Litsinger, Owners Jim Miller Custom Builders, Inc.,: Contractor : IN THE COURT OF COMMON PLEAS OF CUMBERLAND COUNTY, PENNSYLVANIA NUMBER 0/- WHEREAS, Jim Miller Custom Builders, Inc. is about to proceed with certain construction and excavation work upon certain land now owned by James S. Litsinger and Kristen N. R. Litsinger (the "Owners") situate in the Township of Silver Spring, Cumberland County, Pennsylvania, more particularly bounded and described on Exhibit A attached hereto. NOW, this August I ~,, 2001, at the time of and immediately before any authority has been given by the Owners to the Contractor to commence work on, or to furnish or purchase materials for the aforesaid work, in consideration of the making of said contract with the Contractor and the further consideration of One Dollar to the Contractor paid by Owners, Contractor hereby agrees that no liens or claims shall be filed or made against said land, or any part, piece, parcel or lot thereof, by the Contractor, or any subcontractor, or by any materialmen, workmen or other persons for or on account of any labor provided or materials furnished or purchased, or any extra labor or materials provided, furnished or purchased for said construction and excavation work, hereby expressly waiving any and all rights to file or make such liens and claims. AND, in furtherance hereof, the Contractor does hereby represent and warrant that as of the time of the execution hereof, neither the Contractor, nor any sub- contractors, materialmen, workmen or any other persons have commenced any work on, or furnished or purchased any materials for the aforesaid construction. IN WITNESS WHEREOF, the Contractor, intending to be legally bound hereby, has duly executed this Stipulation on the aforesaid day, month and year. Authorized Representative 68222 2 EXHIBIT "A' ALL THAT CERTAIN tract or parcel of land being situated in Silver Spring Township, Cumberland County, Pennsylvania, more particularly bounded and described as follows, to wit: BEGINNING AT A POINT on the Northeastern right-of-way line of Stone Run Drive, a 50 foot wide right-of-way, said point being the Southwestern corner of Lot #22; thence along the Northeastern right-of-way line of Stone Run Drive North 55° 00' 00" West a distance of 85.00 feet to a point, said point being the beginning of an arc connecting the Northeastern right-of-way line of Stone Run Drive to the Southeastern right-of-way line of a future street; thence by a curve to the right having a radius of 25.00 feet and an arc length of 39.27 feet to a point on the Southeastern right-of-way line of a future street thence by said right-of-way line North 35° 00' 00' East a distance of 125.00 feet to a point on the line of land now or late of M. John and Lloyd J. Edris; thence along the line of land now or late of M. John and Lloyd J. Edris South 55° 00' 00" East a distance of 110.00 feet to a point, said point being the northwest corner of Lot #22; thence along the Northwest line of said lot South 35° 00' 00' West a distance of 150.00 feet to a point, the PLACE OF BEGINNING. Being Lot #21 of a plan of lots known as "Walnut Point, Phase 1', and containing 16,365.87 square feet or 0.3757 acres.
