I. Plaintiff is ANTHONY L. SMURO, whose current address is 119 Enola Drive,

2. Defendant is SHELLY HEINZIG, whose current address is 1067 Nanroc Drive,
Mechanicsburg, Cumberland County, Pennsylvania.
3. Plaintiff is the Father, and Defendant is the Mother of the Child, who is the
subject of this action.
4. Plaintiff seeks shared legal and partial physical custody of:

5. The parties are not married and do not live together.
6. From birth to Spring 2001, the Child lived at 120 W. Keller Street,
Mechanicsburg, Cumberland County, Pennsylvania with the Plaintiff, the Defendant and
Defendant's son Colby Ruth.
7. From to Spring 2001 to Summer 2001, the Child lived at rnaternaI grandmother's
residence, Mechanicsburg, Cumberland County, Pennsylvania with the Defendant and
Defendant's son Colby Ruth, the maternal grandmother and her husband, and the Defendant's
brother, Jimmy.
8. During Summer 2001, the Child lived at 120 W. Keller Street, Mechanicsburg,
Cumberland County, Pennsylvania with the Plaintiff, the Defendant and Defendant's son Colby
Ruth.
9. From Summer 2001 to Fall 2001, the Child lived at Belle Terre Apartments,
Mechanicsburg, Cumberland County, Pennsylvania with the Defendant and Defendant's son
Colby Ruth, and Defendant's friend Melissa.
10. From Fall 2001 to Winter 2001, the Child lived at Wesley Drive, Mechanicsburg,
Cumberland County, Pennsylvania with the Defendant and Defendant's son Colby Ruth, and
Defendant's husband, Jason Heinzig.
11. Frorn Winter 2001 to present, the Child has lived at 1067 Nanroc Drive,
Mechanicsburg, Cumberland County, Pennsylvania with the Defendant and Defendant's son
Colby Ruth, and Defendant's husband, Jason Heinzig; Mr. Heinzig's mother and sister; and
Defendant's friend and the friend's child.
12. Plaintiff has no information of a custody proceeding concerning the Child
pending in a court of this Commonwealth.
13. The best interests and permanent welfare of the Child will be served by the relief
requested.
14. Plaintiff has not participated as a party, witness or in another capacity or in other
litigation concerning the custody of the Child in this or another Court.
15. Plaintiff currently lives with his roommate, Dennis Martin.
16. Defendant lives with her husband, Jason Heinzig; the Child, Anthony Joseph,
another son, Colby Ruth; her mother-in-law and sister-in-law; and Defendant's friend and the
friend's child, at 1067 Namoc Drive, Cumberland County, Pennsylvania.
WHEREFORE, Plaintiff respectfully requests that the Court grant the parties shared
legal custody and that he be awarded partial physical custody of his son, Anthony Joseph Smuro.

2. A Conciliation Conference was heId on September 4, 2003, with the following individuaIs
in attendance: The Mother, Pamela S. Krebs, with her counseI, JoAnne Murphy, Esquire, and the
Father, John R. Krebs, with his counsel, Lori K. SerrateIli, Esquire.
3. The submission of this Report and proposed Order was initially deferred at counsels' request
pending resolution of a daycare issue. After submission, the report and order were again held due to
scheduling concerns which had deveIoped between the parties as reported to the conciIiator by letters
from counsel. A teIephone conference was held between counsel for each party and the conciliator on
January 12, 2004. It was determined that the custody evaluation was underway and expected to be
completed in March. CounseI agreed that the parties were continuing to follow the temporary schedule
estabIished at the September 4,2003 conciIiation conference pending compIetion of the evaluation and
that no Court Order is necessary at this time. It was agreed that counsel for either party could contact
the conciliator within sixty days of receipt of the evaluator's written recommendation to schedule an
additional conference, if necessary.

