is about to execute contemporaneously herewith, a contract, with HAUBERT HOMES, INC.
of 15 CENTRAL BLVD., CAMP HILL Pennsylvania·
for the erection of a story building upon a lot of land situate
and commonly known as 2151 Merrimac Avenue, Township of Upper Allen,Cummberland
County, Pennsylvania, as set forth in the deed dated August 15, 2003 recorded
at Deed Book 259, Page 1207, in the Recorder's Office for Cumberland County,
Pennsylvania, as more specifically described in Exhibit "A" which is incorporated
herein and attached hereto.
NOW. November 17, 2003 llJX . at the time of and immediately before the execution of the prin-
cipal contract, and before any authority has been given by the said Owner
to the said Contractor
to commence work on the said building· or purchase materials for thc same in consideration of the making of the said
contract with Contractor and the further
consideration of One Dollar. to Contractor paid
by Owner · it is agreed that no lien shall be filed against the
building by the contractor, or any sub-contractor· nor by any of the material men or workmen or any other person for any
labor, or materials purchased, or extra labor or materials purchased for the erection of said building, the right to file such
liens being expressly waived.

ALL TH. AT CERTAIN lot of land situate in the Township of Upper Allen, County of Cumberland
and Commonwealth of Pennsylvania, bounded and deacrib~d as follows, in accordance to the Final
Subdivision Plan for Creekstone Manor (formerly known as Trout Run), Phases II & III, dated January 1,
1996, prgpared by Hartman & Associates, Inc., and recorded in Plan Book 76, Page 133, to wit:
BEGINNING at a point on the southwestern line of Merrimac Avenue at the northern comer of Lot
No. 56 on the above mentioned Plan of Lots; thence along the western side of Lot No. 56, South 47 degrees
16 minutes 20 seconds West, a distance of 125.00 feet to a point at the comer of land now or formerly of
Ashcombe Farms North; thence along the northern line of said lands, North 42 degrees 43 minutes 40
seconds West, a distance of 85.00 feet to a point on the same lands and the southeastern comer of Lot No.
54 on the above mentioned Plan of Lots; thence along the eastern line of Lot No. 54, North 47 degrees 16
minutes 20 seconds East, a distance of 125.00 feet to a point on the southwestern side of Merrimac Avenue;
thence along the same side of Merrimac Avenue, South 42 degrees 43 minutes 40 seconds East, a distance
of 85.00 feet to a point, the point and place of BEGINNINO.
CONTAINING 10,625.00 square feet or 0.243 acre.
