BECKERLEG, Defendant IN THE COURT OF COMMON PLEAS OF CUMBERLAND COUNTY, PENNSYLVANIA CIVIL ACTION - LAW NO. 2003 -6214 CIVIL 1N CUSTODY CO~TO~ER AND NOW, this ~'t~ day of January, 2004, upon consideration of the attached Custody Conciliation Report, it is ordered and directed as follows: A hearing is scheduled,~n Courtroom No. ~ of the Cumberland County Courthouse on the ~q day of /f)~-~A~ , 2004, at C~; 3(9 /~ .M. at which time test~nt'ony will be taken in the above case. At this hearing, the Mother, Kimberly R. Beckerleg, shall be the moving party and shall proceed initially with testimony. Counsel for the parties, shall f'de with the court and opposing counsel a memorandum setting forth the history of custody in this case, the issues currently before the court, each party's position on these issues, a list of witnesses who will be called to testify and a summary of the anticipated testimony of each witness. This memorandum shall be filed at least ten (10) days prior to the mentioned hearing date. Pending further Order of Court, the following temporary custody order is entered: Bo The Mother, Kimberly R. Beckerleg, and the Father, James J. Beckerleg, shall enjoy shared legal and shared physical custody of Samantha M. Beckerleg, born March 31, 1993; and Tabitha F. Beckerleg, born November 16, 1994. Physical custody shall be handled with Father having the following periods of physical custody with the minor children: On alternating weekends from Friday after school until the following Tuesday at 7:30 p.m. On the weekends Father does not have custody, he shall have custody from Sunday at 6:00 p.m. until Monday at 7:30 p.m. C. Mother shall enjoy custody of the minor children at all other times. For exchange of custody, the receiving parent shall pick up the children either at school or at the other parent's home unless agreed otherwise by the parties. The parties may modify this schedule in any form that they may agree. However, absent an agreement, the schedule set forth above shall control. In the event the parties believe that another custody conciliation conference would aide in resolving this case prior to the above mentioned hearing, counsel for either party may contact the conciliator directly to schedule such a conference. BECKERLEG, Defendant : IN THE COURT OF COMMON PLEAS OF : CUMBERLAND COUNTY, PENNSYLVANIA : : CIVIL ACTION - LAW : : NO. 2003 - 6214 CIVIL : IN CUSTODY Prior Judge: CONCILIATION CONFERENCE SUMMARY REPORT IN ACCORDANCE WITH THE CUMBERLAND COUNTY CIVIL RULE OF PROCEDURE 1915.3-8(b), the undersigned Custody Conciliator submits the following report: The pertinent information pertaining to the children who are the subject of this litigation is as follows: Samantha M. Beckerleg, born March 31, 1993; and Tabitha F. Beckerleg, born November 16, 1994. A Conciliation Conference was held on January 2, 2004, with the following individuals in attendance: The Mother, Kimberiy R. Beckerleg, with her counsel, Steven J. Shanahan, Esquire; and the Father, James J. Beckerleg, with his counsel, Carol J. Lindsay, Esquire. The parties separated shortly before Thanksgiving. There is a major dispute relative to circumstances of separation with Father saying he left because he understood the Mother was going to leave. There is also a lot of disagreement with respect to who actually provided a majority of the parenting for the children. There is a problem relative to work schedules in that Mother works at a nursing home on a 6:00-2:00 shift during the week and Father works at a distribution center on an 11:00-7:00 shift. The conciliator spent a fair amount of time with the parties and their attorneys trying to work out a schedule. Father is asserting a claim for primary custody and has requested an alternating week on/week off schedule pending a hearing. Mother is also asserting primary custody, and she has enjoy primary custody since the parties separated only because she was the first one to take advantage of that opportunity. Over the past few weeks, the parties worked out a schedule with Father enjoying alternating weekends and some other times. However, Father asserts he has had a major impact in the children's lives and that he should not simply he a weekend father. In light of the work schedules and other information provided at the custody conciliation conference, the conciliator recommends that a hearing be scheduled and that a temporary custody order be entered in the form as attached.
