THIS AGREEMENT made the of November, 2003, by and
between William H. Goodling Construction,
Michael R. Schmehl and Sara B. Schmehl, hereinafter referred to as
Owner, whereby the former undertook and agreed to erect and
construct a single family dwelling on that certain lot of ground
situate in
Lot 138, 5810 Fawn Meadow Lane, Enola, PA 17025
NOW THEREFORE, THIS AGREEMENT WITNESSETH: That the said
Contractor, for and in consideration of the sum of ($1.00) Dollar
to william H. Goodling Construction in hand paid by Owner, the
receipt whereof is hereby acknowledged, and the further
consideration mentioned in the agreement aforesaid, for
themselves and their subcontractors, and all parties acting
through or under them, covenant and agree that no mechanic's
liens or claims shall be filed or maintained by them or any of
them against the said buildings and the lot of ground appurtenant
thereto for or on account of any work done or materials furnished
by them or any of them under said contract or otherwise, for,
towards, in, or about the erection and construction of the said
buildings on the lot above described, and the said Contractor,
for themselves, their subcontractors and others under them hereby
expressly waive and relinquish the right to have, file, and
maintain any mechanic's liens or claims against the said
buildings or any of them, and agree that this instrument, waiving
the right of lien, shall be an independent covenant.

ALL that certain piece, parcel or lot of land situate in Hampden
Township, Cu~berland County, Pennsylvania, and bounded and
described as follows:
BEGINNING at a point on the Northern right-of-way line of Fawn
Meadow Lane (50.00 feet wide), said point being located at the
Southwestern corner of Lot No. 137; then along said right-of-way
line of Fawn Meadow Lane South 88 degrees 30 minutes 15 seconds
West, for a distance of 107.69 feet, to a point at the
Southeatern corner of Lot No. 139; then along the Eastern
boundary line of Lot No. 139 North 01 degrees 29 minutes 45
seconds West, for a distance of 133.81 feet, to a point in line
of other lands now or formerly of The McNaughton Company; then
along said other lands of McNaughton, North 88 degrees 29 minutes
37 seconds East, for a distance of 107.69 feet, to a point at the
Northwestern corner of Lot No. 137; then along the Western
boundary line of Lot No. 137 South 01 degree 29 minutes 45
seconds East, for a distance of 133.83 feet, to a point and the
place of BEGINNING.
This piece, parcel or lot of land consists of approximately 14,411
square feet of land, and is known and numbered as Lot No. 138 on
the Final Subdivision Plan for Westbury Phases VIIA and VIIB,
which is recorded in Cumberland County in Plan Book 86, Page 4.
UNDER AND SUBJECT TO:
(a) Any and all easements, licenses, exceptions, reservations,
covenants, agreements, conveyances and restrictions which affect
the premises and are visible by inspection of the premises.
(b) Any and all easements, licenses, exceptions, reservations,
covenants, agreements, conveyances and restrictions contained in
any and all prior agreements, leases, deeds, grants and
conveyances affecting the premises.
(c) Plan notes prohibiting the contruction of any structure other
than a fence, uncovered steps and entrance canopies -- not
greater than 3 feet in height and 6 feet in width) within any 50
foot buffer yard shown on the subdivision plan of record.
(d) The Declaration of Covenants and Restrictions which is
recorded in the office of The Recorder of Deeds for Cumberland
County in Miscellaneous Book 697, Page 1312, as may be applicable
to the premises.
BEING PART OF THE SAME PREMISES which The McNaughton Company, a
corporation organized and existing under the laws of the
Commonwealth of Pennsylvania, by deed to be recorded
simultaneously herewith in the Office of the Recorder of Deeds in
and for Cumberland County, granted and conveyed unto Michael
Schmehl and Sara Schmehl.
