WITNESSETH THAT: The Contractor by instrument dated "N 0 v"c ~r"~..)~ 7~ 200~ entered into an A?ement with the Owner for the erection and construction of a &, ~¢6,-- cA.~f.oi\.~ AND WHEREAS, the Contractor has covenanted and agreed therein to enter Into an additional agreement with the Owner stipulating :that no lien or liens of any kind shall be filed against the above building or the appurtenances thereto. NOW, THIS AGREEMENT WITNESSETH, that the Contractor, for and in consideration of the awarding to him of the eaid contract as for the sum of ONE DOLLAR ($1.00) to him in hand paid by the Owner, the receipt of which is hereby acknowledged, promises and agrees that no Mechanic's Lien or liens shall be filed against the aforesaid building or the appurtenances thereto by any subcontractor, subcontractors, materialman, mechanics, laborers or anyone for materials furnished, work done or sen'ices rendered of any kind whatsoever, for or about, or on account of the aforesaid building or on the credit thereof. CONTRACTOR: ~., ~, ~, ,~ (~ ~ Jeane~e L, Pennington Notary Public ~0~ ~ ~ :.~u,,quehanna Township, C'ounty of Dauphin (SEAL) (SEAL) (SEAL) ALL THAT CERTAIN tract of land, situate principally in the Township of South Middleton, County of Cumberland and Commonwealth of Pennsylvania, being more particularly bounded and described as follows, to wit: BEGINNING at a steel pin set on the southernmost dedicated right-of-way line of Morrison Way, a fifty foot wide street, said pin marking the common point adjoiner of Lots numbered 6 and 7 on the hereinafter mentioned plan of subdivision with said right-of-way line of Morrison Way, North seventy-nine (79) degrees sixteen (16) minutes twenty (20) seconds East for a distance of two hundred and no hundredths (200.00) feet to a steel pin on said right-of-way line at Lot No. 8; thence departing from Morrison Way and extending along Lot No. 8 South ten (10) degrees forty-three (43) minutes forty (40) seconds East for a distance of five hundred and no hundredths (500.00) feet to a steel pin at lands now or formerly of Dauphin Deposit Bank; thence extending along said lands South seventy-nine (79) degrees sixteen (16) minutes twenty (20) seconds West for a distance of two hundred and no hundredths (200.00) feet to a steel pin at Lot No. 6; thence extending along Lot No. 6 North ten (10) degrees forty-three (43) minutes forty (40) seconds West for a distance of five hundred and no hundredths (500.00) feet to a steel pin set on the southernmost dedicated right-of-way line of Morrison Way, said pin marking the place of BEGINNING. CONTAINING 100,000 square feet or 2.295 acres, and being designated as Lot #7 on a final plan of Subdivision of Sunrise Meadows, Phase 1, prepared for Kimba, Inc. and Harmon-Graves Company by Rodney Lee Decker and Associates, Inc., dated February 23, 1993, and recorded in the Office of the Recorder of Deeds in and for Cumberland County, Pennsylvania in Plan Book 68, Page 37. UNDER AND SUBJECT, NEVERTHELESS, to the Protective Covenants, Restrictions, and Reservations applicable to Sunrise Meadows, Phase 1, as found of record in the Office of the Recorder of Deeds of Cumberland County, Pennsylvania, in Miscellaneous Book 581, Page 463.
