SMILEY Defendant MOTION FOR A SPECIAL ORDER DIRECTING SERVICE BY PUBLICATION PURSUANT TO RULE 430 OF THE PENNSYLVANIA RULES OF CIVILE PROCEDURE AND NOW, here comes Plaintiff, Epsys Corporation, by and through their attoneys, Dickie, McCamey & Chilcote, P.C., and moves a follows: 1. Plaintiff filed a Praecipe for Writ of Summons with this Honorable Court on or about November 26, 2003. 2. Pennsylvania Rule of Civil Procedure 400(a) provides that "original process shall be served within the Commonwealth only by the sheriff." Pa.R.Civ.P. 400(a). 3. In accordance with the Pennsylvania Rules of Civil Procedure, Plaintiffs directed the Cumberland County Sheriff to serve Defendant Smiley with the Writ of Summons at115 East Columbia Road, Enola. PA, Cumberland County. 4. 115 East Columbia Road, Enola, PA, Cumberland County is the address of Defendant as it appears in the most recent Cumberland County telephone directory. 5. The Sheriff indicated to Plaintiff's Attorney, Charles E. Haddick, Jr., through his legal assistant, Kim Contini, that the Cumberland County Sheriffs were not able to serve Defendant at that address because Defendant would not come to the door when the Sheriffs arrived. 6. The Cumberland County Sheriff further indicated to Plaintiff's Attorney that it appeared that somebody was home at the above address. 7. Accordingly, Plaintiff filed the appropriate Praecipe to Reinstate Complaint with this Honorable Court in December, January, February, March, and April, each time requesting that the Cumberland County Sheriff serve Defendant at 115 East Columbia Road, Enola. PA, Cumberland County. 8. Pennsylvania Rule of Civil Procedure 430(a) provides that "[i]f service cannot be made under the applicable rule the plaintiff may move the court for a special order directing the method of service." Pa.R.Civ.P. 430(a). 9. "The motion shall be accompanied by an affidavit stating the nature and extent of the investigation which has been made to determine the whereabouts of the defendant and the reasons why service cannot be made." Pa.R.Civ.P. 430(a). See Exhibit 1. 10. To date, the Cumberland County Sheriffs have still been unable to serve original process on Defendant. 11. Despite Plaintiff's and Plaintiff's Attorneys' good faith effort to obtain Original Service on Defendant, Plaintiff still has not obtained original process on Defendant. 12. Plaintiff believes that 115 East Columbia Road, Enola, PA, Cumberland County is Defendant's current address and that Defendant is concealing himself from the Cumberland County Sheriff at that address. WHEREFORE, Plaintiff, Epsys Corporation, asks that this Honorable Court enter a special order directing service by publication in accordance with Pennsylvania Rule of Civil Procedure 430. This address appeared on our second instructions to the Cumberland County Sheriff provided by my office on or about December 29, 2003. Ph Me # Phone # F"# Fax # Subject: Phase II Soil Investigation Report for 5,000-Gallon Waste Oil UST Property at Susquehanna Ave. & Enola Rd., Enola, Pennsylvania EPSC 420013404 EPSYS Corporation (EPSYS) was retained by the Estate of Ross R Smiley to perform a Phase 11 soil investigation for a waste oil underground storage tank (UST). The tank is on property located at the intersection of Susquehanna Avenue and Enola Road (U.S. Route 11/15) in Enola, Pennsylvania. Soil borings were advanced around the perimeter of the tank, samples screened and characterized in the field, and samples collected and submitted for laboratory analysis of used motor oil parameters. The tank has a diameter of 72 inches and is approximately 23 feet long with an estimated capacity of 5,000 gallons. The purpose of the boring program was to investigate the quality of soils in the vicinity of the UST to assess if spills or a release from the tank had caused soils to exceed Pennsylvania Department of Environmental Protection Statewide human health standards. On January 31, 2002, a Geoprobem rig was utilized to advance a total of six soil borings (GP-l through GP-6) around the perimeter of the 5,000-gallon UST. Figure 1 presents a sample location diagram showing the placement of each boring in relation to the UST. Continuous sampling at four-foot intervals was performed at each boring location from the ground surface to refusal, which varied from 8 feet to approximately 12 feet below ground surface (bgs). Soil was retrieved within the hollow sample collection tube in which an acetate liner was placed to hold the sampled soil. A new liner was placed in the tube for each sample retrieved. Once retrieved, the tube was cut open to inspect, screen and log the soil. Field screening of the soil was performed using a phomionization detector (PID) to screen for the presence of volatile organic compounds associated with hydrocarbons commonly found in waste oil. Encountered soil was generally a dark grey to light brown silty clay. A