GUTTSHALL Defendants IN THE COURT OF COMMON PLEAS OF CUMBERLAND NO: STIPULATION AGAINST MECHANICS LIENS RECORD AND RETURN TO: Appalachian Settlement Agency, LLC 101 West Cherry Street Palmyra, PA 17078 STIPULATION AGAINST LIENS THIS AGREEMENT made the //'//J day ofn ..~/.///~U~F 2003, between WIRL BUILDERS, a general partnership, and GM Development, a general partnership hereinafter referred to as Contractor, A N D BRET J. GUTTSHALL AND SHERI L. GUTTSHALL, hereinafter referred to as Owner. WHEREAS Contractor has undertaken and agreed to erect and construct a building on that certain lot of ground situate in South Middleton Township, Cumberland County, Pennsylvania, more particularly described as Lot No. 48 on Plan of South View Estates. NOW THEREFORE THIS AGREEMENT WITNESSETH: That the said Contractor, for and in consideration of the sum of ONE ($1.00) DOLLAR in hand paid to it by Owner, the receipt whereof is hereby acknowledged, and the further consideration mentioned in the agreement aforesaid, for itself and its subcontractors, and ail parties acting through or under it or them, covenant and agree that no mechanic's liens of claims shail be filed or maintained by it or any of them against the said buildings and the lot of ground thereto for or on account of any work done or materiais furnished by it or any of them under said contract or otherwise, for, towards, in or about the erected and construction of the said buildings on the lot above described, and the said Contractor, for itself, its subcontractors and others under it hereby expressly waives and relinquishes the right to have, file, and maintain any mechanic's liens or claims against the said buildings or any of the improvements, and agrees that this instrument, waiving the right of lien, shall by an independent covenant. 1N WITNESS WHEREOF, the parties hereto intending to be legaily bound have hereunto set their hands and seals the day and year first above written.
