Kindly withdraw Plaintiff Rite Aid Corporation's Writ of Summons in the above case.
Plaintiff's Writ of Summons against Defendant H.D. Smith Wholesale Drug Company
was issued by this Court on November 13, 2003. Before Plaintiff served the Writ of Summons
on Defendant or filed a Complaint in this Court, Plaintiff initiated an action against Defendant in
the Circuit Court of Cook County, Illinois, Chancery Division. Accordingly, Plaintiff seeks to
withdraw its Writ of Summons and to dismiss this action without prejudice.