COMPLAINT
Plaintiff, SECCO, Inc., through it attorneys, Goldberg, Katzman & Shipman, P.C., files
the within Mechanic's Lien Complaint and in support thereof states the following:
COUNT I
MECHANICS' LIEN
1. Plaintiff is SECCO, Inc., a HV AC, Mechanical and Electrical Contractor with a
business address at I II Primrose Avenue, Camp Hill, PA 17011.
2. Defendant is Harding's Restaurant, a corporation with a business address at
3817 Old Gettysburg Road, Camp Hill, PA 1701 I.
3. At all times relevant, the Defendant owns and owned the buildings and curtilage
located at 38 I 7 Old Gettysburg Road, Camp Hill, P A 1701 I.
4. On or about April 26,2002, Defendant contracted with Plaintiff to perform work
at 3817 Old Gettysburg Road, Camp Hill, PAl 70 11.
5. Plaintiff commenced the work shortly thereafter. The work consisted of the
installation of a new refrigeration system and numerous repairs to the existing air conditioning
systems.
6. On or about November 13, 2003, Plaintiff filed a Mechanic's Lien Claim in the
Court of Common Pleas of Cumberland County at No. 2003-ML-5776. A true and correct copy
of this claim is attached hereto as Exhibit" A".
7. The nature and type of work and materials supplied were labor and materials for
repairs and additions to owner's commercial property located at 38 I 7 Old Gettysburg Road,
Camp Hill, PA 17011 and as evidenced by the attachments to the Mechanic's Lien representing a
total principal amount due of$9,II9.81.
8. PlaintiffbiIIed, net of any applicable credits, the sum of $13,071.72 for all work
completed.
9. Despite Plaintiff completing the work on or about October 9, 2002, Defendant has
failed to pay for all of the work completed.
10. Plaintiff's work was performed in a reasonable and workmanlike manner.
I I. In accordance with the terms of the Agreement between the Plaintiff and
Defendant, the outstanding amount due and owing for said work is $9,119.81 plus service
charges of$4,489.16 as agreed to by the owner with interest continuing to accrue.
12. True and correct copies of Plaintiff's billing statements and credits allowed were
attached to the Mechanic's Lien.
13. To date, Defendant has failed to pay the Plaintiff the amount which is due under
the terms of the Agreement for the time and materials expended relative to the work performed
on the premises.

WHEREFORE, Plaintiff, SECCO, Inc. demands judgment in its favor and against
Defendant Harding's Restaurant in the amount of$13,608.97 together, with costs, attorneys'
fees and interest.
COUNT II
BREACH OF CONTRACT
14. The averments contained in paragraphs I through 13 are incorporated herein as
though set forth in their entirety.
IS. As evidenced by the documentation attached to the Complaint, Defendant
contracted with Plaintiff to perform certain work.
16. Plaintiff provided all services and materials in a workman like fashion.
17. Defendant has failed to pay for the work.
18. As agreed to by the Defendant, all invoices outstanding in excess of30 days
accrue interest at the rate of 2% per month.
19. Defendant has breached its obligation to pay for the services rendered and
materials and products provided.
20. Defendant owes Plaintiff $13,608.97 which said amount continues to accrue
interest at the rate of 2% per month.

WHEREFORE, Plaintiff, SECCO, Inc. demands judgment in its favor and against
Defendant Harding's Restaurant in the amount of$13,608.97 together, with costs, attorneys' fees
and interest.

statement of demand:
1. Claimant is SECCO, Inc., a HV AC, Mechanical and Electrical Contractor with a business

2. The Owner is Harding's Restaurant, a corporation with a business address at 3817 Old
Gettysburg Road, Camp HilI, P A 170 II.
3. On or about April 26, 2002, Owner contracted with Claimant to perform work at 3817 Old
Gettysburg Road, Camp Hill ,PA 1701 I, An estimate was provided to the owner.
4. Claimant commenced the work on [date]. The work consisted ofInstallation of New
Refrigeration Systems and numerous repairs to air conditioning systems.
5. The nature and type of work and materials supplied were all labor and materials for repairs and

6. The date of completion of Claimant's work was October 9, 2002. Said work was performed in
a reasonable and workmanlike manner, thus entitling Claimant to payment therefore.
7. To date, Owner has failed to pay Claimant the full amount, which is due for the work
completed relative to the work performed upon the premises.
8. In accordance with the terms of the Agreement between Claimant and Owner, the outstanding
amount claimed to be due and owing for said work is $9,119.81, plus service charges of $2,991.82 as
agreed to by the Owner.. (Exhibit C)
9. To date, Claimant has billed, net of any applicable credits, the sum of$I3,071.72 for all work
completed.
10. To date, Claimant has received $3,911.91. Thereby leaving an outstanding balance of
$9,1 19.81 plus service charges on the unpaid balance of $2,991.82 for a total due of$I2,II 1.63.

