STIPULATION AGAINST LIENS
THIS AGREEMENT made this / 3 ~'~ day of /'/~x-*~ ~z~,~
by and between
W. Lee Roland, Builder
hereinafter called the Contractor,
Joseph J. Marcin& Rita A. Girondi
hereinafter called the Owner.
W1TNESSETH THAT:
The Contractor by instrument dated 9-16-03
entered into an Agreement with the Owner for the erection and construction of a,
Single Family Residence
situated on Wmtworth Estates, Lot 24, Hampden Township, Cumberland County,
Mechanicsburg, PA 17050
AND WHEREAS, the Contractor has covenanted and alp~-d therein to enter into an additional
agreement with the Owner stipulating that no lien or liens of any kind shall be filed against the
above building or the appurtenances thereto.
NOW, THIS AGREEMENT WITNESSETH, that the Contractor, for and in consideration of the
awarding to him of the said contract as for the sum of ONE DOLLAR ($1.00) to him in hand paid
by the Owner, the receipt of which is hereby acknowledged, promises and agrees that no
Mechanic Lien or liens shall be filed against the aforesaid building or the appurtenances thereto
by any subcontractor, subcontractors, matemflmen, mechanics, laborers or anyone for materials
furnished, work done or services rendered of any kind whatsoever, for or about, or on accomat of
the aforesaid building or on the credit thereof.

ALL that certain piece or parcel of land situate in the Township
of Hampden, County of Cumberland and Commonwealth of
Pennsylvania, lying along Claridge Court and being approximately
410 feet northwest of the intersection of Claridge Court and
Heatherington Way, bounded and described as follows, to wit:
BEGINNING at the intersection of the southerly right-of-way line
of Claridge Court (cul-de-sac) with the line of division between
Lot 23 and Lot 24; extending (1) thence along Lot 23, South 28
degrees 13 minutes 19 seconds West, 341.71 feet; extending (2)
thence along Lot 20, North 87 degrees 43 minutes 44 seconds West,
33.18 feet; extending (3) thence along the lands now or formerly
of Augustus E. and Anna Mae Putt as recorded among the land
records of Cumberland County in Deed Book 13H, Page 369, North 05
degrees 18 minutes 29 seconds West, 114.30 feet; extending (4)
thence along the same, South 87 degrees 05 minutes 03 seconds
West, 63.62 feet; extending (5) thence along Lot 25, North 29
degrees 40 minutes 07 seconds East, 293.97 feet to the southerly
right-of-way line of Claridge Court; extending (6) thence along
said right-of-way line by a curve to the left, having a radius of
80.00 feet, an arc distance of 2.02 feet, and a chord bearing and
distance of South 61 degrees 03 minutes 17 seconds East, 2.02
feet; extending (7) thence along the same, South 61 degrees 46
minutes 41 seconds East, 137.98 feet to the place of BEGINNING.
CONTAINING 1.008 acres.
BEING Lot NO. 24 as shown on a plan entitled '~Final Subdivision
Plan for Phase 1, Wentworth Estates" dated November 20, 2002,
last revised April 11, 2003, Job Number 1001-846, prepared by LSC
Design, Inc., York, PA and recorded in Cumberland County Office
of the Recorder of Deeds in Plan Book 87, Page 50.
BEING the same premises which Smith Land & Improvement
Corporation, A Delaware Corporation, and Kinsley Equities II
Limited Partnership, a Pennsylvania limited partnership, by Deed
dated September 15, 2003 and recorded in Cumberland County, in
Deed Book 259, page 1609, conveyed unto Joseph J. Marcin and Rita
A. Girondi, husband and wife.
