AHMED AND RABIYA WAJIH of 4256 Nantucket Drive, Mechanicsburg Pennsylvania. is about to execute contemporaneously herewith, a contract, with H~UBERT HOMES, INC. of 15 Central Blvd., Camp Hill, Pennsylvania. for the erection of a story building upon a lot of land situate and commonly known as Lot 31 Inverness Drive, Township of Hampden, Cumberland County, Pennsylvania, as set forth in the deed dated~o~ tc),~C~5~ recorded at Deed Book , Page , in the Recorder'~ Office for Cumberland County, Pennsylvania, as more specifically described in Exhibit "A" which is incorporated herein and attached hereto. NOW. October 21, 2003 ~gX . at the time of and immediately before the execution of the prin- cipal contract, and before any authority has been given by thc said Owner to the said Contractor to commence work on thc said building, or purchase materials for thc same in consideration of the making of the said contract with Contractor and the further consideration of One Dollar. to Contractor paid by Owner . it is agreed that no lien shall be filed against thc building by thc contractor, or any sub-contractor, nor by any of thc material mcn or workmen or any other person for any labor, or materials purchased, or extra labor or materials purchased for thc erection of said building, thc right to file such liens being expressly waived. Ahmed, Rahab' a Waji~ ' Exhibit "A" ALL THAT CERTAIN tract or parcel of land being situate in Hampden Township, Cumberland County, Pennsylvania, more particularly bounded and described as follows, to wit: BEGINNING at a point located on the westerly right-of-way line of Inverness Drive, twenty-five (25') from the centerline of the same and being a front property comer of Lot 8; thence along said Lot 8 and Lot 7, north 77 degrees 36 minutes 30 seconds West (N 77°36'30"W) a distance of 184.64 feet to a point, said point being a comer of Lot 38; thence along said Lot 38, north 36 degrees 02 minutes 29 seconds east (N 36° 02' 29") a distance of 121.28 feet to a point, said point being a comer of Lot 32; thence along said Lot 32, south 64 degrees 00 minutes 07 seconds east (S 64° 00' 07" E) a distance of 147.79 feet to a point on said westerly right-of-way; thence along said westerly right-of-way, south 25 degrees 59 minutes 53 seconds west (S 25° 59' 53" W) a distance of 8.00 feet to a point; thence along the same, by a curve to the left having a radius of 225.00 feet an arc length of 69.07 feet being subtended by a chord of south 17 degrees 12 minutes 16 seconds west (S 17° 12' 16" W) a distance of 68.80 feet to a point, said point being the POINT OF BEGINNING. CONTAINING 15,708.30 square feet or 0.36 acres of land. BEING Lot No. 31 as shown on the Final Subdivision Plan of Fairwinds, Phase 4 recorded in the Office of the Recorder of Deeds, Cumberland County, in Plan Book 87, Page 11, plan titled "Fairwinds, Final Phase 4", as prepared by Melham Associates, PC, dated February 26, 2003.
