AND this Agreement waiving the right of hen shall be an independent covenant and shall operate and be effective as
well with respect to yank done and materials furnished trader any supplemental conlraot for emra w~rk in the erection,
construction and completion of said building or binldin~s as to any work and labor dime and materials furnished under the
contract aforezaid.
AND, in order to give the Owner full power and authority to pmteot himself and the lot or lots of ground against eny
end all claims filed by the Contractor or anyene acting under or throu~ him or it in violatien of the foregoing covenant, the
said Cenlraotor for himserf, the~nselves, it.serf, hereby irrevocably authorizes and empowers any At~mey of eny Court of
Common Pleas of the Commonwealth of Pennsylvania. to appear for him, them~ it, or any of them, in any of the said Courts of
Common Pleas as Atlome~, for him; thean or it and/n h/s, their, its, name, mark satisfied of record at thc cost and expense of
the Conh~actor or of any Sub-Contractor or Mated~lmsn, or Mmtefial mea, any and all claims o~ claim, lien or lieas, filed by c~

bounded and described in accordance with a Plan prepared by Eric L. Diffenbaugh, R.P.L.S., dtate May 6, 2000
and recorded in the Office of the Recorder of Deeds of Cumberland County in Plan Book 82, Page
BEGINNING at a railroad spike in Kelso Road SR 4017, at comer of LOt No. 10 on plan of Ridgeview; thence
along Lot No. 10 South 44 degrees 50 minutes 47 seconds West 574.31 feat to a point; thence along Lot No. 12,
North 45 degrees 09 minutes 13 seconds West 200.00 feat to a point; thence still along Lot No. 12, North 44
degrees 50 minutes 47 seconds East 574,31 feet to a point in cartway of Kelso Road, SR 4017; thence along
Kelso Road SR 4017 South 45 degrees 09 minutes 13 seconds East 200.00 feet to a point, the Place of BEGINNI
CONTAINING 2.6389 acres and designated as Lot No. 11 on the Plan of Ridgeview.
BEING the same premises wich Kimjon, Inc. granted and conveyed to Franklin C. Ridley and Linda K. Ridley, his
wife, deed dated October 31, 2003, and recorded in the Office of the Recorder of Deeds in and for Cumberland
