Complaint
1. The plaintiff is Citibank (South Dakota) N.A., with plaee of business located at
701 East 60th Street North, Sioux Falls, South Dakota.
2. The defendant is CYNTHIA J STEINOUR, who resides at ]20 S 30 STREET
CAMP HILL, CUMBERLAND County, Pennsylvania.
3. At the defendant's request, plaintiff issued the defendant a credit card with account
number 4428135024329120 for the defendant's use in making credit purchases and securing cash
advances subject to the terms and conditions governing the use ofthe credit card. Attached hereto,
made a part hereof and marked Exhibit A is a true and correct copy of the terms and conditions.
4. The defendant accepted the credit eard and the terms and conditions governing its
use for the purchase of goods, merchandise and services and/or cash advances from vendors
who accepted plaintiffs credit card. In using the credit card, the defendant agreed to comply
with the terms and conditions governing its use which included the obligation to pay plaintiff
for all the charges made in full upon receipt of the statement or in installments subject to monthly
finance charges.
5. The defendant utilized the credit card by making/obtaining purehases of goods,
merchandise and services and/or cash advanees from vendors who accepted the credit card.
Monthly statements were sent to the defendant which detailed the charges made to the account
including finance charges, late and/or over limit charges. The balanee due for the charges made
by the defendant including any finance charges, late or over limit charges is $6,7]9.04.
6. Defendant did not pay the balance due in full upon receipt of the billing statements
and failed to make the required minimum monthly payment set forth in the the billing statement. As
such, defendant is in default of the terms and conditions governing the use of the credit card.
7. Although demand has been made by plaintiff upon defendant to pay the sum of$6,7] 9.04,
the defendant failed and refused to pay a.JI or any part thereof.
8. Plaintiff alleges it is entitled to reeovery of attorney's fees from defendant pursuant
to the terms and conditions governing the account. Plaintiff's counsel is not a salaried employee
ofCitibank (South Dakota) N.A. Plaintiff seeks recovery of attorney fees in the sum of$I,276.62.
WHEREFORE, plaintiff demands judgment against the defendant in the sum of $6,7] 9.04,
attorneys fees in the sum of$],276.62 and the costs of this action.

Plaintiffs Memorandum of Law in Support of Partial Judgment
on the Pleadings Against Defendant
I. Facts and Procedural History
Plaintiff filed a complaint against defendant to recover the balance past due on a credit
card aceount. Defendant filed an answer with new matter. In the answer defendant admitted
plaintiff issued her a credit card with terms and conditions as per Exhibit A. Defendant
acknowledged using the credit card but claimed she paid "roughly $1,200 on account of the
aJleged debt." Plaintiff contends defendant effectively admitted aJI but $1,200 of the baJance.
The pleadings in this action are closed. The matter is before the Court on plaintiff s
motion for judgment on the pleadings under Pa. R.C.P. 1034(a). Plaintiff believes that entry of
partial judgment on the pleadings is proper under Pa. RC.P. 1034(b).
II. Question Presented
Whether plaintiff is entitled to partiaJjudgment on the pleadings under Pa.RC.P.
1034 (a) for the sum of$5,5I8.62 where defendant's response to the complaint set forth no facts
denying liability to aJI but $1,200 of the amount set forth in the eomplaint?
III. Argument
A. Standard for Decision of Motion
Pa. RC.P. 1034 provides:
(a) After the relevant pleadings are closed, but within such time as not
to unreasonably delay the triaJ, any party may move for judgment on
the pleadings. Note: Oruy the pleadings between the parties to the
motion for judgment on the pleadings must be closed prior to filing
the motion.
(b) The court shall enter such judgment or order as shall be proper on
the pleadings.
"The motion for judgment on the pleadings should be granted only in clear cases, which
are free from doubt, and where there are no issues of fact. The deciding court should grant
judgment only where the case is so clear that a trial would clearly be a fruitless exercise." 6
Standard Pennsylvania Practice 2d Section 31 :45 and the cases cited therein. Even under this
stringent standard, plaintiff is entitled to judgment since the defendant's answer admitted
plaintiffs case. Proceeding to trial despite those admissions would indeed be a fruitless exercise.
Given the judicial admissions to be discussed hereinafter, Rule 1034 is proper authority for the
Court to grant the relief sought in this motion for a sum less than that claimed by plaintiff, that is,
for the amount admitted by defendant.
B. General Denials to Factual Complaint Averments Are Admissions Under the
Pennsylvania Fact Pleading System.
