THIS AGREEMENT, made the / k/w'/~day of November, 2003, by and between
ZIMMER-GROVE HOMES, INC.,
hereinafter referred to as Contractor,
AND
KARSTEN MEIER and LEEANN MEIER, husband and wife
5106 Erbs Bridge Road, Mechanicsburg, PA,
hereinafter referred to as Owners,
Whereby the former undertook and agreed to erect and construct a single family dwelling on that certain lot
of ground situate in Hampden Township, Cumberland County, Pennsylvania, known as Lot No. 3 and a
matching tract on the western side of a proposed road as shown on Plan No. 2 of Bungalow Site, said Plan
being recorded in Cumberland County Plan Book 2, Page 67.
Being further identified as Tax Parcel No. 10-20-1844-008
NOW THEREFORE, THIS AGREEMENT WITNESSETH: That the said Contractor, for and in
consideration of the sum of ONE DOLLAR ($1.00) to him in hand paid by Owner, the receipt whereof is
hereby acknowledged, and the further consideration mentioned in the agreement aforesaid, for themselves
and their subcontractors, and all parties acting through or under them, covenant and agree that no mechanic's
liens or claims shall be filed or maintained by them or any of them against the said buildings and the lot of
ground appurtenant thereto for or on account of any work done or materials furnished by them or any of
them under said contract or otherwise, for, towards, in, or about the erection and construction of the said
buildings on the lot above-described, and the said Contractor, for themselves, their subcontractors and others
under them, hereby expressly waive and relinquish the right to have, file, and maintain any mechanic's liens
or claims against the said buildings or any of them, and agree that this instrument, waiving the right of lien,
shall be an independent covenant.

ALL THOSE TWO CERTAIN pieces or parcels of land simam in
17ampden Township, Cumberland County, Pennsylvania, more particularly bounded and
described as follows, to wit:
TRACT 1:
BEGINNING at a point on the eastern side of a proposed 30 foot street as
shown on Plan 2 of Bunga/ow Site, recorded in the Cumberland County Recorder's Office in
P/an Book 2, Page 67 on the dividing line between Lots 2 and 3 on .said Plan; thence along said
dividing line in an easterly direction, a distance of 250.00 feet to a point on the bank of the
Condoquinet Creek; thence along the bank of the Condoquinet Creek on a line forming a fight
angle w/th the ~ividing line between Lots 2 and 3 as aforesaid, in a northerly direct/on, a
distance of 56 feet to a stake at fine of land now or late of Robert M. Gross and w/£e; thence
along said hand now or late of Robert M. Gross and wile, in a southwesterly direction, a
distance of 250.00 l'~t to a sake on the eastern side of the proposed street as aforesaid; thence
along said proposed street in a southerly direction, a distance of 56 feet to a point, the place of
]~GI~G, HAVING THEREON ERECTED a dweliin9 house known and
_n__umb_ered as 5106 Erbs SridDe Road.
TRACT 2:
BEGINNh~G at a point on the western line of a proposed 30 foot street as
shown on Plan 2 of Bungalow Sims, said Plan being recorded in Cumberland County Recorder's
O~ce in Plan Book 2, Page 67, said point being 14.7.60 feet measured northwardly along the
western line of said street from line of lands now or late of Charles Erb; thence South 77
degrees 30 minutes West by lands now or late of Emandar Realty Company, now or late of
.Mervin Keller 196.40 feet to a point of land now or late of Joseph Shields; thence by the latter
land North 16 degrees 45 minutes West 56 feet more or less to a point at line of lands now or
~ of Robext M. Gross and Helen Gross, h/s wife; thence by said Gross lands North 78 degrees
30 minutes East 197.00 feet more or less to a point on the westeriy line of said proposed street;
thence by the latter line South 12 degrees 30 minutes East 56.00 feet to the place of
