COMPLAINT IN CIVIL ACTION AND NOTICE TO DEFEND
You have been sued in court. If you wish to defend against the claims set forth in the following
pages, you must take action within twenty (20) days after this complaint and notice are served, by entering
a written appearance personally or by an attorney and filing in writing with the court your defenses or
objections to the claims set forth against you. You are warned that if you fail to do so the case may
proceed without you and a judgment may be entered against you by the court without further notice for
any money claimed in the complaint or for any other claim or relief requested by the plaintiff. You may
lose money or property or other rights important to you.

COMPLAINT
I. Plaintiff is a corporation having offices m 4161 Piedmont Parkway, Greenboro, NC
27409.
2. Defendant is an adult individual residing at 183 Rustic Drive, Shippensburg, PA 17257.
3. On or about September 8, 1998, Defendant duly executed a Installment Loan Contract
(hereinafter the "Contract") in favor of Plaintiff, a true and correct copy of said Contract is attached
hereto, marked as Exhibit "1" and made a part hereof.
4. Pursuant to said Contract, Defendant took possession of the mobile home more particularly
identified in the Contract as a I 990 Fisher 52 x 28.
5. Plaintiff avers that Defendant is in default of the Contract by having not made payment to
Plaintiff as promised, thereby rendering the entire balance immediately due and payable.
6. Plaintiff avers that a balance of$50,930.78 is due from Defendant as of October 23,2003.
7. Plaintiff avers that the Contract between the parties provides that Plaintiff is entitled to
interest at the rate of 10.45% per annum.
8. Plaintiff avers that the Contract between the parties provides that Defendant will pay
Plaintiff's reasonable attorneys' fees.
9. Plaintiff avers that such attorneys' fees amount to $5,000.00.
10. Although repeatedly requested to do so by Plaintiff, Defendant has willfully failed and/or
refused to pay the principal balance, attorneys' fees, interest, or any part thereof to Plaintiff.
WHEREFORE, Plaintiff demands judgment against Defendant, Mary E. Griffin, individually, in
the amount of$55,930.78 with continuing interest thereon at the Contract rate of 10.45% per annum from
October 23, 2003 and costs.
THIS IS AN ATTEMPT TO COLLECT A DEBT AND ANY INFORMATION OBTAINED
SHALL BE USED FOR THAT PURPOSE.

AND NOW, comes Plaintiff, by counsel, Weltman, Weinberg & Reis Co., L.P.A. and petitions this
honorable court to enter an Order allowing service upon Defendant, Mary E. Griffin, by Certified Mail and
by Certificate of Mailing Postal Form 3817, postage prepaid, addressed to 183 Rustic Drive,
Shippensburg, PA 17257, averring in support of the following:
1. On or about December 1, 2003, pursuant to Defendants breach of a written contract
entered into between the parties for mobile home, Plaintiff filed a Complaint in Civii Action against
Defendant to recover the unpaid balance on the contract due Plaintiff from Defendant in the amount of
$55,930.78 together with continuing interest thereon at the rate of 10.45% per annum and costs.
2. When the Sheriff of Cumberland County, Pennsylvania, attempted to make service of
Plaintiff's Complaint on Defendant, the Sheriff was unable to do so, evidenced by the Sheriff's return, a
true and correct copy of which is attached hereto, marked Exhibit "1 ", and made a part hereof.
3. Upon receipt of the Sheriff's return of no service, Plaintiff conducted an investigation with
the United States Postal Service to confirm the physical address of the Defendant.
4. Pursuant to Plaintiff's request for information, the United States Postal Service confirmed
Defendants physical address of 183 Rustic Drive, Shippensburg, PA 17257, a true and correct copy of
Plaintiff's Postal Request are attached hereto and marked as Exhibit "2", and made a part hereof.
5. Plaintiff contacted the Cumberland County Directory Assistance, a representative from
which could not provide a current address for Defendant of 183 Rustic Drive, Shippensburg, PA 17257.
6. Plaintiff conducted a Trans Union Credit Bureau Report which indicates the defendants
last known address as being 183 Rustic Drive, Shippensburg, PA 17257. Said credit report is attached
as Exhibit "3'.
8. Plaintiff received vehicle information from the Department of Transportation, which shows
that a vehicle is registered to Defendant at the current address of 183 Rustic Drive, Shippensburg, PA
17257. A true and correct copy of the vehicle record is attached hereto, made a part hereof and marked
Exhibit "4".
9. Based upon the foregoing, Plaintiff believes and therefore avers that Defendant, Mary E.
Griffin, is attempting to avoid service of process in the above-captioned matter and Plaintiff therefore
seeks an Order of Court, pursuant to Pennsylvania Rule of Civil Procedure 430, granting Plaintiff leave
to serve its Complaint on Defendant by alternative means.
WHEREFORE, Plaintiff respectfully requests this Honorable Court permit Plaintiff to serve
Defendant, Mary E. Griffin, with the Complaint in Civil Action by permitting the Plaintiff to mail a copy of
the Complaint in Civil Action to Defendant at her last known address being 183 Rustic Drive,
