KNOWN BY ALL THESE PRESENT, that contemporaneously with the execution
hereof, an Agreement has been entered into between Caldwell, Heckles & Egan, Inc., a
Pennsylvania corporation, with a principal place of business at 1270 Groffiown Road,
Lancaster, Penns¥1van'la 17602 ("Contractor"),
AND
Trinity United Methodist Church ("Owner") with a principal place of business at 405 Bridge
Street, New Cumberland, Pennsylvania 17070 relating to the New Construction and Renovations
of Trinity United Methodist Church upon the real estate located at 405 Bridge Street, New
Cumberland, PA 17070.
NOW, THEREFORE, intending to be legally bound hereby, at the time of and
immediately before the execution of the Agreement, and before any authority has been given by
Owner to Contractor to commence work on said project, for and in consideration of the making
of the Agreement with the Owner, Contractor does hereby agree that no lien shall be filed against
the building by the Contractor, or any sub-contractor, nor by any of the workers or any other
person for any labor or materials purchased, or extra labor or materials purchased for the erection
of said building, the right to file such liens being expressly waived.
This Stipulation is made and intended to be filed with the Prothonotary of the Court of
Common Pleas of the County or other proper place in which the above described land is located.
IN WITNESS WHEREOF, Contractor with intent to be legally bound, has hereunto
signed and sealed these presents this 4th day of November, 2003.