I I. A true and correct copy ofSECCO Inc. 's, billing statements detailing the fees incurred and
payments and credits charged is attached hereto as Exhibit A.
12. Owner received a detailed incremental breakdown of both the work performed and the
amounts due and owing to the Claimant. (See Claimant's work details attached hereto as Exhibit B).
13. The improvements and restorations to the property and sub-basement, which are the subject of
the lien, is a Restaurant at 3817 Old Gettysburg Road, Camp Hill, Cumberland County, PA 17011.
WHEREFORE, Claimant claims to have a lien upon the premises herein described in the amount
of$ 9,119.81 plus interest at the legal rate from November II, 2002, plus costs against Owner.

STIPULATION FOR ENTRY OF CUSTODY ORDER
AND NOW, come the parties, ANTHONY 1. SMURO, Plaintiff, and SHELLEY
HEINZIG, Defendant, who hereby agree and stipulate as follows:
I. The parties hereto are the parents of one (I) minor child, ANTHONY JOSEPH
SMURO, born: September 26, 2000.
2. On October 29,2003, Plaintiff filed a Complaint for Custody to the above-
captioned docket number.
3. As a result of discussions between the parties and their counsel, the parties have
reached agreement with respect to custody of Anthony.
4. The parties acknowledge and agree that it is in the best interests and welfare of
Anthony that they have shared legal custody.
5. The parties further acknowledge and agree that it is in Anthony's best interests for
Defendant to have primary physical custody and for Plaintiff to have partial physical custody, as
follows:
a. Plaintiff shall have physical custody of Anthony on alternating weekends
from Friday at 6:00 p.m., until Sunday at 6:00 p.m.
b. Plaintiff shall have physical custody of Anthony for two (2) weeks during
each summer, not to be taken consecutively, and inclusive of his regularly
scheduled weekends, upon thirty (30) days written notice to Defendant.
c. Plaintiff shall have physical custody of Anthony on Father's Day from
6:00 p.m. on the preceding evening until 6:00 p.m., on Father's Day.
d. Defendant shall have custody of Anthony on Mother's Day from 6:00 p.m.
the evening before until 6:00 p.m., on Mother's Day.
e. The Easter holiday shall be divided each year so that Plaintiff has custody
of Anthony on Easter Sunday from I :00 p.m. until 6:00 p.m., when Easter
falls on Defendant's weekend. When Easter falls on Plaintiff's weekend,
Defendant shall have custody of Anthony from Easter Eve at 6:00 p.m.,
until Easter Sunday at 1 :00 p.m., at which time Plaintiff shall have custody
of Anthony until 6:00 p.m. on Easter Sunday. In this event Plaintiff shall
also have the first portion of his regular weekend.
f. Memorial Day, Independence Day and Labor Day shall be alternated. If
the holiday falls on the Monday immediatdy after or the Friday
immediately before the weekend of the parent who also has custody, that
parent shall have the entire three-day weekend. If the parent's holiday
falls on the other parent's weekend, the holiday custody period shall begin
at 10:00 a.m., on the holiday itself and end at 9:00 p.m. The rotation shall
begin with Plaintiff having Memorial Day m 2004.
g. Plaintiff shall have custody of Anthony each year on Thanksgiving from
10:00 a.m., until 3:00 p.m.

