HomeMy WebLinkAbout03-5500RELEASE AND WAIVER OF LIENS Know all men by these presents, that we, the undersigned, Contractor, WIRL CONSTRUCTION, together with all Subcontractors, Mechanics and Material Men, for value received, have remised, released, and waived, and by these presents, do, for ourselves and heirs, executors and administrators, remise, release and waive, to and in favor of WILLIAM J. WIRL, JR., of 855 York Road, Carlisle, Pennsylvania 17013, his successors and assigns, ("owner") our right under Act of Assembly, entitled, "The Mechanics Lien Act of 1963," to file or enter on record and Mechanics Lien or Liens against all the certain lot of ground known as Lot No.~, Northridge, Plan Book 76, Page 56 situate in North Middleton Township, Cumberland County, Pennsylvania, for any and all work done upon, or materials furnished for the dwelling house or other buildings on said lot or lots by us in the erection, building and completion thereof, or that may hereafter be done or furnished on the same, so that the said property shall be and will be free of all such lien, so far as our claims are concerned. Contractor and any and all parties acting for, through or under Contractor, them or any of them, or any one, covenant and agree with Owner that no mechanic's liens or claims shall be filed or maintained by Contractor, them or any of them, or any one, or any of the undersigned, against the above-described real estate, or the buildings or other improvements to be erected thereon, or any of them, or the estate (including a lease-hold estate), interest or tide thereto of Owner, for or on account of any work done under any agreement or under any supplemental contract, verbal or written, or contract for extra work relating to the erection, construction, alteration, or repair and completion of buildings or other improvements, on said lot, or any of them, or otherwise; and Contractor for Contractor and any and all parties acting through or under Contractor, them or any of them, or any of the undersigned, hereby expressly waives and relinquishes the right to have, file or maintain mechanic's liens or claims against said real estate or buildings or other improvements or any of them. Contractor, and each of the undersigned, for itself and its successors and assigns, and all parties acting or claiming through or under them, do hereby release and waive any rights it or they may now or hereafter have to file or maintain mechanic's liens or claims against the above-described real estate, or buildings or other improvements to be erected thereon, or any of them, or the estate, interest or title thereto of Owner, for or on account of any work done prior to the date hereof under any agreement or any prior agreement relating to services to be rendered in connection with said lot or on account of any work done in the future under any existing or future agreements, oral or written. This agreement releasing and waiving the right of lien shall be an independent covenant and shah operate and shall be effective as well with respect to work done and materials furnished under any supplemental contract for extra work in the erection, construction, alteration, or repair and completion of any said buildings or other improvements, as to any work and labor done and materials furnished and relating to the lot aforesaid. This Release and Waiver of Liens may be filed with the Prothonotary of the Court of Common Pleas of the County of Cumberland, Pennsylvania, or other proper place in which the above-described lands are located. It is the express intent of the parties to be legally bound hereby in accordance with the provisions of the Mechanic's Liens Act of 1963. This Release and Waiver of Liens is given in consideration of One ($1.00) Dollar, receipt of which is hereby acknowledged, in consideration of any existing past, or future agreements or contracts or orders (all of which are referred to as an agreement herein), and is given with intent to be legally bound hereby, regardless of any actual consideration (paymenO. ~ Wdtness our hands and seals the '~ ~ day of .2oo_Z. l:r~nce of For Excavating Cellar.
