HomeMy WebLinkAbout03-5476Stipulation .4gamst Liens THIS AGREEMENT made the by and between ML Builders 641 Wiskey Spring Road Boilings Springs, PA 17007 hereinafter referred to a~ Contractor, ML Builders' 641Wiskey Spring Road Boiling Springs, PA 17007 AND Owner, whereby the former undertook and agreed to erect and construct n day of October 2003 ,hereinaftarreferredta ~ dwelling on that certain lot of ground situate in in South Middleton Township, Cumberland County, Pennsylvania. Tract No. 1: Having a frontage of 37/1/2 feet on Pine Road and extending northwardly a depth of 450 feet on the Eastern side a depth of 393 feet on the western side to points marked by stakes and having a width in the rear along an old fence line of 84 feet. Tract No. 2: Having a frontage of 75 feet on the Pine Road; and extending to Northward a depth of 450 feet, more or less, on the West, a depth of 506 feet, more or less, on the East, and having a width in the rear of 112.5 feet, more or less. NO~/ THEREFOP~. , THIS AGREEMENT PFITNE$$ETH: That the said Contractor, for and in consideration of the sum of ($ L O0) Dollar to it in hand paid by O~ner, the receipt whereof ls hereby acknowledged, and the further consideration mentioned in the agreement aforesaid, for themselves and their subcontractors, ai;d all parties acting through or under them, covenant and agree that no mechanic's llen~ ar claims shall be .filed or maintained by them or an)' of them against the said buildings and the lot of ground appu~taannt thereta for or on account of any work done or materials furnished by them or any of them under said t~ntract or otherwise, for, towards, in, or about the erection and construction of the said buildings on the lot ab~ve d~cribed. and the said Contractor, for themselves, their subcontractors and others under them hereby expressly waive and relinquish the right to have, file, and maintain any mechanic's liens or claims against the said buildings o~ any them, and agree that this instrument, waiving the right of lien, shall be aa independent covenant.
