WILLIAMS, INC., Contractor : IN THE COURT OF COMMON PLEAS : CUMBERLAND COUNTY, PENNSYLVANIA WItEREAS, Vidal O. Bravo, an adult individual, Owner, is about to contemporaneously herewith execute a contract with A.P. WILLIAMS, INC., Contractor, with a principal place of business located at 3035 North Progress Avenue, Harrisburg, Dauphin County, Pennsylvania 17110, for the erection/renovations upon a certain lot of land situate and known as 4956 Carlisle Pike, Hampden Township, Cumberland County, Pennsylvania and which is more particularly described un Exhibit "A," attached hereto and made a part hereof. NOW, this ~ day of ~T0 ~ ~/~ , 2003, at the time of and immediately before the execution of the principal contract, and before any authority has been given by the said Owner to the said Contractor, to commence work on the said building, or purchase materials for the same in consideration of the making of the said contract with the Contractor and the further consideration of One ($1.00) Dollar and other valuable considerations, receipt of which is hereby acknowledged, to the Contractor paid by the Owner, it is agreed that no lien shall be filed against the building by the Contractor, or any sub-Contractor nor by any of the material men or workmen or any other person for any labor, or materials purchased, or extra labor or materials purchased for the erection/renovations to said building, the right to file such liens being expressly waived. WITNESS our hands and seals the day and year aforesaid. WITNESS/ATTEST: OWNER: V~dal 0 Bra CONTRACTOR: Authorized Officer ALL THAT CERTAIN lot of ground situate in Hampden Township, Cumberland County, Pennsylvania, more particularly bounded and described as follows, to wit: BEGINNING at a point on the southern right-of-way line of the Carlisle Pike, Route #11, LR #34, said point being located and referenced a distance of 459.9 feet, more or less, in an easterly direction from the center line intersection of Sporting Hill Road and Carlisle Pike; thence South 03 degrees 14 minutes 44 seconds East, a distance of 25 feet to the point of beginning; thence along the said southern fight-of-way line of the Carlisle Pike, North 86 degrees 33 minutes 17 seconds East, a distance of 130 feet to an iron pin; thence along other lands now or formerly of Arthur B. Copenhaver, South 03 degrees 14 minutes 44 seconds East, a distance of 415.88 feet to a concrete monument; thence along other lands now or formerly of Arthur B. Copenhaver and a 30 feet wide sanitary sewer fight-of-way South 86 degrees 33 minutes 17 seconds West, a distance of 130 feet to an iron pin; thence along Lot No. 1 North 03 degrees 14 minutes 44 seconds West a distance of 415.88 feet to an iron pin, the place of BEGINNING. CONTAINING 1.241 acres, more or less, to the dedicated right-of-way line. BEING Lot No. 2 in the subdivision plan of Arthur and Ruth Copenhaver prepared by Wtfittock- Hartman, dated April 21, 1982 and recorded in Cumberland County Plan Book 42, Page 36. BEING KNOWN AS 4956 Carlisle Pike, Mechanicsburg, Pennsylvania 17050-3028. BEING THE SAME PREMISES WHICH River City Foods Co., formerly Universal Restaurants, Inc., a Pennsylvania Corporation, by its Deed dated September 18, 1998 and recorded September 29, 1998 in the Office of the Recorder of Deeds of Cumberland County, Pennsylvania in Deed Book 186 at Page 193, transferred and conveyed unto Basil N. Papoutsis and Elena B. Papoutsis, husband and wife. UNDER AND SUBJECT to zoning regulations, ordinances, easements, building and other restrictions, privileges and rights of public service companies, rights-of-way, reservations and protective covenants of record and those visible on the subject premises, and subject to all agreements or like matters of record or visible on the premises, and subject to all rights and ownership in the public in roads, streets and highways, whether or not opened.
