MUMPER CONSTRUCTION, INC., CONTRACTOR IN THE COURT OF COMMON PLEAS CUMBERLAND COUNTY, PENNSYLVANIA STIPULATION AGAINST LIENS WHEREAS, JOHN E. BAUGHMAN and ROBIN ADAMS BAUGHMAN, of 9 Sunfire Avenue, Camp Hill, Pennsylvania, is about to execute contemporaneously herewith, a contract with J. W. MUMPER CONSTRUCTION, INC. of 840 Sawgrass Lane, Mechanicsburg, Cumberland County, Pennsylvania, for the erection of a dwelling upon a lot of land situate as follows: ALL THAT CERTAIN Lot in the property known, named and identified in the Declaration, referred to below, as "Lindenwood, a Planned Community," located in Upper Allen Township, Cumberland County, Pennsylvania, which has heretofore been submitted to the provisions of the Pennsylvania Uniform Planned Community Act, 68 P~C.S.A. Sections 5101 et seq., by the recording in the Office of the Recorder of Deeds of Cumberland County, Pennsylvania, the Declaration for Lindenwood, a Planned Community ("Declaration"), dated August 28, 1997, recorded August 28: 1997, in Miscellaneous Book 555, Page 806, and as amended by First Amendment to Declaration for Lindenwood, a Planned Community ("First Amendment"), dated April 28, 1999, recorded April 28, 1999, in the Office of the Recorder of Deeds of Cumberland County, Pennsylvania, in Miscellaneous Book 611, Page 193, and as amended by Second Amendment to Declaration for Lindenwood, a Planned Community ("Second Amendment"), dated April 17, 2002, recorded April 19, 2002, in the Office of the Recorder of Deeds of Cumberland County, Pennsylvania, in Miscellaneous Book 686, Page 2571, and as amended by Third Amendment to Declaration for Lindenwood, a Planned Community ("Third Amendment"), dated January 9, 2003, recorded January 10, 2003, in the Office of the Recorder of Deeds of Cumberland Connty, Pennsylvania, in Miscellaneous Book 693, Page 1581, designated in such Declaration (as amended by the First Amendment and Second Amendment and Third Amendment) as Lot No. 32 (Identifying Number), described in Section 2.2 of the Declaration (as amended by the First Amendment and Second Amendment and Third Amendment) and shown (and described) in Exhibit E of the Declaration, Exhibit B- 1 of the First Amendment or Exhibit C-3 of the Second Amendment or Exhibit A-4 of the Third Amendment. CONTAINING .6680 acres, more or less. BEING LOT NO. 32, of the Final Subdivision of Lots 30, 31 & 32 of Lindenwood Phase II, dated October 23, 2002, recorded November 5, 2002, in Plan Book 86, Page 39. UNDER AND SUBJECT to any and all restrictive covenants, conditions, restrictions, rights-of-way, easements and agreements of record, including, but not limited to, Final Subdivision Plan for Phase I, Lindenwood, dated February 3, 1997, last revised July 17, 1997, recorded in the Office of the Recorder of Deeds of Cumberland County, Pennsylvania, in Plan Book 75, Page 29 and Final Subdivision Plan of Phase II, Lindenwood, dated December 1, 1998, last revised April 14, 1999, recorded in the Office of the Recorder of Deeds of Cmnberland County, Pennsylvania, in Plan Book 78, Page 121. BEING THE SAME PREMISES which Lindenwood, Inc., a Pennsylvania Corporation by its deed dated February 1, 2003 and recorded March 20, 2003 in the Office of the Recorder or Deeds in and for Deed Book 256, Page 843, granted and conveyed unto John E. Baughrnan and Robin Adams Baughman, husband and wife. NOW, the / q day of October, 2003, at the time of and immediatelybefore the execution of the principal contract, and before any authority has been given by the said JOHN E. BAUGHMAN and ROBIN ADAMS BAUGHMAN, to the said J. W. MUMPER CONSTRUCTION, INC. to commence work on the said building, or purchase materials for the same in consideration of the making of the said contract with J. W. MUMPER CONSTRUCTION, INC. and the further consideration of One Dollar, to J. W. MUMPER CONSTRUCTION, INC. paid by JOHN E. BAUGHMAN and ROBEN ADAMS BAUGHMAN, it is agreed that no lien shall be filed against the building by the contractor, or any sub-contractor, nor by any of the material men or workmen or any other person for any labor, or materials purchased, or extra labor or materials purchased for the erection of said building, the fight to file such liens being expressly waived.
