TO PLAINTIFF'S COMPLAINT
TO THE HONORABLE, THE JUDGES OF SAID COURT:
AND NOW, come the Defendants, Helene L. Yohn and Richard L. Yohn, Jr., by and
through their attorney, Gary L. Kelley, and respectfully submit the following Preliminary
Objections to Plaintiffs Complaint:
1. Preliminary Objection in the nature of improper service of the complaint.
Pa.R.C.P. 400(a) requires that the serice of all original process must be served by the sheriff.
Plaintiff attempted service in this matter by First Class U.S. Mail.
2. Preliminary Objection in the nature of a more specific pleading. Averment 3 of
Plaintiffs Complaint is without specificity such that Defendants are unable to respond.
3. Preliminary Objection in the nature of improper venue. Plaintiff has failed to plead
where the alleged loans occurred and, thus failed to establish venue for this matter.
4. Preliminary Objection in the nature of a demurrer.
WHEREFORE, the Defendants respectfully request that this Honorable Court grant their
Preliminary Objections and dismiss Plaintiff Complaint with prejudice.

COMPLAINT
1. Plaintiff is Carl W. Hintz, an adult individual who
resides at 5003 Muirfield Place, Mechanicsburg, PA 17050.
2. Defendants are Helene M. Yohn and Richard L. Yohn, Jr.,
husband and wife, who reside at 451 Linton Hill Road, Duncannon,
PA 17020-9714. This pleading is being served on the Defendants
by mail at the address of Defendants as appears in a prior
pleading in this case; to wit, the Distract Justice proceedings
and particularly the appeal by Defendants 'therefrom.
3. On the following dates, and at the request of Defendants,
Plaintiff loaned to Defendants, the latter agreeing to repay by
May 1, 2003, the following sums of money, all upon oral
agreement(s) made between the parties, with repayments as
indicated:

4. The aforesaid loan(s) were all made at Plaintiff's home in
Cumberland County.
5. The aforesaid loans were all made by checks payable to either or
both Defendants, except for the following loans: $3,768.00 and $862.00,
both of which were made payable to Equity One; and the loans for
$138.00, $137.22, $137.39, $137.39, all of which were made payable to
PNC Bank, NA. All of the aforesaid loans were made at the specific
request of the Defendant(s).
6. Defendants have failed and refused to pay the aforesaid loan
balance(s) by May 1, 2003.
WHEREFORE, Plaintiff demands judgment ,against Defendants in the
sum of $5,547.00 plus District Justice costs of $162.05 and with
interest from and after May 1, 2003.
