HomeMy WebLinkAbout03-6044STIPULATION AGAINST LIENS THIS AGREEMENT made the 14th day of November, 2003, by and between Hoffman's Custom Contracting, Inc., hereinafter referred to as Contractor, and Robert R. Wild and Patricia A. Wild, hereinafter referred to as Owner, whereby the former undertook and agreed to erect and construct a custom built home on that certain lot of ground situate at Lot 40, 24 Morgan Drive, Kings Gap Estates, Dickinson Township, Cumberland County, Pennsylvania, known as more fully described in Exhibit "A" attached hereto and made a part hereof. NOW THEREFORE, WlTNESSETH: That the said Contractor, for and in consideration of the sum of ($1.00) Dollar to Contractor in hand paid by Owner, the receipt whereof is hereby acknowledged, and the further consideration mentioned in the agreement aforesaid, for themselves and their subcontractors, and all parties acting through or under them, covenant and agree that no mechanic's liens or claims shall be filed or maintained by them or any of them against the said buildings and the lot of ground appurtenant thereto for or on account of any work done or materials furnished by them or any of them under said contract or otherwise, for, towards, in, or about the erection and construction of the said buildings on the lot above described, and the said Contractor, for themselves, their subcontractors and others under them hereby expressly waive and relinquish the right to have, file, and maintain any mechanic's liens or claims against the said buildings or any of them, and agree that this instrunaent, waiving the right of lien, shall be an independent covenant. Wild, husband and wife, known to me to be the persons whose names are subscribed to the within instrument, and who acknowledge themselves to be the Owners of Lot 40, 24 Morgan Drive, Kings Gap Estates, Carlisle, Pennsylvania and that they as such owners, executed the foregoing statement for the purposes therein contained by signing their names. Hoffman, the President of Hoffman's Custom Contracting, Inc., a Pennsylvania corporation, known to me or satisfactorily proven to be the person whose name is subscribed to the within instrument and acknowledged that he, as said President, executed the same for the purposes therein contained. Not ~c~ Public cOMMONWEALTH OF PENNSYLVANIA SCHEDULEC PROPERTY DESCRIPTION The land referred to in this Commitment is described as follows: ALL THAT CERTAIN lot of land situate in Dickinson Township, Cumberland County, Pennsylvania, bounded and described in accordance with Final Subdivision Plan of Kings Gap Estates recorded on April 10, 1992, in the hereinafter named Recorder's Office in Plan Book 64, Page 48, etc., as follows: BEGINNING at a point on the southern line of 60 feet wide Morgan Drive at the dividing line between Lots Nos. 39 and 40; thence along said southern tine of 60 feet wide Morgan Drive North 74 degrees 39 minutes 39 seconds East a distance of 196.26 feet to a point at the dividing line between Lots Nos. 40 and 30; thence along the western lines of Lots Nos. 30 and 31, and 32, South 8 degrees 51 minutes 28 seconds West a distance of 389.65 feet to a point at the dividing line between Lots Nos. 35 and 40; thence along said dividing line between said Lots Nos. 35 and 40, South 83 degrees 29 minutes 38 seconds West a distance of 170.00 feet to a point at corner common to Lots Nos. 35 and 36 and 39 and 40; thence along the dividing line between said Lots Nos. 39 and 40, North 06 degrees 25 minutes 03 seconds East a distance of 354.57 feet to a point on the southern line of 60 feet wide Morgan Drive at the Place of BEGINNING. THE ABOVE described Lot of land is all of Lot No. 40 as shown on said Final Subdivision Plan of Kings Gap Estates recorded as aforesaid, and contains an area of 64,251 square feet, or 1.48 acres, more or less. THE ABOVE described lot of land has a mailing address of 24 Morgan Drive, Carlisle, PA 17013. THE ABOVE described lot of land is a portion of a larger tract of land which Ediu Corporation by its Deed dated March 4, 1969 and recorded March 5, 1969 in the Office of the Recorder of Deeds in and for Cumberland County at Carlisle, Pennsylvania in Deed Book "C" Volume 23, Page 791, granted and conveyed to L.B. Phillips, Jr., and Edna Lucille Phillips, husband and wife. The said Edna Lucille Phillips having died on November 1, 1998, title to the same remains vested by operation of law solely in her surviving spouse L. B. Phillips, Jr. who is the Grantor herein.
