NO. 03-5920 CIVIL DONALD McKINERY, Defendant JURY TRIAL DEMANDED COMPLAINT I. Plaintiffs Stephanie Diamond and Christopher Reese, citizens of the Commonwealth of Pennsylvania, are husband and wife, adult individuals who reside in Mechanicsburg, Cumberland County, Pennsylvania. 2. Defendant Donald McKinery is an adult individual and citizen of the State of Oregon who resides at 56 Carthage A venue, Eugene, Lane County, Oregon, 97404. 3. The facts and occurrences hereinafter related took place on or about November 15, 2001, between the hours of 5:00 p.m. and 5:30 p.m. on State Route 581, just west of the South Bridge, Cumberland County, Peunsylvania. 4. At that time and place, Plaintiff Stephanie Diamond (Dr. Diamond) was operating her Lexus in the far left lane of State Route 581. 5. Traffic on State Route 581 came to a stop and Dr. Diamond stopped her vehicle. 6. At that time and place, Defendant Donald McKinery was also operating his vehicle, a Volvo, traveling behind Dr. Diamond on State Route 581. 7. Mr. McKinery failed to bring his vehicle to a stop before colliding into the rear of Dr. Diamond's stopped vehicle. 8. The foregoing accident and all of the injuries and damages set forth hereinafter sustained by Plaintiffs Stephanie Diamond and Christopher Reese are the direct and proximate result of the 2681l6.tIDLLIMTG II " ' I negligent, careless, wanton and reckless manner in which Defendant Donald McKinery operated his motor vehicle as follows: a) failure to have his vehicle under such control as to be able to stop within the assured clear distance ahead; b) failure to keep proper and adequate control over his vehicle; c) failure to keep a proper watch for stopped traffic; d) failure to keep alert and maintain a proper watch for the presence of motor vehicle stopping given the heavy traffic conditions at the time; e) driving his vehicle upon the highway in a manner endangering persons and property and in a reckless manner with careless disregard to the rights and safety of others and in violation of the Motor Vehicle Code of the Commonwealth of Pennsylvania. CLAIM I Stephanie Diamond v. Donald McKinerv 9. Paragraphs 1 through 8 of the Complaint are incorporated herein by reference. 10. As a result of the aforementioned rear-end collision, Dr. Diamond sustained painful and severe injuries to her right knee, including, but not limited to, a straining of the posterior capsule due to hyperextension and the development of chondromalacia of the patella of the right knee 11. By reason of the aforesaid injuries sustained by Dr. Diamond, she was forced to incur liability for medical treatment, medications, physical therapy, cortisone shot, and similar miscellaneous expenses in an effort to restore herself to health, and claim is made therefor. 12. Because of the nature of her injuries, Dr. Diamond has been advised and, therefore, avers that she may be forced to incur similar expenses in the future, and claim is made therefor. 13. As a result of the aforementioned injuries, Dr. Diamond has undergone and in the future may undergo physical and mental suffering, inconvenience in carrying out her daily activities, loss oflife's pleasures and enjoyment, and claim is made therefor. 268116,lIDLLIMTG 2 II 14. As a result of the aforesaid injuries, Dr. Diamond has been and in the future may be subject to humiliation and embarrassment, and claim is made therefor. 15. Dr. Diamond continues to be plagued by intermittent pain and limitation of her right knee and, therefore, avers that her injuries may be of a permanent nature, causing residual problems for the remainder of her lifetime, and claim is made therefor. CLAIM II Christopher Reese v. Donald McKinerv 16. Paragraphs I through 15 of the Complaint are incorporated herein by reference. 17. As a result of the aforementioned injuries sustained by his wife, Plaintiff Stephanie Diamond, Plaintiff Christopher Reese has been and may in the future be deprived of the care, companionship, consortium, and society of his wife, all of which will be to his great detriment, and claim is made therefor. WHEREFORE, Plaintiffs Stephanie Diamond and Christopher Reese demands judgment against Defendant Donald McKinery in an amoWlt in excess of Twenty-five Thousand Dollars ($25,000.00), exclusive of interest and costs and in excess of any jurisdictional amoWlt requiring compulsory arbitration. Admitted in part, denied in part. It is admitted only that the Plaintiffs, Stephanie Diamond and Christopher Reese, are adult individuals who reside in Mechanicsburg, Cumberland County, Pennsylvania. Mr. McKinery is without sufficient knowledge or information to form a belief as to the truth of the remaining averments of Paragraph No. 1 and the same are, therefore, denied. 