pronounced motor oil odor and stained soils were noted at a depth of 7 to 8 feet bgs in borings GP-4 and GP-5. Only a slight odor of oil was discerned in boring GP-1 at a depth of 8 to 9 feet bgs. No indications of petroleum impacted soils were noted in the other three borings. . Discrete laboratory soil samples were collected from specific zones in each of the borings. The sample was collected from the zone of highest apparent contamination (i-e., highest P1D reading or area with the most visual evidence of staining), when noted (GP-1 Q. 9', GP-4 Qa 8', and GP-5 Q 8'). At the other three locations (GP-2 @ 9', GP-3 Q 8.5', and GP-6 @ 9') where no visible signs of impacted soils were detected, samples were collected near the base of the UST at 9 feet bgs or refusal. All samples for analysis of volatile compounds s were collected by EPA Method 5035 using En Core'm sample devices and submitted extracted within the 48-hour hold time for laboratory analysis. Glass jars with Teflon- lined lids were also used for samples analyzed for semi-volatiles (base neutral compounds), total lead, and moisture. Q002 Mr. Don Smiley February 20,2002 EPSC #20013404 Protection (PADEP) used motor oil parameter list, which includes: benzene, toluene, cumene, ethylbenzene, naphthalene, benzo(a)anthme'ne, benzo(a)pyrena, benzo(b)fluoranthene, benzo(g,h,i)perylene, chrysene, indeno (1,43-cd) pyrene, pyrene, and total lead. Chain of custody documentation was filled out for the samples and accompanied the samples until delivery at the laboratory (enclosed). All samples were kept in coolers with ice. The samples were delivered by EPSYS to Analytical Laboratory Services, Inc. (PADEP Certification 422-293) in MiddIetown, Pennsylvania for analysis. Samples collected from soil borings GP-1, GP-2, GP-3, and GP-5 all were reported to have no detectable levels of base neutral, and volatile organic compounds. Sample GP-4 @ 8' had naphthalene detected at 380 micrograms per kilogram (µg/kg), while sample GP-6 @ Thad ethylbettzeue present at 2 pg/kg_ The PADEP action level for naphthalene in soils is 25,000 ug/kg, while the standard for ethylbenzene is 70,000 ug/kg. All soil samples had detectable levels of lead, which does occur naturally in Pennsylvania soils, ranging from 15 milligrams per kilogram (mg/kg) in GP-2 @ 9' to 67 mg/kg in GP-l @ 9'. The standard for lead in soil is 450 mg/kg. All soil sample analytical results are below the PADEP Standard/Action Levels (Act 2) for unsaturated soils- The laboratory analysis results are summarized in Table 1 and laboratory reports are enclosed. In conclusion, there is evidence of hydrocarbon-impacted soils along the western and southern end of the waste oil UST (fill port end of tank) which may be present due to overfill and/or spills during the filling and draining of the UST while in operation However, all analytical results from the soil samples collected around the exterior of the LIST were below PADEP Startdards/Action Levels for soils at UST closure sites. Plaintiff filed a Praecipe for Writ of Summons with this Honorable Court on or about November 26, 2003. 2. Pennsylvania Rule of Civil Procedure 400(a) provides that "original process shall be served within the Commonwealth only by the sheriff." Pa.R.Civ.P. 400(a). 3. In accordance with the Pennsylvania Rules of Civil Procedure, Plaintiffs directed the Cumberland County Sheriff to serve Defendant Smiley with the Writ of Summons atl15 East Columbia Road, Enola. PA, Cumberland County. 4. 115 East Columbia Road, Enola, PA, Cumberland County is the address of Defendant as it appears in the most recent Cumberland County telephone directory. 5. The Sheriff indicated to Plaintiff's Attorney, Charles E. Haddick, Jr., through his legal assistant, Kim Contini, that the Cumberland County Sheriffs were not able to serve Defendant at that address because Defendant would not come to the door when the Sheriffs arrived. 6. The Cumberland County Sheriff further indicated to Plaintiffs Attorney that it appeared that somebody was home at the above address. 7. Accordingly, Plaintiff filed the appropriate Praecipe to Reinstate Complaint with this Honorable Court in December, January, February, March, and April, each time requesting that the Cumberland County Sheriff serve Defendant at 115 East Columbia Road, Enola. PA, Cumberland County. 8. Pennsylvania Rule of Civil Procedure 430(a) provides that "[i]f service cannot be made under the applicable rule the plaintiff may move the court: for a special order directing the method of service." Pa.R.Civ.P. 430(a). 