NOTICE TO DEFEND
You have been sued in court. If you wish to defend against the
claims set forth in the following pages, you must take action within

entering a written appearance personally or by attorney and filing in
writing with the court your defenses or objections to the claims set

1. Plaintiff is Carter Lumber Company. Defendants are Country
.Lane Construction, LLC and Sandra Lichtenberger.
COUNT I
Carter Lumber Company vs. Country Lane Construction, LLC
2. At the oral instance and request of Defendant, Country Lane
Construction, LLC, Plaintiff sold and delivered to Defendant, Country
Lane Construction, LLC, goods and services at the times, of the
kinds, in the quantities and for the prices set forth in Plaintiff's
books of original entry, a true and correct copy of which is attached
hereto, made part hereof, and marked Exhibit "A".
3. Defendant, Country Lane Construction, LLC, received and
accepted the goods and services described in Exhibit "A".
4. The prices, including service and/or other charges, if any,
which are set forth in Exhibit "A", are the fair, reasonable and
market prices and the prices which Defendant, Country Lane
Construction, LLC, agreed to pay.
5. All credits, if any, to which Defendant, Country Lane
Construction, LLC, is entitled are set forth in Exhibit "A".

6. Although demand has been made, Defendant, Country Lane
Construction, LLC, has failed to make payment of the amount due as
above. As a result of the foregoing, there is due and owing from
Defendant, Country Lane Construction, LLC, to Plaintiff the sum of
$3,769.48, which includes attorney's fees of $628.24 in accordance
with the credit application and/or terms of sale.
WHEREFORE, Plaintiff claims there is now justly due and owing
by Defendant, Country Lane Construction, LLC, the sum of $3,769.48,
with interest at 18% from January 29, 2007 and costs on Count I.
COUNT II
Carter Lumber Company vs. Country Lane Construction, LLC
7. Paragraphs 1 through 6 are incorporated by reference.
8. On or before January 29, 2007, Plaintiff delivered goods and
services to Defendant, Country Lane Construction, LLC, at the times,
of the kinds, in the quantities, and for the prices set forth in
Plaintiff's books of original entry, true and correct copies of which
are shown as Exhibit "A".
9. Defendant, Country Lane Construction, LLC, received and
accepted the goods and services shown on Exhibit "A", and benefitted
thereby.

10. Defendant, Country Lane Construction, LLC, received the
.benefit of the goods and services from Plaintiff and it is
unconscionable for Defendant, Country Lane Construction, LLC, to
receive those benefits without making restitution to Plaintiff.
11. It can be inferred from the acts in the light of the
surrounding circumstances Defendant, Country Lane Construction, LLC,
implied that it would pay Plaintiff for the goods and services.
12. Under the circumstances of the case, the ordinary course
of dealing and the common understanding of mean, there is shown a
mutual intention by Plaintiff to sell and Defendant, Country Lane
Construction, LLC, to pay for the goods and services.
13. All conditions precedent to the present action have
occurred or been performed.
14. Defendant, Country Lane Construction, LLC, is liable to the
Plaintiff in the sum of $3,769.48 under the theory of quantum
valebant, quantum meruit, quasi contract, implied contract, goods had
and received, and/or unjust enrichment.

WHEREFORE, Plaintiff claims there is now justly due and
.owing by Defendant, Country Lane Contruction, LLC, the sum of
$3,769.48 with interest at 18% from January 29, 2007 and costs on
Count II.
COUNT III
Carter Lumber Company vs. Sandra Lichtenberger
15. Plaintiff incorporates by reference all of the
allegations contained in the preceding paragraphs hereof, as if more
fully set forth herein.
16. In order to induce the Plaintiff to extend credit to
Country Lane Construction, LLC, all of which is more fully described
'in Count I hereof, Defendant, Sandra Lichtenberger, executed a
guaranty of the liability of Country Lane Construction, LLC. A true
and correct copy of said guaranty is attached hereto, made part
hereof and marked Exhibit "A".
17. Although Plaintiff has made demand upon Defendant,
Sandra Lichtenberger, for the payment of the aforementioned sum,
Defendant, Sandra Lichtenberger, has failed and refused to pay the
same or any part thereof.

WHEREFORE, Plaintiff demands judgment against the Defendant,
.Sandra Lichtenberger, in the sum of $3,769.48, with interest at 180
from January 29, 2007 and costs on Count III.
