HomeMy WebLinkAbout03-6016STIPULATION AGAINST LIENS THIS AGREEMENT made this27t~ay of October, 2003, by and between Reisinger Construction, hereinafter referred to as Contractor, Thomas L. Reed, Jr. and Doroth/ G. Reed, husband and wife, hereinafter referred to as Owner, whereby the contractor undertook and agreed to erected and construct a dwelling on the certain lot of ground situate in the Borough of Carlisle, C~,mherland County, Commonwealth of Pennsylvania, and more fully described in Exhibit "A" which is attached hereto and made a part hereof known as 316 Glendale Street, Carlisle, Cumberland County, PA. NOW THEREFORe, THIS AGREEMENT WITNESSETH: That the said Contractor, for an in consideration of the sum of ($1.00) Dollar to Contractor in hand paid by Owner, the receipt whereof is hereby acknowledged, and the further consideration mentioned in the agreement aforesaid, for itself, himself or themselves and its, his or their subcontractors, and all parties acting through or under them, covenant and agree that no mechanic's liens or claims shall be filed or maintained by them or any of them against the said buildings and the lot of ground appurtenant thereto for or on account of any work done or materials furnished by them or any of them under said contract or otherwise, for, towards, in, or about the erection and construction of the said buildings on the lot above described, and the said Contractor, for itself, himself or themselves, its, his or their subcontractors and others under them, hereby expressly waive and relinquish the right to have, file, and maintain any mechanic's liens or claims against the said buildings or any of them, and agree that this instrument, waiving the right of lien, shall be an independent covenant. (SEAL) NOTARIAL SEAL KANDI L LENKER, NOTARY PUBLIC CARLISLE BORO, CUMBERLAND COUNTY MYCOMMISSION EXPIRES FEBRUARY 20, 2005 Exhibit A ALL THAT CERTAIN tract of land with the improvements thereon erected, known as No. 316 Glendale Street, located in the Borough of Carlisle, Cumberland County, Pennsylvania, being the Southern 40 feet of Lot No. 20 and the Northern 60 feet of Lot No. 21 on the Plan of Rocky Ridges, said Plan being recorded in the Cumberland County Recorder's Office in Plan Book 5, Page 25, more particularly bounded and described as follows: BEGINNING at a point on the West side of Glendale Street, which point is located North 0 degrees 04 minutes West, a distance of 194.64 feet from the Northwest corner of Hillside Avenue and Glendale Street; thence through Lot No. 21, on said Plan, South 89 degrees 56 minutes West, a distance of 200 feet to a point in line of Lot No. 27, on said Plan; thence along Lots Nos. 27 and 28 on said Plan, North 0 degrees 04 minutes West, a distance of 100 feet to n point; thence through Lot No. 20, North 89 degrees 56 minutes East, a distance of 200 feet to a point on the West side of Glendale Street; thence along the West side of Glendale Street, South 0 degrees 04 minutes East, a distance of 100 feet to a point, the Place of BEGINNING.
