OF ASSESSMENT APPEALS,
Appellee
IN THE COURT OF COMMON PLEAS
CUMBERLAND COUNTY, PENNSYLVANIA
No.
Tax Parcel No. 13-24-0797-041
NOTICE OF APPEAL OF DECISION
OF CUMBERLAND COUNTY
BOARD OF ASSESSMENT APPEALS
Appellants, David A. Krulac and Diane E. Krulac, husband and wife, by and through
their undersigned counsel, James A. Diamond, Esquire, hereby appeal, and petition the Court to
review, de novo, the Decision of the Cumberland County Board of Assessment Appeals of mail-
ing date October 29, 2003, setting the assessed value of the real estate tract located at 8 Walnut
Lane, Lower Allen Township, Cumberland County, Pennsylvania, and designated as Parcel
Number 13-24-0797-041. In support of their Appeal, Appellants aver as follows:
1. David A. Krulac and Diane E. Krulac, husband and wife (hereinafter "Appellants"
or "Taxpayers"), are adult individuals and residents of the Cormnonwealth of Pennsylvania, with
a mailing address at P.O. Box 1064, Mechanicsburg, Pennsylvania 17055.
2. Appellants are owners and taxpayers with respect to the residential real estate
tract located at 8 Walnut Lane, Lower Allen Township, Cumberland County, Pennsylvania,
which is designated as Tax Parcel Number 13-24-0797-041 (hereinafter the "Subject Property").
3. By Decision of mailing date October 29, 2003, a true and correct copy of which is
attached hereto as "Exhibit A" and incorporated herein by reference, the Cumberland County
Board of Assessment Appeals, following a heating that was held on or about October 27, 2003,
determined that the applicable fair market value, or actual value, of the Subject Property was
$97,900.00.
4. Appellants are aggrieved by, and hereby appeal, the said Decision of the Cumber-
land County Board of Assessment Appeals.
5. The said Decision of the Cumberland County Board of Assessment Appeals is er-
roneous to the extent that it finds the actual fair market value of the Subject Property to be in ex-
cess of $74,500.00.
6. The actual fair value of the Subject Property was at all relevant times, including
as of the date of the filing of this Appeal to the Board, no greater than $74,500.00.
7. To the extent that the said Decision of the Cumberland County Board of Assess-
ment Appeals failed to find the fair market value to be $74,500.00, or less, it is incorrect and er-
roneous.
8.
This Court has jurisdiction over this de novo appeal, including by virtue of 42 Pa.
C.S.A. {}933; 72 P.S. {}5020-518.1; and Article 5, Section 9 of the Pennsylvania Constitution.
WHEREFORE, Appellants respectfully request that this Court set this matter for a hear-
ing de novo; that the Determination of the Cumberland County Board of Assessment Appeals be
set aside; and that a Decision be rendered by this Court finding the proper assessed value of the
Subject Property to be no greater than $74,500.00.

ANSWER
AND NOW, comes Cumberland County Board of Assessment Appeals and County
of Cumberland, by Stephen D. Tiley, Assistant Cumberland County Solicitor for tax
matters, and files this Answer, of which the following is a statement:
1. Admitted.
2. Admitted.
3. Admitted in part. Denied in part. By way of further Answer, the Board of
Assessment Appeals reduced the assessment from $102,640 to $97,990.00. (Not
$97,900.00 as stated by Appellant.) The within appeal being de novo, the assessment
appealed is the pre-existing value of $102,640.00.
4. Admitted in part. Denied in part. It is admitted that Appellants have
appealed, it is denied that they have a legitimate basis for their appeal. Whether or not
Appellants are "aggrieved" is a conclusion of law to which no responsive pleading is
required.
5. Denied. The averments of this paragraph of the Notice of Appeal of
Decision constitute a conclusion of law to which no responsive pleading is required.

6. Denied. The averments of this paragraph of the Notice of Appeal of
Decision constitute a conclusion of law to which no responsive pleading is required.
7. Denied. The averments of this paragraph of the Notice of Appeal of
Decision constitute a conclusion of law to which no responsive pleading is required.
8. Admitted. It is admitted that the Court has jurisdiction, however, the more
appropriate citation is to Section 704 of The Fourth to Eighth Class County Assessment
Law (72 P.S. §5453.704) which is the more specific, and therefore controlling section over
Section 518.1 of The General County Assessment Law.
WHEREFORE, Respondent, Cumberland County Board of Assessment Appeals
and County of Cumberland, prays Your Honorable Court fnr a Decision denying
Appellant's appeal for setting the value of the subject real estate at $102,640, or such
greater amount as the Court may deem just and proper.
