PETITION FOR CITATION TO COMPEL APPLICATION FOR LETTERS
PURSUANT TO 20 Pa. C.S. ~ 3155
1. Your Petitioner is Peter Vaccaro, III who resides at 264 Sand Hill Road,
Fleetwood, Berks County, Pennsylvania 19522.
2. The decedent, Clyde D. Zeigler died on November 3, 2005. At the time of death,
Clyde D. Zeigler resided at 20 Dewalt Drive, Mechanicsburg, PA 17050.
3. The decedent was survived by his wife, Sara Jane Zeigler who died November 17,
2005 from the injuries she suffered in this car accident. Petitioner believes and therefore avers
that there are no other intestate heirs of the decedent other than his wife who is now deceased.
4. On November 3,2005, your Petitioner and the decedent who was the owner of
and was then operating a 1984 Chevolet Caprice were was involved in a automobile collision in
the area of State Route 114 and Willow Hill Park Road in Silver Spring Township, Cumberland
County, Pennsylvania.
5. In the accident, Petitioner suffered personal injuries requiring medical care and
treatment and such care and treatment will be necessary in the indefinite future. Petitioner also
sustained a loss of earnings and a loss of future earning capacity because of the injuries he
suffered from the accident.
6. On October 31, 2007, Petitioner filed a Praecipe for Writ of Summons in Civil
Action-Law, against the Estate of Clyde D. Zeigler in the Court of Common Pleas of

Cumberland County, Pennsylvania due to Mr. Zeigler being deceased at the time of filing of the
Writ of Summons.
7. No estate was opened for Clyde D. Zeigler in Cumberland County, and it is
believed that he died intestate.
8. An estate was opened however for Sara Jane Zeigler in the Cumberland County
Register of Wills office. The Administratrix of the estate is Nancy Dellinger, 10 Meade Drive,
Carslisle, PA 17013. The estate is docketed at 21-05 -1026. The Attorney for the estate is
Robert G. Frey who has a business address of 5 S. Hanover Street, Carlisle, PA 17103.
Wherefore, Petitioner respectfully requests that citation be awarded pursuant to 20 Pa.
C.S. S 3155 directed to Nancy Dellinger, administratrix of the estate of Sara Jane Zeigler to show
cause why she should not apply for and take out letters of administration on the estate of Clyde
D. Zeigler, decedent or failing this to show cause why letters should not issue to Petitioner or his
nommee.