9. "The motion shall be accompanied by an affidavit stating the nature and extent of the investigation which has been made to determine the whereabouts of the defendant and the reasons why service cannot be made." T Fmm o L Ph e Y Phona R Fax 0 Pax X Subject: Phase II Soil Investigation Report for 5,000-Gallon Waste Oil UST Property at Susquehanna Ave. & Enola Rd., Enola, Pennsylvania EPSC #20013404 EPSYS Corporation (EPSYS) was retained by the Estate of Ross FL Smiley to perform a Phase 11 soil investigation for a waste oil underground storage tank (UST). The tank is on property located at the intersection of Susquehanna Avenue and Enola Road (U.S. Route 11/15) in Enola, Pennsylvania, Soil borings were advanced around the perimeter of the tank, samples screened and characterized in the field, and samples collected and submitted for. laboratory analysis of used motor oil parameters. The tank has a diameter of 72 inches and is approximately 23 feet long with an estimated capacity of 5,000 gallons. The purpose of the boring program was to investigate the quality of soils in the vicinity of the UST to assess if spills or a release from the tank had caused soils to exceed Pennsylvania Department of Environmental Protection Statewide human health standards. On January 31, 2002, a Geoprobem rig was utilized to advance a total of six soil borings (GP- I through GP-6) around the perimeter of the 5,000-gallon UST. Figure 1 presents a sample location diagram showing the placement of each boring in relation to the UST. Continuous sampling at four-foot intervals was performed at each boring location from the ground surface to refusal, which varied from 8 feet to approximately 12 feet below ground surface (bgs). Soil was retrieved within the hollow sample collection tube in which an acetate liner was placed to hold the sampled soil. A new liner was placed in the tube for each sample retrieved. Once retrieved, the tube was out open to inspect, screen and log the soil. Field soreening of the soil was performed using a photoionization detector (PID) to screen for the presence of volatile organic compounds associated with hydrocarbons commonly found in waste oil. Encountered soil was generally a dark grey to light brown silty clay. A pronounced motor oil odor and stained soils were noted at a depth of 7 to 8 feet bgs in borings GP-4 and GP-5. Only a slight odor of oil was discerned in boring GP-1 at a depth of 8 to 9 feet bgs. No indications of petroleum impacted soils were noted in the other three borings. . Discrete laboratory soil samples were collected from specific zones in each of the borings. The sample was collected from the zone of highest apparent contamination (i_e., highest PID reading or area with the most visual evidence of staining), when noted (GP-1 @ 9', GP-4 @ 81, and GP-5 @ 81). At the other three locations (GP-2 @ 9', GP-3 @ 8.5', and GP-6 @ 9') where no visible signs of impacted soils were detected, samples were collected near the base of the UST at 9 feet bgs or refusal. All samples for analysis of volatile compounds s were collected by EPA Method 5035 using En Col sample devices and submittedlext acted within the 48-hour hold time for laboratory analysis. Glass jars with Teflon- lined lids were also used for samples analyzed for semi-volatiles (base neutral compounds), total lead, and moisture. Mr. Ion Smiley February 20,2002 EPSC #20013404 Protection (PADEP) used motor oil parameter list, which includes: benzene, toluene, cumene, ethylhenzene,naphthalene, benzo(a)anthracene,benzo(a)pyrene,benzo(b)fluorantbene, beuzo(gh,i)perylene, ehrysene, indeno (1,2,3-cd) pyrene, pyrene, and total lead. Chain of custody documentation was filled out for the samples and accompanied the samples until delivery at the laboratory (enclosed). All samples were kept in coolers with ice. The samples were delivered by EPSYS to Analytical Laboratory Services, Inc. (PADEP Certification 1122-293) in Ddiddletown, Pennsylvania for analysis. Samples collected from soil borings op. 1, GP-2, GP-3, and GP-5 all were reported to have no detectable levels of base neutral, and volatile organic compounds. Sample GP 4 @ 8' had naphthalene detected at 380 micrograms per kilogram (pg/kg), while sample GP-6 @ Thad ethylbenzene present at 2 jig/kg- The PADEP action level for naphthalene in soils is 25,000 ug/kg, while the standard for ethylbenzene is 70,000 ug/kg. All soil samples had detectable levels of lead, which does occur naturally in Pennsylvania soils, ranging from 15 milligrams per kilogram (mg/kg) in GP-2 @ 9' to 67 mg/kg in GP-1 @ 91. The standard for lead in soil is 450 mg/kg. All soil sample analytical results are below the PADEP Standard/Action Levels (Act 2) for unsaturated soils. The laboratory analysis results are summarized in Table 1 and laboratory reports are enclosed. In conclusion, there is evidence of hydrocarbon-impacted soils along the western and southern end of the waste oil UST (fill port end of tank) which may be present due to overfill and/or spills during the filling and draining of the UST while in operation However, all analytical results from the soil samples collected around the exterior of the UST were below PADEP Standards/Action Levels for soils at UST closure sites.
