Contractor IN THE COURT OF COMMON PLEAS CUMBERLAND COUNTY, PENNSYLVANIA This instrument is executed this ~,q~ day of November, 2003, by Lobar, Inc., a Pennsylvania business corporation with principal offices at 1 Old Mill Road, PO Box 50, Dillsburg, Pennsylvania, 17019-0050 ("Contractor") in favor of Borough of Carlisle, a Pennsylvania mnnicipality with principal offices at 53 West South Street, Carlisle, Pennsylvania, 17013 ("Owner"). Whereas, Owner is about to execute contemporaneously herewith, a contract with Contractor for the erection ora municipal police center upon tracts of land situate in Carlisle Borough, Cumberland County, Pennsylvania, collectively situate on Lincoln Street, more fully described as follows: ALL THAT CERTAIN piece or parcel of land situate in the Borough of Carlisle, County of Cumberland, Commonwealth of Pennsylvania, with the improvements thereon erected, more particularly bounded and described as follows: BEGINNING at a point at the intersection of the southern line of Lincoln Street and the eastern line of an alley; thence along the eastern line of said alley (16 feet wide) South 12 degrees 3 minutes West a distance of 346 feet to a point on the northern line of Peun Street; thence along the northern line of Penn Street South 77 degrees 30 minutes East a distance of 135 feet to a point on other lands formerly of Cutler- Federal, Inc., and now or formerly of the Cumberland County Redevelopment Authority; thence along said last mentioned line of lands the following two (2) courses and distances: (1) North 36 degrees 15 minutes East a distance of 239 feet, more or less, to a point and (2) North 12 degrees 3 minutes East a distance of 126 feet, more or less, to a point on the southern line of Lincoln Street; thence along said last mentioned southern line of Lincoln Street North 77 degrees 30 minutes West a distance of 227 feet to a point, the place of BEGINNING. CONTAINING an area of 68,376 square feet, more or less. BEING the same premises which Robvirco, a Pennsylvania limited partnership conveyed to the Borough of Carlisle. TOGETHER WITH certain tracts acquired by the Borough of Carlisle from Pennsylvania Lines, LLC, under its power of eminent domain pursuant to proceedings duly filed of record in the Offices of the Prothonotary and Recorder of Deeds in and for Cumberland County. iNCLUDING, the unopened portions of West Penn Street and Factory Street abutting the above described tracts. Now, November ;~c~ ,2003, atthetimeofandimmediatelybeforetheexecutionoftheconstruction contract aforesaid, and before any authority has been given by the said Owner to the said Contractor to commence work on the said building, or purchase materials for the same, in consideration of the Owner making of the said contract with Contractor, and intending to be legally bound hereby, it is agreed that no lien shall be filed against the building by Contractor, or any sub~contractor, nor by any of the materialmen or workmen or any other person for any labor, or materials purchased, or extra labor or materials purchased for the erection of said building, the right to file such liens being expressly waived.
