KISHBAUGH entered into a contract with CRAIG S. KISHBAUGH AND VERONICA M. KISHBAUGH , to provide materials and/or to perform labor necessary for the construction and erection or the alteration and repair of (a) buildin s u~o~nl`t~hose certain pieces or parcels of land situated in COt1'IIIAMP'IbN TOWNSEiIP , EE!!ZZ County, Pennsylvania, being more particularly bounded and described as follows: Deed from Interfaith Housing Alliance, Inc. dated ll"IS"~ and intended to be recorded preceding the recording of this stipulation to Craig S. Kishbaugh and Veronica M. Kishbaugh. NOW, THEREFORE, it is hereby stipulated and agreed by and between the said parties, as part of the said contract and for the consideration therein set forth, that neither the undersigned contractor, any sub-contractor or materialman, nor any other person furnishing labor or material to the said contractor under this contract shall file a lien, commonly called a mechanic's lien, for work done or materials furnished to the said building or any part thereof. This stipulation is made and intended to be filed with the County Prothonotary within ten (10) days after date, in accordance with the requirements of Act of Assembly of Pennsylvania, in such case provided (49 P.S. 1402). (SEAL) EXHIBIT A ALL that tract of land in Southampton Township, Cumberland County, Pennsylvania, being more particularly described as follows: BEGINNING at an iron pin on the eastern right-of--way line for Walleye Drive at corner of Lot No. 26 on the hereinafter described subdivision plan; thence by said Lot No. 26, South 50 degrees 13 minutes 28 seconds East, 154.94 feet to an iron pin at corner of Lot No. 25 on the hereinafter described subdivision plan; thence by said Lot No. 25, South 38 degrees 08 minutes 54 seconds West, 62.31 feet to an existing post at corner of land now or formerly of Ronald J. Zeigler; thence by said land now or formerly of Ronald J. Zeigler, South 51 degrees 51 minutes 32 seconds West, 58.00 feet to an iron pin at corner of Lot No. 28 on the hereinafter described subdivision plan; thence by said Lot No. 28, North 41 degrees 53 minutes 40 seconds West, 151.41 feet to an iron pin in the eastern right-of--way line for Walleye Drive; thence in and along said eastern right-of--way line of Walleye Drive, by a curve to the left on a circle having a radius of 497.41 feet, for an arc distance of 72.32 feet, the chord of which is North 43 degrees 56 minutes 26 seconds East, 72.25 feet to an iron pin; thence in and along the eastern right-of--way line of Walleye Drive, North 39 degrees 46 minutes 32 seconds East, 25.00 feet to an iron pin in the eastern right-of--way line of Walleye Drive and at corner of Lot No. 26, the point of BEGINNING. CONTAINING 16,846 square feet more or less. THE ABOVE description was taken from a final subdivision plan for North Middle Spring Estates by Eric L. Diffenbaugh, Professional Land Surveyor, which plan is recorded in the Office of the Recorder of Deeds in and for Cumberland County, Pennsylvania, in Plan Book 91, at Page 61.
