MOTION TO MAKE RULE ABSOLUTE
AND NOW, R. J. Marzella & Associates, P.c., file this instant Motion to Make Rule
Absolute and avers the following:
1. On or about August 29, 2006, the family of Betty J. Sturn, deceased,
contacted an attorney to investigate a potential medical malpractice claim on behalf of
their late mother.
2. The family was referred to R.j. Marzella & Associates, who agreed to
investigate the care and treatment that Betty j. Sturn received from various medical
providers during the last months of her life.
3. In order for R.J. Marzella & Associates to effectively proceed with the
investigation, it became necessary to file a Petition to open The Estate of Betty J. Sturn
with the Cumberland County Register of Wills. Specifically, R.J. Marzella and Associates

needed to obtain a short certificate, which was required to request medical records of
Mrs. Sturn, deceased, from the various providers on the family's behalf.
4. No other action was instituted by R.J. Marzella & Associates on behalf of
the Estate of Betty J. Sturn in any court of law.
5. Undersigned counsel has instructed the Executrixes to obtain new counsel
to undertake representation of the Estate in this matter.
6. Accordingly, the personal representatives of the Estate of Betty j. Sturn are
now seeking new counsel to proceed in further investigating any potential claims and to
continue with the probating ofthe Estate.
7. R.J. Marzella & Associates filed a Petition to Withdraw as Counsel ofthe
Estate of Betty J. Sturn on or about October 17, 2007.
8. On or about October 24, 2007, The Honorable j. Wesley Oler, Jr. issued an
Order for a Rule Returnable within 20 days of service.
9. On or about November 3,2007, R.j. Marzella & Associates served the
Court's Order on Dianna Clouse, the Executrix ofthe Estate of Betty j. Sturn via certified
mail. (See Correspondence and proof of service mailed via U.S. Certified Mail attached
hereto as Exhibit "A").
10. As of November 23,2007, no response to the Petition and/or Rule to Show
Cause has been filed to undersigned Counsel's knowledge.
11. Therefore, R.j. Marzella & Associates request this Honorable Court grant
the Petition to Withdraw and enter the attached Order.
WHEREFORE, R.J. Marzella & Associates, requests this Honorable Court enter an
Order making the Rule Absolute and granting Counsel's request to withdraw as counsel
this matter.
