CIVIL ACTION IN DIVORCE AND CUSTODY ,.- Pj-.!>g'(J : NO. ----- CIVIL TERM DANIEL DASHIELL, Defendant DIVORCE COMPLAINT WITH CUSTODY COUNT The plaintiff, Regina Dashiell, by her attorneys, the Family Law Clinic, sets forth the following causes of action for divorce and custody: COUNT!. DIVORCE UNDER 23 Pa.C.s. SECTION 3301(c). 3301(d) AND 3301(a)(6) OF THE DIVORCE CODE I. Plaintiff is Regina Dashiell, who currently resides at 38 Bellaire Avenue, Carlisle, Cumberland County, Pennsylvania, 17013, since December I, 2002. 2. Defendant is Daniel Dashiell, who currently resides at Clem Mar House, 540-542 Main Street, Edwardsville, Luzerne County, Pennsylvania 18704, since September 2003. 3. Plaintiff and defendant have been bona fide residents in the Commonwealth for at least six months immediately previous to the filing of this Complaint. 4. Plaintiff and defendant were married on September 4, 1999, in Carlisle, Cumberland County, Pennsylvania. 5. Plaintiff and defendant have lived separate and apart since December 1,2002. 6. There have been no prior actions of divorce or for annulment between the parties. 7. The marriage is irretrievably broken. 8. Plaintiff avers that defendant has offered such indignities to the plaintiff, an injured and innocent spouse, as to render the condition of the plaintiff intolerable, and life burdensome. 9. Plaintiff has been advised that counseling is available and that plaintiff may have the right to request that the court require the parties to participate in counseling. WHEREFORE, plaintiff requests the court to enter a decree in divorce dissolving the marriage. COUNT II. CUSTODY 10. Plaintiff repeats and realleges paragraphs one through nine. II. Plaintiff seeks sole legal and primary physical custody, subject to supervised visitation rights ofthe father on terms mutually agreeable to the parties, ofthe following child: Name Zachary Dashiell Present Address 38 Bellaire Avenue Carlisle, Pennsylvania Al!e one year old (DOB: 10/01/02) The child was not born out of wedlock. The child is presently in the custody of Regina Dashiell, who resides at 38 Bellaire Avenue, Carlisle, Pennsylvania, 17013. Since the child's birth, the child has resided with the following persons and at the following addresses: Persons Addresses 38 Bellaire Avenue Carlisle, Pennsylvania Dates 12/01/02 - Present Regina Dashiell & her mother, Virginia Winters Regina Dashiell & Daniel Dashiell 257 Pine Grove Road Gardners, Pennsylvania 10/02 - 12/02 The mother of the child is Regina Dashiell, currently residing at 38 Bellaire Avenue, Carlisle, Pennsylvania. She is married. The father of the child is Daniel Dashiell, currently residing at Clem Mar House, 540-542 Main Street, Edwardsville, Pennsylvania. He is married. 12. The relationship ofthe plaintiff to the child is that of mother. The plaintiff currently resides with her son, Zachary Dashiell, and her mother, Virginia Winters. 13. The relationship ofthe defendant to the child is that off ather. The defendant currently resides in a drug and alcohol rehabilitation facility. 13. The plaintiff has not participated as a party or witness, or in another capacity, in other litigation concerning the custody of the child in this or another court. Plaintiff has no information of a custody proceeding concerning the child pending in a court of this Commonwealth or any other State. Plaintiff does not know of a person not a party to the proceedings who has physical custody of the child or claims to have custody or visitation rights with respect to the child. 14. The best interest and permanent welfare of the child will be served by granting the relief requested because: a) Plaintiff provides the child with a home with adequate moral, emotional and physical surroundings as required to meet the needs of the child; b) Plaintiff is willing and able to accept sole custody of the child; c) Plaintiff continues to exercise parental duties and enjoys the love and affection ofthe child; d) Defendant is not in a position to care for the child. 15. Each parent whose parental rights to the child have not been terminated and the person who has physical custody of the child have been named as parties to this action. WHEREFORE, plaintiff requests the Court to grant her sole legal and primary physical custody, subject to supervised visitation rights of the father on terms mutually agreeable to the parties, of the child.
