Davis, by her attorneys, Mancke, Wagner & Spreha, who respectfully represent: 1. Mary V. Davis is an adult individual residing at 1611 Bridge Street, New Cumberland, Cumberland County, Pennsylvania. 2. Your Petitioner is a licensed operator of motor vehicles in the Commonwealth of Pennsylvania who has received a notice of license recall as a result of an alleged neuropsychia~c condition, a copy of said notice is attached hereto and made a part hereof as Exhibit A. 3. Your Petitioner believes that said action is illegal, unjust and improper for reasons which include, but are not limited to, the following: (a) Your Petitioner does not have a neuropsychiatric condition which prevents her from safely operating a motor vehicle; (b) the Department of Transportation has imprepefly and/or illegally compared her medical condition with the standards of the Department of Transportation; (c) the action of the Department of Transportation was based on a violation of confidentiality regulations which include, but are not limited to, HIPAA Pdvacy Regulations, any rights under the Vehicle Code, under 50 Pa.C.S. §7111,71 Pa.C.S. §1690.108, 42 Pa.C.S. ~944, 28 Pa. Code §115.27, 42 CFR §2.1, 42 USCS §290dd-2 and 28 Pa.Code VERIFICATION I hereby verify that the statements made in this document are true and correct.
