STIPULATION AGAINST LIENS
THIS AGREEMENT made this 14th day of December 2007, by and
between Neidlinger Fine Hc:nes LLC, hereinafter referred to as
Contractor,
AND
Larry V. Neidlinger and Mary Jo Neidlinger, husband and wife,
hereinafter referred to as Owners, whereby the contractor undertook
and agreed to erected and construct dwellings on the certain lot of
ground situate in South Middleton Township, Cumberland County,
Pennsylvania, and more fully described in Exhibit "A" which is
attached hereto and made a part hereof known as Lot 1, Oxford Road,
Gardners, PA 17324.
NOW THEREFORE, THIS AGREEMENT WITNESSETH: That the said
Contractor, for an in consideration of the sum of ($1.00) Dollar to
Contractor in hand paid by Owner, the receipt whereof is hereby
acknowledged, and the further consideration mentioned in the
agreement aforesaid, for itself, himself or themselves and its, his
or their subcontractors, and all parties acting through or under
them, covenant and agree that no mechanic's liens or claims shall
be filed or maintained by them or any of them against the said
buildings and the lot of ground appurtenant thereto for or on
account of any work done or materials furnished by them or any of
them under said contract or otherwise, for, towards, in, or about
the erection and construction of the said buildings on the lot
above described, and the said Contractor, for itself, himself or
themselves, its, his or their subcontractors and others under them,
hereby expressly waive and relinquish the right to have, file, and
maintain any mechanic's liens or claims against the said buildings
or any of them, and agree that this instrument, waiving the right
of lien, shall be an independent covenant.

of Neidlinger Fine Homes LLC, known to me (or satisfactorily

purposes therein contained.

ALL THAT CERTAIN tract of land situate in South Middleton Township, Cumberland
County, Pennsylvania, bounded and described as follows:
BEGINNING at a point in the center of the public road known as the Oxford Road, said point
being the southwestern corner of land now or formerly of Richard E. McNew, et ux: thence by
the center line of said Road, South 33 degrees West, 203 feet, more or less, to a point; thence by
land now or formerly of Lester Myers, North 49 degrees 15 minutes West, 206.5 feet, more or
less, to a stake; thence by land now or formerly of John W. Marsh, North 31 degrees 30 minutes
East, 170 feet to a stake; thence by other land now or formerly of Richard E. McNew, et ux;
South 58 degrees 30 minutes East, 207 feet, more or less, to the Place of BEGINNING.
BEING the same premises which Francis~X. Bender, Jr. and Dorothy K. Bender, his wife, by
Deed dated February 3, 1989 and recorded February 3, 1989 in the Office of the Recorder of
Deeds in and for Cumberland County in Deed Book U33, Page 399, granted and conveyed unto
Thomas Eugene Myers and Molly S. Myers, his wife, the Grantors herein.
