Nudel, PC, and respectfully files this Complaint for Confession of Judgment for Possession as follows: 1. Plaintiff, Hampden Center, Inc., is a Pennsylvania corporation with a business address of 444 Park Avenue South, Suite 302, New York, New York 10016. 2. Plaintiff is the owner of real property known as Hampden Centre Shopping Center, Mechanicsburg, Hampden Township, 17050 wife, 4900 Carlisle Pike, Cumberland County, ( "Shopping Center") . Pennsylvania 3. Defendants, Walter Dewall and Nancy Dewall, husband and are individuals trading and doing business as West Coast Video, having a business address of 4900 Carlisle Pike, Space D- 1, Mechanicsburg, Cumberland County, Pennsylvania 17050 and a home address of P.0. Box 105, York Springs, Pennsylvania 17372. 4. On or about January 6, 1999, Plaintiff as landlord and Defendants as tenants, entered into an Agreement of Lease ("Lease") for 4,040 square feet of commercial space known as space D-1 of Hampden Centre Shopping Center located at 4900 Carlisle Pike, Mechanicsburg, Cumberland County, Pennsylvania 17050 ("Premises"). A true and correct copy of the Lease is attached hereto and made a part hereof as Exhibit "A". 5. Defendants are in default under the terms of the Lease as hereinafter set forth. 6. No judgment has been entered on the Lease in this or any other jurisdiction prior to this action. 7. The Lease has not been assigned. 8. Judgment is not being entered by Confession against a natural person in connection with a residential lease. 9. The Lease provides, inter alia, for the payment of base rent ("Rent") and the pro rata share of common maintenance expenses, insurance, and taxes ("Additional Rent") and in the event of default, interest, costs of suit and attorneys fees. 10. Defendants are in default under the terms and conditions of the Lease in that Defendants have failed to pay Rent and Additional Rent when due and owing in the amount of $13,296.86. 11. The Lease provides, inter alia, that all amounts unpaid by Defendants shall bear an interest rate of 18% per annum, but not in excess of the maximum legal rate. 12. The Lease provides, inter alia, that in the event of default by Defendants, Plaintiff may Confess Judgment against Defendants for possession of the Premises. 13. The Lease provides, inter alia, that in the event of default by Defendants, Defendants are liable for Plaintiff's attorneys fees of not less than $1,000.00 incurred to regain possession of the Premises. WHEREFORE, Plaintiff demands judgment for Possession of Real Property in accordance with the terms of the Lease and as authorized by the Warrant appearing in the attached Lease together with interest, costs of suit and attorneys fees.