h. The parties shall share the Christmas holiday pursuant to a two-segment
arrangement. Segment A shall begin at 12:00 noon on December 24, and
end at 12:00 noon on December 25. Segment B shall begin at 12:00 noon
on December 25, and end at l2:00 noon on December 26. Plaintiffshall
have segment A in the even numbered years and segment B in the odd
numbered years. Defendant shall have segment A in the odd numbered
years and segment B in the even numbered years.
1. In addition to the foregoing, Plaintiff shall have partial physical custody of
Anthony as the parties shall from time to time agree upon and arrange and
the parties shall be free to modify the aforementioned custody
arrangement in accordance with their mutual agreement.
6. The parties shall permit reasonable telephone access between Anthony and the
other parent at all times. They shall use sound discretion as to the time, frequency and duration
of the phone calls.
7. The parties shall share transportation for each exchange of custody as they shall
from time to time mutually agree upon and arrange. Plaintiff acknowledges that he does not
have a valid operator's license and therefore shall not operate a motor vehicle in which Anthony
is a passenger until such time as his operator privileges have been restored.
8. Plaintiff shall refrain from taking Anthony to his f:lther's home in Johnstown,
Pennsylvania until such time as his operator privileges have been restored unless Plaintiff and
Anthony are accompanied by Plaintiff's sister.
9. Plaintiff shall obtain door locks at his home in order to safeguard Anthony more
securely while in his custody.

10. Neither party shall do or say anything to estrange Anthony from the other parent
and both shall encourage his relationship with the other parent and their family members. It shall
be the express duty of each party to uphold the other parent as one whom Anthony shall respect
and love.
11. The parties shall share with each other all infornlation pertinent to all major
aspects of Anthony's life, including but not limited to his education, health, religion, social
adjustment and activities. Both parties shall pmiicipate in and make all major decisions
concerning Anthony and shall cooperate to the fullest possible extent in their son's upbringing.
12. This Stipulation shall be entered as an Order of Court and, as such, shall have the
same force and effect as if this matter had been tried and decided by the Court.
13. This Stipulation and Order shall continue in full force and effect until further
Order of this Court and shall replace and supersede any existing custody arrangements between
the parties or any previous order entered by this or any other court.
14. The parties hereby waive their right to present this Stipulation in open court or to
have their case heard by the Court at this time.

PETITION TO MODIFY CUSTODY ORDER
AND NOW, Plaintiff, ANTHONY L. SMURO, by and through his counsel, Goldberg
Katzman, P.C., and Paul J. Esposito, Esquire, files this Petition to Modify Custody Order, and in
support thereof, avers the following:
1. Plaintiff is Anthony L. Smuro, Father, who currently resides at 4341 Carlisle Pike,
Apartment B4, Camp Hill, Cumberland County, Pennsylvania 17011.
2. Defendant is Shelly Heinzig, Mother, who currently resides at 62 N. 63rd Street,
Apartment 4, Harrisburg, Dauphin County, Pennsylvania 17111.
3. The parties hereto are the parents of one minor child, namely, Anthony Joseph
Smuro, born September 26, 2000.
4. On March 22, 2004, the Court entered a Custody Order granting the parties shared
legal custody. Further, the Court granted Defendant primary physical custody and Plaintiff
specified partial physical custody. A copy of said Order is attached hereto, made a part hereof
and marked Exhibit "A."
5. In early November 2005, Defendant entered an inpatient drug rehabilitation
program which, to the best of Plaintiff's knowledge, was the result of her abuse of heroin and
oxycontin.
6. At that time, Defendant's grandparents initially took custody of Anthony and
shortly thereafter, pursuant to the agreement of the parties to this Petition, Plaintiff assumed sole
custody of Anthony.
7. Plaintiff assumed total responsibility for his son immediately upon assuming
custody, including the provision of regular daycare, overseeing his school work, involving him in
T-ball and otherwise discharging all of his duties as a parent.
8. Notwithstanding her release from rehab in January 2006, Defendant told Plaintiff
that she was satisfied to have Anthony remain in his custody.
9. Plaintiff continued to exercise primary custody of Anthony, allowing Defendant
liberal visitation throughout the winter and spring of 2006.
10. On Sunday, July 9, 2006, Defendant was supposed to return Anthony to Plaintiff
at the end of the weekend; however, she telephoned Plaintiff on that date and indicated that he
should pick Anthony up on Monday.
11. On Monday, July 10,2006, Defendant told Plaintiff that she intended to keep
Anthony in her custody.
12. Plaintiff believes and therefore avers that Defendant has demonstrated her
inability to provide stability for Anthony in that she has had at least three (3) different
residences, has lived with at least three (3) different men, and has had at least two (2) different
jobs since January 2006.