Defendant's answer in paragraph 3 admitted that plaintiffissued her a credit card
with terms and conditions as per Exhibit A. Paragraphs 4 to 6 of the complaint averred that
defendant accepted the credit card and its accompanying terms and conditions, that defendant
agreed to pay plaintiff for all charges including finance charges, that defendant utilized the card
for purchases, that plaintiff sent monthly statements, the balance due, and that defendant did not
pay the balance in full or make minimum monthly payments. Defendant admitted she used the
card and "denied that she owes the alleged balance and accrued interest. . ." Defendant did not
respond to the other averments of these paragraphs. Pa. R.C. P. 1029(b) provides:
Averments in a pleading to which a responsive pleading is required
are admitted when not denied specifically or by necessary
implication. A general denial or a demand for proof, except as
provided by subdivisions (c) and (e) of this rule, shall have the effect
of an admission.
Defendant thus admitted the averments to which she did not respond. Defendant's use of
the language "denies that" to these paragraphs followed by the language of the averment of the
complaint without any facts plead in opposition to the complaint is a general denial. This is a
denial in haec verba. The rule cited in the treatise has been the law in Pennsylvania for many
years and has periodically served as the basis for grant of a motion for judgment on the
pleadings. See: Sheppard v. Stubbs, 19 D & C 215 (1910); Martin v. Barfield, 66 Pa. D. & C.
321 (1948); Hoffman v. Bozitsko, 198 Pa. Super. 553, 182 A.2d 113, (Pa.Super 1962); Noll v.
Hamil, 72 Pa. D. & C.2d 177 (1975).
Normally, this response should be construed as an admission to the balance set forth in
the complaint as there are no facts stating why the balanee is incorrect. However, defendant's
pleading to paragraphs 7 and 8 stated that she paid "roughly $1,200" Taken as a whole therefore,
defendant's denial could be read as averring that the sum claimed by plaintiff was not correct and
that defendant owes only $5,518.62. Though defendant did not respond to paragraph 8, which
pertains to attorney's fees, plaintiff is not seeking attorney's fees in this motion.
To the extent defendant's request for verification pursuant to the Fair Debt Collection
Practices Act (hereinafter "FDCP A") is considered a defense or denial of paragraphs 7 and 8, it
fails for two reasons. First, there is nothing in the FDCP A, 15 U.S.e. 9 1692 et seq. that gives
rise to a defense to a creditor's claim. Second, a request for production of documents is outside
of the scope of pleadings allowed under Pa.R.C.P. IOI7(a).
Based on the discussion above, the averments in the answer have the effect of admissions.
The admissions provide the proof of plaintiff's case with regard to the existence of the contract
and the breach thereof. While the admissions do not provide a basis for recovery for the full
amount claimed by plaintiff, the effective admission that all but $1,200 is owed is binding on
defendant. As stated in Packel & Poulin, Pennsylvania Evidence, 2d Ed., Section 127, p. 30:
Evidentiary admissions are to be distinguished from judieiaJ
admissions. Judicial admissions are not evidence at aJ\. Rather, they
areformal concessions in thepleadings in the case or stipulations by
a party or its counsel that have the effect of withdrawing afact from
issue and dispensing wholly with the needfor proof of thefact. Thus
the judicial admission, unless allowed by the court to be withdrawn
is conclusive in the case, whereas the evidentiary admission is not
conclusive but is aJways subject to contradiction or explanation.
(Emphasis added.)
In Jewelcor Jewelers & Distributors v. Corr, 373 Pa.Super 536,542 A.2d 72 (1988), the
Superior Court addressed the effect of a judicial admission, as follows:
A j udiciaJ admission is an express waiver made in court or
preparatory to trial by a party or his attorney, conceding for the
purposes of the triaJ, the truth of the admission. It has the effect of a
confessory pleading, in that the fact is thereafter to be taken for
granted, so that the opposing party need offer no evidence to prove it
and the party by whom the statement was made is not aJlowed to
disprove it. See 9 Wigmore, Evidence Section 2588 (Chadbourne
Rev. 1981). It is axiomatic that a judicial admission cannot be
contradicted by the party that made it. See Tops Apparel Mfg. Co. v.
Rothman, 430 Pa. 583, 244 A. 2d 436 (1968).

Defendant's new matter is not a bar to judgment on the pleadings. Paragraphs 9 and 10
plead no facts, and as discussed above, alleged FDCP A violations are not a defense to a
creditor's claim. While paragraph II plead facts, the pleading is improper and requires no
response. Pa.R.C.P. l006(e) states in relevant part: "Improper venue shall be raised by
preliminary objection and if not so raised shall be waived." As such, this averment shall be
deemed denied under Pa.R.C.P. 1029(d).
The defendant having admitted the allegations of the complaint except the total amount
owed, there are no factual issues before the Court which would require a trial for the portion of
the amount which defendant effectively admitted.
IV. Conclusion
Plaintiff submits partial judgment on the pleadings should be entered under Pa.R.C.P.
1034(a) on its behalf and against defendant for the sum defendant effectively admitted to owing
in the answer, $5,518.62 and the costs of the action with leave to plaintiff to proceed to trial for
the sum not admitted by defendant in the pleadings and attorney's fees.
