OZOG AND TERI D. OZOG of 108 PROWELL DRIVE, APT. D, CAMP HILL, Pennsylvania, is about to execute contemporaneously herewith, a contract, with HAUBERT HOMES, INC. of 15 CENTRAL BLVD, CAMP HILL Pennsylvania. for the erection of a story building upon a lot of land situate and commonly known as 1406 Inverness Drive, Township of Hampden, Cumberland County, Pennsylvania, as set forth in the deed dated October I-~, 2003, recorded at Deed Book __, Page __, in the Recorder's Office for Cumberland County, Pennsylvania as more specifically described in Exhibit "A" which is incorporated herein and attached hereto. NOW. October 17 ~1:~2003, at the time of and immediately before the execution of the prin- cipal contract, and before any authority has been given by the said Owner to the said Contractor to commence work on the said building, or purchase materials for the same in consideration of the making of the said contract with Contractor and the further consideration of One Dollar, to Contractor paid by Owner , it is agreed that no lien shall be filed against the building by the contractor, or any sub-contractor, nor by any of the material men or workmen or any other person for any labor, or materials purchased, or extra labor or materials purchased for the erection of said building, the right to file such liens being expressly waived. Ozog v Exhibit "A" ALL THAT CERTAIN tract or parcel of land being situate in Hampden Township, Cumberland County, Pennsylvania, more particularly bounded and described as follows, to wit: BEGINNING at a point located on the easterly right-of-way line of Inverness Drive, Twenty-five Feet (25') from the centerline of the same and being a front property comer of Lot 14; thence along said Lot 14, South 89 Degrees 16 Minutes 35 Seconds East (S89°16'35"E) a distance of 116.55 feet to a point, said point being on the westerly right-of-way line of Good Hope Road; thence along said westerly right-of-way, South 05 Degrees 01 Minutes 19 Seconds East (S05° 01'19"E) a distance of 145.25 feet to a point, said point being a comer of Lot 12; thence along said Lot 12, North 64 Degrees 00 Minutes 07 Seconds West (N64°00'07"W) a distance of 163.50 feet to a point on said easterly right-of-way; thence along said easterly right- of-way, by curve to the left having a radius of 175.00 feet an arc distance of 77.20 feet being subtended by a chord of North 13 Degrees 21 Minutes 39 Seconds East (N13°21'39"E) a distance of 76.57 feet to a point, said point being the POINT OF BEGINNING. CONTAINING 14,313.25 square feet or 0.33 acres of land. BEING Lot No. 13 as shown on the Final Subdivision Plan of Fairwinds, Phase 4 recorded in the Office of the Recorder of Deeds, Cumberland County, in Plan Book 87, Page 11, plan titled "Fairwinds, Final Phase 4", as prepared by Melham Associates, PC, dated February 26, 2003.