13. Anthony has thrived while in the care and custody of Plaintiff, including showing
what was described as drastic improvement in school and demonstrating a much more contented
and happy disposition.
14. Plaintiff is willing and capable of providing an appropriate home for Anthony;
whereas, he does not believe that Defendant is capable of providing an appropriate living
environment for Anthony.
WHEREFORE, Plaintiff respectfully requests that this Honorable Court modify its Order
of March 22,2004, and award him primary legal and physical custody of the child, ANTHONY
JOSEPH SMURO.

6:00 p.m. on the preceding evening until 6:00 p.m., on Father's Day.
d. Defendant shall have custody of Anthony on Mother's Day from 6:00 p.m.
the evening before until 6:00 p.m., on Mother's Day.
e. The Easter holiday shall be divided each year so that Plaintiff has custody
of Anthony on Easter Sunday from 1 :00 p.m. until 6:00 p.m., when Easter
falls on Defendant's weekend. When Easter falls on Plaintiff's weekend,
Defendant shall have custody of Anthony from Easter Eve at 6:00 p.m.,
until Easter Sunday at 1 :00 p.m., at which time Plaintiff shall have custody
of Anthony until 6:00 p.m. on Easter Sunday. In this event Plaintiff shall
also have the first portion of his regular weekend.
f. Memorial Day, Independence Day and Labor Day shall be alternated. If
the holiday falls on the Monday immediately after or the Friday
immediately before the weekend of the parent who also has custody, that
parent shall have the entire three-day weekend. If the parent's holiday
falls on the other parent's weekend, the holiday custody shall begin at
10:00 a.m., on the holiday itself and end at 9:00 p.m. The rotation shall
begin with Plaintiffhaving Memorial Day in 2004.
g. Plaintiff shall have custody of Anthony each year on Thanksgiving from
10:00 a.m., until 3:00 p.m.
h. The parties shall share the Christmas holiday pursuant to a two-segment
arrangement. Segment A shall begin at 12:00 noon on December 24, and
end at 12:00 noon on December 25. Segment B shall begin at 12:00 noon
on December 25, and end at 12:00 noon on December 26. Plaintiffshall
have segment A in the even numbered years and segment B in the odd
numbered years. Defendant shall have segment A in the odd numbered
years and segment B in the even numbered years.
1. In addition to the foregoing, Plaintiff shall have partial physical custody of
Anthony as the parties shall from time to time agree upon and arrange and
the parties shall be free to modify the aforementioned custody
arrangement in accordance with their mutual agreement.
3. The parties shall permit reasonable telephone access between Anthony and the
other parent at all times. They shall use sound discretion as to the time, frequency and duration
of the phone calls.
4. The parties shall share transportation for each exchange of custody as they shall
from time to time mutually agree upon and arrange. Plaintiff shall not operate a motor vehicle in
which Anthony is a passenger until such time as his operator privileges have been restored.
5. Plaintiff shall refrain from taking Anthony to his father's home in Johnstown,
Pennsylvania until such time as his operator privileges have been restored unless Plaintiff and
Anthony are accompanied by Plaintiff's sister.
6. Plaintiff shall obtain door locks at his home in order to safeguard Anthony more
securely while in his custody.
7. Neither party shall do or say anything to estrange Anthony from the other parent
and both shall encourage his relationship with the other parent and their family members. It shall
be the express duty of each party to uphold the other parent as one whom Anthony shall respect
and love.
8. The parties shall share with each other all information pertinent to all major
aspects of Anthony's life, including but not limited to his education, health, religion, social
adjustment and activities. Both parties shall participate in and make all major decisions
concerning Anthony and shall cooperate to the fullest possible extent in their son's upbringing.

9. This Order shall remain in full force and effect until further order ofthis Court
and shall replace and supersede any existing custody arrangements between the parties or any
previous order entered by this or any other Court.

