Hoffman and Gall C. Hoffman of Camp Hill, Cumberland County, Pennsylvania, is about to execute contemporaneously herewith, a contract with of Custer Homes, Inc. of 2805 Old Post Road, Dauphin County, Pennsylvania 17110, lbr the erection of a single lhmily dwelling home upon a lot of land situate in Silver Spring Township, Cumberland County, Pennsylvania, being designated as Lot No. 6, Sterling Glen. See Exhibit "A". NOW, ,,,~u~,/,~ ,l t~ ,2003, at the time of and immediately before execution of the principal contract, and before any authority has been given by the said Custer Homes, Inc., to commence work on the said building, or purchase materials for the same in consideration of the making of the said contract with Custer Homes, Inc. and the further consideration of One Dollar to Custer Homes, Inc. paid by Brian L. Hoffman and Gail C. Hoffman, it is agreed that no lien shall be filed against the building by the contractor, or any sub-contractor, nor by any of the material men or workmen or any other person for any labor, or materials purchases, or extra labor or materials purchased for the erection of said building, the right to file such liens being expressly waived. Stan Custer, Jr., Pre Ail that certain piece or parcel of land situate in Silver Spring Township, Cumberland County, Pennsylvania, being known and numbered as Lot No. 6 on the Final Subdivision and Land Development Plan for Sterling Glen, said Plan dated January 17, 2002 and recorded in the Office of the Recorder of Deeds of Cumberland County on May 29, 2002 in Cumberland County Plan Book 85, Page 67, and as more particularly bounded and described as follows, to wit: Beginning at a point on the right-of-way of Springdale Way at the dividing line between Lot No. 5 and Lot No. 6 as appearing on the aforesaid Plan; thence continuing along the dividing line between Lot No. 5 and Lot No. 6 as appearing on the aforesaid Plan, South 63 degrees 43 minutes 13 seconds East for a distance of 112.70 feet to a point at the dividing line between Lot No. 6 and Lot No. 7 as appearing on the aforesaid Plan; thence continuing along the dividing lille between Lot No. 6 and Lot No. 7 as appearing on aforesaid Plan, North 26 degrees 16 minutes 47 seconds East for a distance of 165.91 feet to a point on the right-of-way of Springdale Court; thence continuing along the right-of-way of Springdale Court, North 63 degrees 43 minutes 13 seconds West for a distance of 91.70 feet to a point along the right-of-way of Springdale Court at or near the intersection of Springdale Way, all as appearing on the aforesaid Plan; thence continuing along a curve at the intersection of Springdale Court and Springdale Way as appearing on the aforesaid Plan, said curve having a radius of 21.00 feet and an arc distance of 32.99 feet and a chord length of 29.70 feet to a point on the right-of-way of Springdale Way as appearing on the aforesaid Plan; thence continuing along the right-of-way of Springdale Way as appearing on the aforesaid Plan, South 26 degrees 16 minutes 47 seconds West for a distance of 145.91 feet to a point, the place of BEGINNING.
