PAVUK and JEANINE PAVUK, his wife, are about to execute contemporaneously herewith, a contract, with C & C RESIDENTIAL, of P.O. Box 2434, Mechanicsburg, Pennsylvania 17055, for the construction of a home upon a lot of land being known as Phase III, of the Peninsula Subdivision, more particularly concerning the land described as follows: Two-story Home at 2 Clairburn Drive Mechanicsburg, PA 17050. SEE LEGAL DESCRIPTION ATTACHED HERETO NOW, this ~2 ~ day of /~/o ~tt,~/.~t~.- , 2003 at the time of and immediately before the execution of the principal contract, and before any authority has been given by the said OWNERS to the said CONTRACTORS to commence work on the said building, or purchase materials for the same in consideration of the making of the said contract with CONTRACTORS and the further consideration of one Dollar, to CONTRACTORS paid by OWNERS it is agreed that no lien shall be filed against the land by the contractor, or any sub- contractor, nor by any of the material men or workmen or any other person for any labor, or materials purchased, or extra labor or materials purchased for the erection of said building, the right to file such liens being expressly waived. J~ANINE PAVUK C & C RESIDENTIAL (SEAL) All that certain tract or parcel of land situate in Silver Spring Township, Cumberland County, Pennsylvania, as follows: Beginning at a point at the end of an arc connecting the Northern right-of-way line of Clairburn Drive with the Western right-of-way line-of Sample Bridge Road (T.596); thence along the right-of-way line of Sample Bridge Road (T-596) North 01 degrees 01 minutes 18 seconds West a distance of 110.20 feet to a point; thence along same North 88 degrees 51 minutes 14 seconds East, a distance of 27.68 feet to a point; thence along same North 00 degrees 52 minutes 13 seconds East, a distance of 54.72 feet to a point on the Southern line of Lot #5 of the Plan of Lots of The Peninsula, Phase Ill; thence along the Southern line of Lot #5 on the aforementioned Plan of Lots North 88 degrees 58 minutes 42 seconds East, a distance of 109.96 feet to a point on the Western line of Lot #2 on the aforementioned Plan of Lots; thence along the Western line of Lot #2 South 02 degrees '19 minutes 18 seconds East, a distance of '190.00 feet to a point on the Northern right-of-way line of Clairburn Drive; thence along the Northern right-of-way line of Clairburn Drive South 88 degrees 58 minutes 42 seconds West, a distance of 111.76 feet to a point; thence on an arc connecting the Northern right-of-way line of Clairburn Drive and the Eastern right-of-way line of Sample Bridge Road (T-596) on a curve, curving to the right, having a radius of 25.00 feet and an arc distance of 39.27 feet to a point, the place of BEGINNING. Being Lot #1 of the Plan of Lots of"The Peninsula, Phase 10" and containing 0.5480 acre. Under and Subject to existing restrictions, easements and privileges or rights of public service companies, of record or visible upon the ground, and easements and restrictions shown on the Subdivision Plan as recorded and the Declaration of Restrictions and Covenants as recorded in the Office of the Recorder of Deeds in and for Cumberland County in Misc. Book 504 at Page 418. Together with all and singular the tenements, hereditaments and appurtenances to the same belonging, or in anywise appertaining, and the reversion and reversions, remainder and remainders, rents, issues and profits thereof; and also all the estate., right, title, interest, property, claim and demand whatsoever, both in law and equity, of the Grantors, of, in, to or out of the said tract of land, and every part and parcel thereof. To Have and to Hold the said tracts of land, with all and singular the premises herein described together with the appurtenances, unto the Grantees, its successors and assigns, to and for the only proper use and behoof of Grantees, its successors and assigns forever. And the Grantor, for itself, its successors and assigns hereby covenants and agrees to warrant specially and forever defend all and each of the hereditaments and premises herein above-described and granted, or mentioned and intended so to be, with the appurtenances, against all and every other person or persons, whomsoever, lawfully claiming or to claim the same or any part thereof, by, from or under it, him, her, them or any of them.
