Esquire, respectfully represents as follows:
1. Charles J. Nelson died on June 14, 2007, a resident of
Cumberland County, Pennsylvania.
2. The decedent's Will dated October 6, 1999 and naming
Ruby Gehr as Executrix and Brian Nelson as Successor Executor was
probated on June 26, 2007 to the above captioned file number.
3. Ruby Gehr having renounced her right to administer the
Estate, Letters Testamentary were issued to Brian Nelson.
4. Said Ruby Gehr died on July 10, 2007, and Letters
Testamentary were granted in her Estate to Evelyn R. Reeder to

Estate file no. 21-07-0671. Michael A. Scherer, Esquire is the
attorney for the Ruby Gehr Estate.
5. Ruby I. Gehr and Charles J. Nelson were the owners,
during their lifetime, of a 2001 Heritage Mobile Home located at
what is now known as North View Manor Mobile Home Park with a
mailing address of 21 Hidden Noll Road, Carlisle, PA 17013.
6. Ruby I. Gehr and Charles J. Nelson owned the mobile home
as tenants in common, and each Estate is therefore vested in an
undivided one-half ownership interest in the mobile home. Credit
Life Insurance paid off the lien on the mobile home, and a true
and correct copy of the title thereto is attached hereto, made a
part hereof, and marked Exhibi t "A".
7. The only assets owned by Charles J. Nelson, at his date
of death, exclusive of the mobile home, have a total value of
$1,869.06, as set forth on proposed Schedule "E" to the
Pennsylvania Inheritance Tax Return, a true and correct copy of
which is attached hereto, made a part hereof, and marked
Exhibit "B".
8. The said Charles J. Nelson Estate and Ruby I. Gehr
Estate obtained an appraisal of the value of the mobile home from
Terry L. Kimball, Board Certified Manufactured Housing Valuation
Expert, valuing the mobile home at $50,600, "if marketed
properly" .
9. The Executors of both Estates worked diligently together
in an effort to sell the mobile home by posting the property and

newspaper advertisement. Numerous persons were interested in
purchasing the mobile home for a value of $45,000, or greater,
but no perspective purchaser could secure financing to purchase
the mobile home.
10. No bona fide offers being received, the Executors
listed the property for sale with Park Place Properties LLC, a
mobile home sale brokerage company in which Terry Kimball, who
valued the mobile home, is an employee.
11. Park Place Properties have received a bona fide offer
from a qualified buyer to purchase the mobile home for the sum of
Thirty Thousand ($30,000.00) Dollars. A true and correct copy of
the offer is attached hereto, made a part hereof, and marked
Exhibit "C".
12. The Estate of Charles J. Nelson is insolvent. A
listing of debts and administrative expenses, by priority under
the PEF Code is attached hereto, made a part hereof, and marked
Exhibit "0".
13. Based upon attached Exhibit "0", for a sale price of
Thirty Thousand ($30,000.00) Dollars, subject to a minimum
broker's commission of One Thousand Two Hundred fifty ($1,250.00
Dollars, an additional Thirteen Thousand Seven Hundred fifty
($13,750.00) Dollars are available to the Nelson Estate, which
appears to be sufficient to pay all administrative expenses and
Priority 3, 4 and 5.1 and lienable claims but leaves little or no
balance to make payment against the unsecured claims of the Estate.

14. Attached as Exhibit "E", is a statement of fees
incurred by the undersigned attorney to date for work performed
to December 6, 2007. It is noted that the undersigned attorney
for the Estate normally bills at the hourly rate of Two Hundred
($200.00) Dollars per hour for his time expended. Due to the
insolvent nature of this Estate, the undersigned reduced his
normal hourly billing rate to One Hundred Fifty ($150.00) Dollars
per hour.
15. The Gehr and Nelson Estates have attempted to keep the
lot rent current in order to avoid being evicted from the Mobile
Home Park. The rules of the Mobile Home Park require that all
mobile homes must be owned by their occupants, and therefore
neither Estate has the capability of leasing the mobile home to a
third party.
16. Further, the Mobile Home Park must approve all
perspective new home owners in the Park. The proposed buyers of
the mobile home are currently residing in the Park and have been
approved by the Mobile Home Park to occupy the trailer, upon
their purchase of it.
17. Park Place Properties LLC is "confident" that if the
Estates can "hold on" until Spring, they may secure an offer of
Forty-five Thousand ($45,000.00) Dollars, or more. Nevertheless,
given the status of the mortgage and housing markets, and the
difficulty of persons seeking to live in mobile homes to secure
financing to purchase them, there is no guarantee that a better

offer will be forthcoming in the Spring.
18. Charles J. Nelson Estate does not have sufficient funds
to continue paying lot rent and utilities for the mobile home.
The remaining balance of funds from sale of tangible personal
property and the decedents bank account is now Four Hundred
Fifty-Seven and 04/100 ($457.04) Dollars. Exhibit "F" attached
hereto and incorporated herein by reference provides an
accounting of available assets of the Nelson Estate.
19. Fire and casualty insurance on the mobile home is in
effect through December 31, 2007 at which point coverage will
lapse. Charles Nelson Estate does not have sufficient funds to
pay mobile homeowner's insurance, and further the trailer being
vacant, may not be insurable at any cost.
20. The proposed purchaser of the mobile home has agreed to
leave their offer on the table until December 31, 2007.
21. Brian Nelson, Executor of the Charles J. Nelson Estate,
has been advised by his undersigned attorney that to sell the
mobile home for substantially less than an appraised value, he
should reasonably seek Court approval under Section 3353 of the
PEF Code.
22. Charles Nelson and Ruby Gehr Estates have been
cautioned by an unsecured creditor, Susquehanna Valley Federal
Credit Union, not to sell the property for below market value. A
true and correct copy of that letter of caution is attached
hereto, made a part hereof, and marked Exhibit "G".

23. The undersigned Executor and attorney reasonably
believe that it is in the best interest of the Charles J. Nelson
Estate to sell the mobile home to the qualified buyer for the
offered price of Thirty Thousand ($30,000.00) Dollars, to enable
it to avoid incurring further administrative expenses and to be
in a position to pay all lienable and priority claims of the
Estate.
24. The joinder of the Ruby I. Gehr Estate in this Petition
is attached hereto, made a part hereof and marked Exhibit "H".
TIME BEING OF THE ESSENCE IN THIS MATTER, your Petitioner
prays Your Honorable Court to enter an Order scheduling a hearing
on the matter prior to December 31, 2007 and to provide for
notice hereof to Susquehanna Valley Federal Credit Union by
facsimile transmission and First Class U.S. Mail, postage
prepaid, to its attorney of record, Steven Howell, Esquire,
providing it an opportunity to appear at a hearing in the matter
if it wishes to object to the sale of the mobile home for the
total selling price of Thirty Thousand ($30,000.00) Dollars.
