Plaintiff, Partners Trust Bank, Successor by Merger to BSB Bank & Trust, is a New York State chartered bank having a place of business at 58-68 Exchange Street, Binghamton, New York, 13902. 2. Defendant, Robert Paquette, is an adult individual with a last known address of 194 Birch Lane, Carlisle, Cumberland County, Pennsylvania 17013. 3. On or about October 13, 2000, Michael R. Paquette and Lisa M. Paquette ("Paquette") entered into a Variable/Simple Interest Note, Disclosure and Security Agreement (the "Note") with Forward Financial Company of 360 Church Street, Northboro, Massachusetts 01532 for the purchase money financing of a used 1982 Schult 70' x 14' Mobile Home, serial 2093011-1 number E178991 (the "Mobile Home"). A true and correct copy of the Note is attached hereto as Exhibit "A" and incorporated herein by reference as if fully set forth. 4. By Assignment dated October 13, 2000, Forward Financial Company assigned all of its rights, benefits, title and interest in the Note and Security Agreement to Plaintiff. A true and correct copy of the Assignment is attached hereto as Exhibit "B" and incorporated herein by reference as if fully set forth. 5. Paquette defaulted under the Note by failing to make monthly payments when due beginning June 5, 2007 and on the fifth (5th) day of each month thereafter. 6. Pursuant to the Note, in the event of default, Plaintiff may, and by letter dated August 17, 2007 did, make unpaid principal, earned interest and other agreed charges owed by Paquette under the Note immediately due. A true and correct copy of Plaintiffs August 17, 2007 letter is attached hereto as Exhibit "C" and incorporated herein by reference as if fully set forth. 7. Pursuant to the Note, Plaintiff gave Paquette notice of Plaintiff's intention to repossess the Mobile Home and an opportunity to cure Paquettes' default. See Exhibit " C". 8. As a result of Paquettes' default under the Note, Plaintiff is entitled to immediate possession of the Mobile Home. 9. The present fair market wholesale value of the Mobile Home is approximately $6,674.68. 10. Defendant has possession of the Mobile Home at 194 Birch Lane, Carlisle, Pennsylvania 17013.
