AND NOW, Tuesday, December 09, 2003 , upon consideration of the attached Complaint,
it is hereby directed that parties and their respective counsel appear before Melissa P. Greevy, Esq. _, the conciliator,
at 301 Market Street, Lemoyne, PA 17043 on Tuesday, January 13, 2004 at 11:30 AM
for a Pre-Hearing Custody Conference. At such conference, an effort will be made to resolve the issues in dispute; or
if this cannot be accomplished, to define and narrow tbe issues to be heard by the court, and to enter into a temporary
order. All children age five or older ma;/also be present at the conference. Failure to appear at the conference may
provide grounds for entry of a temporary or permanent order.
The court hereby directs the parties to furnish any and ali existing Protection from Abuse orders,
Special Relief orders, and Custody orders to the conciliator 48 hours prior to scheduled hearing,

AND NOW, this ~ day of March, 2004, upon consideration of the attached
Custody Conciliation Summary Report, it is hereby ordered and directed as follows:
1. Le.qal Custody. The parties, Joseph M. Pinci and Shannon Penica, shall have
shared legal custody of the minor child, Mia Michela Walter-Pinci, born March 25, 1997.
Each parent shaft have an equal right, to be exercised jointly with the other parent, to make
all major non-emergency decisions affecting the child's general well-being including, but not
limited to, all decisions regarding her health, education and religion. Pursuant to the terms
of 23 Pa. C. S. §5309, each parent shall be entitled to all records and information pertaining
to the child including, but not limited to, medical, dental, religious or schoOl records, the
residence address of the child and of the other parent. To the extent one parent has
possession of any such records or information, that parent shall be required to share the
same, or copies thereof, with the other parent within such reasonable time as to make the
records and information of reasonable use to the other parent.
2. Physical Custody. Mother shall have physical custody subject to Father's right
of partial custody which shall be arranged as follows:
A. Effective February 28, 2004 and to continue through March 20,
2004, each Saturday from 11:00 a.m. until 3:00 p.m.
B. Effective March 27, 2004 and to continue through and including
April 24, 2004 on alternating weekends from Saturday at 3:00 p.m. until
Sunday at 5:00 p.m. However, on the weekend of April 10, 2004, Father's
custodial time shall be from Saturday at 11:00 a.m. until Sunday at 2:00 p.m.
for the Easter holiday weekend.
C. Commencing May 7, 2004 and continuing thereafter on
alternating weekends from Friday at 6:00 p.m. until Sunday at 5:00 p.m.

3. Holidays. The following schedule supercedes the regular schedule:
A. In even numbered years, Father will have custody for Easter
and Independence Day and Mother will have custody for Memorial Day and
Labor Day. In odd numbered years, Mother will have custody for Easter and
Independence Day and Father will have custody for Memorial Day and Labor
Day. Unless otherwise agreed, the custodial period for these holidays shall
be from 10:00 a.m. until 5:00 p.m.
B. Thanks,qivin,q. In odd numbered years, Mother will have
custody for Thanksgiving from Wednesday preceding Thanksgiving after
school until 2:00 p.m. Thanksgiving day and Father will have custody from
2:00 p.m. Thanksgiving day until 8:00 p.m. Thanksgiving day. In even
numbered years, Mother will have custody from 2:00 p.m. until 8:00 p.m.
Thanksgiving day and Father will have custody from Wednesday preceding
Thanksgiving after school until 2:00 p.m. Thanksgiving day.
C. Christmas. In even numbered years, Mother will have custody
from December ~ at noon until December 25th at noon and Father will have
custody from December 25th until December 26th at 6:00 p.m. In odd
numbered years, Father will have custody from December 24th at noon until

noon until December 26th at 6:00 p.m.
D. Mother's Day / Father's Day. Mother will have custody for
Mother's Day and Father will have custody for Father's Day. Unless
otherwise agreed, the custodial period for these holidays shall be from 10:00
a.m. until 5:00 p.m.
4. Transportation. The party receiving custody of the child will provide
transportation incident to the custodial exchange.
5. Mother shall not be required to wait more than fifteen (15) minutes for Father's
arrival at the custodial exchange time unless Father calls to let her know that he is enroute
to pick up the child. If Father is more than fifteen (15) minutes late and has not called,
Mother shall be free to make other plans with the child.
6. The parties recognize that the child may experience some adjustment
challenges with the introduction of the above documented custodial plan. In the event that
this so occurs, Mother will contact Father to discuss how the parties can assist the child in
this adjustment. The parties are expected to work cooperatively to ensure the child's
frequent and continuing contact with both parents.

7. This Order is temporary in nature. If within sixty days of the date of this Order
an additional Conference is needed, counsel for either party may contact the Conciliator by
letter to request that the Custody Conciliation Conference be reconvened.

Custody Conciliation Summary Report, it is hereby ordered and directed as follows:

6. The parties will be responsible to see to ii: that the child is not subject to
second hand cigarette smoke whether the child be in a vehicle or in one of the parties'
residences. Neither shall the child be left alone in a vehicle outside the line of sight while
the parent goes into a bank or store.
7. This Order is temporary in nature. If before r)ecember 31, 2004, an additional
Conference is needed, counsel for either party may contact the Conciliator by letter to
request that the Custody Conciliation Conference be reconvened.