AND NOW, this d I ~ day of September, 2006, upon consideration of the
attached Custody Conciliation Summary Report, it is hereby ordered and directed as
follows:
1. LeQal Custody. The parties, Anthony L. Smuro and Shelley Heinzig, shall
have shared legal custody of the minor child, Anthony Joseph Smuro, born September 26,
2000. Each parent shall have an equal right, to be exercised jointly with the other parent, to
make all major non-emergency decisions affecting the children's general well-being
including, but not limited to, all decisions regarding their health, education and religion.
Pursuant to the terms of 23 Pa.C.S. 95309, each parent shall be entitled to all records and
information pertaining to the children including, but not limited to, medical, dental, religious
or school records, the residence address of the children and of the other parent. To the
extent one parent has possession of any such records or information, that parent shall be
required to share the same, or copies thereof, with the other parent within such reasonable
time as to make the records and information of reasonable use to the other parent. Both
parents shall be entitled to full participation in all educational and medical/treatment
planning meetings and evaluations with regard to the minor children. Each parent shall be
entitled to full and complete information from any physician, dentist, teacher or authority and
copies of any reports given to them as parents including, but not limited to: medical records,
birth certificates, school or educational records, attendance records or report cards.
Additionally, each parent shall be entitled to receive copies of any notices which come from
school with regard to school pictures, IEP meetings, extracurricular activities, children's
parties, musical presentations, back-to-school night, and the like.
2. Phvsical Custody. Father shall have primary physical custody; Mother shall
have partial custody, as follows:
A. Mother shall have custody of Anthony on alternating weekends from Friday at
6:00 p.m. until Sunday at 6:00 p.m.

B. Mother shall have custody of Anthony for two (2) weeks during each summer,
non-consecutively, and inclusive of her regularly-scheduled weekend, upon
thirty (30) written notice to Father.
3. Holidavs. The following holiday schedule shall supercede the regular
schedule:
A. Mother shall have custody of Anthony on Mother's Day from 6:00 p.m.
preceding on the Saturday before Mother's Day until 6:00 p.m. on Mother's
Day.
B. Father shall have physical custody of Anthony on Father's Day from 6:00 p.m.
the day before Father's until 6:00 p.m. on Father's Day.
C. Easter: This holiday shall be divided each year so that Father has custody of
Anthony Easter Sunday from 1 :00 p.m. until 6:00 p.m., when Easter falls on
Mother's weekend. When Easter falls on Father's weekend, Mother shall have
custody of Anthony from Easter Eve at 6:00 p.m. until Easter Sunday at 1 :00
p.m., at which time Father shall have custody of Anthony until 6:00 p.m. on
Easter Sunday. In this event, Father shall also have the first portion of his
regular weekend.
D. Memorial Dav. Independence Dav and Labor Dav. These holidays shall be
alternated. If the holiday falls on the Monday immediately after or the Friday
immediately before the weekend of the parent who also has custody, that
parent shall have the entire three day weekend. If the parent's holiday falls on
the other parent's weekend, the holiday custodial period shall begin at 10:00
a.m. on the holiday itself and end at 9:00 p.m.
E. Christmas and Thanksoivino. The parties shall share custody of Anthony each
year on Christmas and Thanksgiving, with the specific times to be worked out
by their mutual agreement.
4. In addition to the basic and holiday schedule, Mother shall have additional
periods of partial custody as the parties shall, from time to time, agree and arrange. The
parties shall be free to modify the aforementioned custody arrangement in accordance with
the mutual agreement.
5. Telephone Contact. The parties shall permit reasonable telephone access
between Anthony and the non-custodial parent. They shall use sound discretion as to the
time, frequency and duration of the phone calls.

6. Transportation. The parties shall share transportation for each exchange of
custody as they may, from time to time, mutually agree.
7. Neither party shall do anything to estrange Anthony from the other parent, and
both shall encourage his relationship with the other parent and their family members. It

shall respect and love.
8. Drug and Alcohol. For a period of twelve hours before and continuing
throughout any period of supervised visitation or partial custody with the minor child, the
parties shall consume no alcoholic beverages nor possess or use non-prescribed controlled
substances whatsoever. The parties shall likewise ensure, to the extent possible, that the
other household members and/or house guests comply with this prohibition.
9. This Order shall remain in full force and effect until further order of this Court,
and shall replace and supercede any existing custody arrangements or previous Orders
entered by this or any other Court.
