WHEREAS, GREGORY O. SEIBOLD, A SINGLE PERSON of 52 QUARRY HILL ROAD, WARNERSVILLE,
PENNSYLVANIA 19565, is about to execute contemporaneously herewith a contract with BONNIE
HEIGHTS HOMES of , for the erection of a story building upon a lot of land
situate
SEE EXHIBIT "A" ATTACHED HERETO AND MADE A PART HEREOF FOR ALL PURPOSES
NOW, NOVEMBER 21, 2003, at the time of and immediately before the execution of the principal
contract, and before any authority has been given by the said OWNER to the said CONTRACTOR to
commence work on the said building, or purchase materials for the same in consideration of the making of
the said contract with OWNER and the further consideration of one Dollar, to CONTRACTOR paid by
OWNER it is agree that no lien shall be filed against the building by the contractor, or any subcontractor,
nor by any of the material men or workmen or any other person for any labor, or materials purchased, or
extra labor or materials purchased for the erection of said building, the right to file such liens being
expressly waived.

ALL that certain tract of land situate in North Newton Township, Cumberland County,
Pennsylvania, bounded and described in accordance with a Plan prepared by Rodney Lee Decker,
R.P.L.S., dated June 8, 1989 and recorded in the Office of the Recorder of Deeds for Cumberland
County in Plan Book 58, Page 109.
BEGINNING at a point in centerline of PA Route 641,'at corner of lands now or
formerly of Jay L. Lehman as noted on said plan; thence along lands now or formerly of Jay L.
Lehman South 24 degrees 04 minutes 20 seconds West 352.28 feet to a point at Lot No. 21;
thence along Lot No. 21 North 86 degrees 34 minutes 05 seconds West 88.70 feet to a point;
thence along Lot No. 22 North 03 degrees 26 minutes 00 seconds East 330.00 feet to a point;
thence along centerline of Pa. Route 641 South 86 degrees 34 minutes 05 seconds East 38.57 feet
to a point; thence continuing along centerline of PA Route 641 South 86 degrees 27 minutes 30
seconds East 174.31 feet to a point, the Place of BEGINNING
CONTAINING 1.142 acres and designated as Lot 23 of North Newton Manor.
BEING part of the same premises which Orvel W. Baer and Pauline E. Baer, his wife,
granted and conveyed to Kimba, Inc., et al, Grantors herein, by deed dated August 7, 1989 and
recorded in the Office of the Recorder of Deeds for Cumberland County in Deed Book C,
Volume 34, Page 227.
UNDER AND SUBJECT NEVERTHELESS to the following building and use
restrictions which shall be binding on the within described tract of land only an shall not be
deemed binding on other land of the Grantors, with which building and use restrictions mad
within Grantees, their heirs and assigns, by acceptance of this deed agree to comply.
1. No mobile homes are pemfitted on any lot in this subdivision.
2. All residential structures shall have a minimum of 1200 square feet of finished living
floor area.
3. No licensed vehicles, junk yard or junk cars are permitted on any lot at any time.
4. There shall be no stockpiling of any material except firewood on any lot at any time.
5. No conm~ercial farming.
6. No open dumping
