HomeMy WebLinkAbout01-4637IN THE COURT OF COMMON PLEAS OF CUMBERLAND COUNTY, PENNSYLVANIA LEXEEN, INC., Owner : FARINELLI CONSTRUCTION INC. : No. tDI --4//-37 Contractor : STIPULATION AGAINST LIENS WHEREAS, LEXEEN, INC. a Pennsylvania business corporation with offices in Halifax Borough, Dauphin County, is about to execute contemporaneously herewith, a contract with FARINELLI CONSTRUCTION INC., of Upper Allen Township, Cumberland County, Pennsylvania, for the erection of commercial building upon a lot of land situate described as follows: ALL THAT CERTAIN lot or parcel of land situate in Upper Allen Township, Cumberland County, Pennsylvania, bounded and described as follows, to wit: BEGINNING at a point on the western right of way line of Township Kaeey Court cul-de-sac at the dividing line between lots No. 5 and No. 6 as shown in the hereinafter mentioned plan; thence along the dividing line of Lots No. 5 and No. 6, South 64 degrees 10 minutes 55 seconds West, 203.78 feet to a point at the eastern line of lands now or formerly of Stanley F. Werzyn; thence along the eastern line of said lands of Stanley F. Werzyn and also lands of L. Nelson Werzyn, North 23 degrees 05 minutes 53 seconds West, a distance of 134.57 feet to a point on the eastern limited access right-of-way line of Ramp F, U.S. Route 15; thence along the limited access right-of-way line of Ramp F, U.S. Route 15, North 38 degrees 23 minutes 26 minutes East, a distance of 9.39 feet to a point; thence continuing along the same, North 36 degrees 03 minutes 10 seconds East, a distance of 275.00 feet to a point at the dividing line between Lots No. 6 and No. 7; thence along the dividing line between Lots No. 6 and No. 7, South 25 degrees 03 minutes 10 seconds East, a distance of 218.18 feet to a point on the western right-of-way line of Kacey Court cul-de-sac; thence along the western right-of-way line of Kacey Court cul-de-sac by a curve, curving to the left, having a radius of 50.00 feet and an arc length of 79.21 feet and a chord of South 19 degrees 33 minutes 53 seconds West 71.18 feet to a point, said point being the place of BEGINNING. CONTAINING 1.112 acres more or less. BEING the same premises which Chad Hazam and Karis Lewellen-Hazam, his wife, by deed dated May 5, 2000, and recorded in Cumberland County Record Book 220, Page 922, granted and conveyed unto Lexeen, Inc., Owner herein. NOW, /~ /6~ ,2001, at the time of and immediately before the execution of the principal contract, and before any authority has been given by the said Owner to the said FARINELLI CONSTRUCTION INC. to commence work on the said building, or purchase materials for the same in consideration of the making of the said contract with Owner, and the further consideration of One Dollar ($1.00), to FARINELLI CONSTRUCTION INC. paid by Owner, it is agreed that no lien shall be filed against the building by the contractor, or any subcontractor, nor by any of the material men or workmen or any other person for any labor, or materials purchased, or extra labor or materials purchased for the erection of said building, the right to file such liens being expressly waived.
