HomeMy WebLinkAbout03-5939WAIVER OF MECHANICS LIEN WHEREAS, TERRY L. CHAMBERLIN and KATHY G. CHAMBERLIN, his wife, of Shippensburg, Pennsylvania, entered into a contract with RINE AND RINE BUILDERS, a partnership, of 19 Independence Drive, Shippensburg, Pennsylvania, for the erection of a single-story, brick and aluminum-sided ranch dwelling house upon real estate to be conveyed by Contractor to Owner, lying and being situate in Southampton Township, Cumberland County, Pennsylvania, more fully described as Lot H-25, Rine Estates, and being part of the same which was conveyed to Contractor by deed recorded in Cumberland County, Pennsylvania, Record Book 183, Page 607. NOW, THEREFORE, it is hereby stipulated and agreed by and between the said parties as part of the said contract and for the consideration herein set forth that neither the undersigned contractor, nor any sub-contractor or materialmen, nor any other person furnishing labor or materials to said contractor under this contract shall file a lien, commonly called a mechanics' lien, for work done or materials furnished to said building or any part thereof. THIS STIPULATION IS MADE and intended to be filed with the Prothonotary of the Court of Common Pleas of the 9th Judicial District, Pennsylvania, prior to the commencement of any work upon the ground in accordance with the requirements of Act of Assembly of Pennsylvania, in such case provided.
