STIPULATION AGAINST LIENS
KNOW ALL MEN BY THESE PRESENTS:
HOFFMAN'S CUSTOM CONTRACTING, INC., a Pennsylvania business corporation
having an address at 3 5 Chelsea Lane, Carlisle, Pennsylvania ("Conlractor") and Randall K.
Baker and Julie A. Baker ("Owner") have entered into a eousU'uction contract the
3 day of ~. ,2003 (the "Contract") relaUng to the construction and erection of a
residential dwelling upon the following described real estate, as pa_et of the consideration for
which agreement this Stipulation of Liens is given:
ALL THAT CERTAIN lot of land situate in Dickinson Township, Cumberland County,
Peansylvania, bounded and described in accordance with Subdivision Plan for Clarendon.
prepared by Stafler-Brehm Associates, Inc., dated June 10, 1998 consisting of 14 pages, a copy
of which was recorded in the hereinafter named Recorder's Office on Au_mist 19, 1998 in Plan
Book 77, Page 56, which Subdivision Plan. for Clarendon is incorporated herein by reference, as
tbllows: ,
BEGINNING at a point on the western line ors0 feet wide Ashton Street at the dividing
line between Lots Nos. 50 and $1; thence along said western line orS0 wide Ashton Street, by a
curve to the left having a radius of 225.00 feet an arc distance of 11g.52 feet to a point at the
dividing line between said Lots Nos. 49 and 50; thence along said dividing tine between said
Lots Nos. 49 and 50, South Sg degrees 09 minutes 22 seoonds West a distance of 445.g6 feet to a
point in line of land now or formerly of Donald D. DieM, et al.; thence along line of sniff land
now or formerly of Donald D. Diehl, et al., North 34 degrees 12 minutes 55 seconds East a
distance of 373.60 feet to a point at the dividing line between Lots Nos. 50 and 5 I; thence along
said dividing line between said Lots Nos. 50 and 51, South 55 degrees 47 minutes 05 seconds
East a distance of 320.93 feet to a point on the western line of 50 feet wide Ashton Street at the
Place of BEGINNING.
THE ABOVE described lot of land is all of Lot No. $0 as shown on said Subdivision for
Clarendon and contains an area of g-~,728 square feet, more or less, and has the mailing address
of 37 Ashton Street, Carlisle, PA 17013.
BEING the same premises which Linwood B. Phillips, Jr., by his de~d dated September
~ 8, 2003 and recorded September 19, 2003 in the Office of the Recorder of Deeds in and for
Cumberland County, in Deed Book 259, Page 1995, granted and conveyed unto Randall K.
Baker and Julie A. Baker.
NOW THEKEFORE, Contractor, inrending to be legally bound hereby, in consideration
of the sum of One Dollar ($1.00) to Conlxactor in haad paid, the receipt and sufficiency of which
are hereby acknowledged, as well as for and in cor~ideration of the enn'y by Owner into the

Contract, does hereby, for Contractor and any and all subcontractors, matcrialmen and parties
acting for, t.h_rough and reader Contractor, them or any of them, or anyone, covenant and agree
with Owner that no mechanics' liens or claims shall be filed or maintained by Contractor, them
or any of them or any on.:, against the above described real estate or the building or other
improvements erected or to be erected thereon, any of them, or the estate (including a ]easeh01d
estate), interest or title thereto of Owner, for or on account of any work done or materials
famished under the Contract or under any supplemental contract, verbal or written, or contract
for extra work relating to the construction, erection and completion of said building or other
improvemems, or any of them, or otherwise; and Contractor, for Contractor and any and
subcontractor*, materialmen and parties acting through or under Contractor, them or any of them,
hereby expressly waives and relinquishes the right to have, file or maintain any mechanics' liens
or claims against said real estate or buildings or other improvements or any of them
This agreement waiving the right of lien shall be an independent covenant and shall
operate and be effective as well with respect to work done and materials furnished under any
supplemental contract for extra work in the construction, erection and completion of the building
or other improvements as to any work and labor done and materials furnished under the Contract
aforesaid.
Contractor hereby represent, and warrants that prior to the date hereof no work has been
done and no materials have been furalshed with regard to the construction which is the subject of
the Contract or with regard to any supplemental eonlxact, verbal or written, or contract for extra
work in or abottt the construction, erection and completion of any building or other
improvements on the above-described propen'y.
This Stipulation Against Liens is made and intended to be filed with the Prothonotary of
County of Cumberland, Commonwealth of Pennsylvania or other proper place in which the
above-described lands are located, within ten days of the date hereof in accordance wig the
requirement~ of law in such case provided.