2. Admitted. 3. Admitted. 4. Admitted. 5. Admitted. 6. Admitted. 7. Admitted. 8 . Denied. The averments of Paragraph No. 8 constitute conclusions of law and fact to which no response is required. To the extent a response may be required, it is specifically denied that the alleged injuries and damages, if any, were a direct and proximate result of the negligence of Mr. McKinery. It is specifically denied that Mr. McKinery was negligent, careless, wanton and reckless in any manner with respect to the Plaintiffs' alleged cause of action; and, to the contrary, it is averred that Mr. McKinery at all times acted in a reasonable manner. (a) Denied. To the contrary, Mr. McKinery at all times had his vehicle under control and did not violate any alleged assured clear distance ahead standard; (b) Denied. To the contrary, Mr. McKinery at all times had proper and adequate control over his vehicl~; (c) Denied. To the contrary, Mr. McKinery kept a proper watch for stopped traffic; (d) Denied. To the contrary, Mr. McKinery kept alert and maintained a proper watch for the presence of motor vehicles and the traffic conditions at the time; and 2 (e) Denied. To the contrary, Mr. McKinery at all times acted in a reasonable manner and did not violate the Motor Vehicle Code of the Commonwealth of Pennsylvania. Claim I Stephanie Diamond v. Donald McKinerv 9. Mr. McKinery incorporates herein by reference his answers to Paragraphs 1 through 8 above as though fully set forth herein at length. 10. Denied. Donald McKinerv 16. Mr. McKinery incorporates herein by reference his answers to Paragraphs 1 through 15 above as though fully set forth herein at length. 4 17 . Denied. After reasonable investigation, Mr. McKinery is without sufficient knowledge or informa~ion to form a belief as to the truth of the averments contained in Paragraph No. 17 and the same are, therefore, denied. WHEREFORE, the Defendant, Donald McKinery, respectfully requests that judgment be entered in his favor and that Plaintiffs' Complaint be dismissed with prejudice. NEW MATTER By way of additional answer and reply, Defendant interposes the following New Matters: 18. That the Plaintiffs' alleged injuries and damages were not caused by any acts, omissions, or breaches of duty by Mr. McKinery. 19. That the Plaintiffs' alleged cause of action may be barred in whole or in part by the Pennsylvania Comparative Negligence Act, 42 Pa. C.S.A. ~7102, et seq., or by the Doctrine of Comparative Negligence. 20. That any damages the Plaintiffs may be entitled to recover in this action are limited to those damages which are recoverable under the provisions of the Pennsylvania Motor Vehicle Financial Responsibility Law, 75 Pa. C.S.A. ~1701, et ~. 5 21. That if it should be found that there was any negligence on the part of Mr. McKinery, which negligence is expressly denied, any such negligence was not a proximate or legal cause of any damages to the Plaintiffs. 22. That the accident and any alleged injuries may have been caused in whole or in part by forces beyond the control of Mr. McKinery. 23. That the accident and any alleged injuries may have been caused by an intervening, superseding cause. 24. That the accident and any alleged injuries may have been caused by a sudden emergency. 25. That the injuries and damages alleged by Plaintiffs may have pre-existed the accident and were not caused as a result of the incident of November 15, 2001. 26. That the injuries and damages alleged by Plaintiffs may have pre-existed the accident and were not aggravated or exacerbated by the incident of November 15, 2001. 27. That the injuries and damages alleged by Plaintiffs may have been sustained subsequent to the accident of November 15, 2001, and are not related to the accident. 6 WHEREFORE, the Defendant, Donald McKinery, respectfully requests that judgment be entered in his favor and that Plaintiffs' Complaint be dismissed with pn,judice.
