CUMBERLAND COUNTY, PENNSYLVANIA STIPULATION AGAINST LIENS Finkeabimder WHEREAS,Barry L. ~mdCatheriae M. entered into a contract with S&A Custom Built Homes~ Inc. ~ dated October 20, 2001, to provide materials and/or perform labor necessary for the construction and erectio~ or the alteration and repair of (a) building(s) upon those certain pieces or parcels of land situtated in Wemt Pennmboro Township, ~umberland County. Pennsylvania, being more particularly bounded and described as follows: SEE ATTAc~ ~.x. IBIT "A" NOW, THEREFORE, it is hereby stipulated and agreed by and between the said parties, as part of the said contract and for the consideration therein set forth, that neither the undersigned contractor, any sub-contractor o~ materialman, nor any other person furnishing labor or materials qo the said' contractor under this contract shall file a lien, commonly called ~mechanic~s lien, for work done or materials furnished to the said building or any part thereof. This stipulation is made and intended to be filed with the County Prothonotary within ten (10) days after date, in accordance with requirements of Act of Assemble of Pennsylvania, in.such case provided. (CONTRACTOR) "/~~//~ (seal~ ALL THAT CERTAIN tract of land situate in the Township of West Peunsboro, County of Cumberland, and Commonwealth of Pennsylvania, being more particularly bounded and described as follows, to wit: BEGINNING at a steel pin set on the southeastemmost dedicated right-of-way line of Watson Drive, at the common point of adjoiner of Lots #15 and #16 on the hereinafter mentioned plan; thence extending along the southeastermnost dedicated right-of-way line of Watson Drive, North forty-seven (47) degrees thirteen (13) minutes thirty (30) seconds East, for a distance of two hundred and zero hundredths (200.00) feet to a steel pin at Lot #17; thence extending along Lot #17, South forty-two (42) degrees forth-six (46) minutes thirty (30) seconds East for a distance of three hundred seventy-nine and forty-six hundredths (379.46) feet to a steel pin at Lands now or formerly of Robert W. Failor; thence extending along lands now or formerly of Failor, South fifty-six (56) minutes zero (00) minutes fifty (50) seconds West for a distance of two hundred five and thirty-eight hundredths (205.38) feet to a steel pin at Lot #15; thence extending along Lot # 15 North forty-two (42) degrees forty-six (46) minutes thirty (30) seconds West, for a distance of three hundred forty-eight and fifty-three hundredths (348.53) feet to a steel pin set on the southeastemmost dedicated right-of-way line of Watson Drive, said pin marking the place of BEGINNING. CONTAINING 1.671 acres, and being designated as Lot #16 on a final plan of subdivision of Cross Road School Estates, Phase Ill, prepared for Liberty Associates by Rodney Lee Decker & Assocs., dated June 3, 1997, and recorded in the Office of the Recorder of Deeds in and for Cumberland County, Pennsylvania, in Plan Book 82, at page 77.
