BENTZ, their and each of their respective heirs, personal representatives, personal representatives and assigns and any and all other persons or legal entities asserting or making any claim to any right, title or interest in or claim against the subject premises, Defendants. : IN THE COURT OF COMMON PLEAS OF : CUMBERLAND COUNTY, PENNSYLVANIA NO. et-/.2 ¢~ CIVIL TERM ACTION TO QUIET TITLE COMPLAINT NOW, comes the plaintiff in the above-captioned matter by and through her counsel, O'BRIEN, BARIC & SCHERER, and files this Complaint in an Action to Quiet Title against the above designated defendants, and in support thereof sets forth the following: 1. Plaintiff, Margaret E. Dyarman is an adult individual residing at 1030 Trindle Road, Carlisle, Cumberland County, Pennsylvania. 2. The defendants are individuals whose present addresses and whereabouts are unknown ( with certain exceptions where service will be made in accordance with the applicable rules), a diligent search of the records of Cumberland County having been made in an effort to determine the addresses and whereabouts of said defendants, said defendants being the heirs-at- law of Abner W. Bentz and Frederick and Henrietta Watts. 3. The title to the herein described premises became vested in the plaintiff and her husband, Arnold B. Dyarman, by deed of Paul W. Snyder and Marie M. Snyder, his wife, dated April 10, 1958 and recorded in Cumberland County Deed Book 18 "J" at page 63. Arnold B. Dyarman died on February 9, 1982 and plaintiff became the sole owner of the property by operation of law. 4. Title to the herein described premises was vested in Paul W. and Marie M. Snyder by deed dated June 20, 1957 from the School District of North Middleton Township and recorded in Cumberland County Deed Book 17 "W" at page 347. 5. The School District of North Middleton Township, by resolution dated April 19, 1955, recorded at Cumberland County Deed Book 16 "K" 248 stated that the herein described premises had been held and used by the School District since sometime prior to 1885 yet the School District was unable to find a deed or other instrument of conveyance to the School District or its predecessor. Said resolution further stated that the names of the owners of said real estate at the time of acquisition of the property by the School District were Abner W. Bentz or F. Watts. 6. Plaintiff is the owner as aforesaid and is in sole and exclusive possession of the following described real estate: ALL that certain tract of land situate in North Middleton Township, Cumberland County, Pennsylvania, bounded and described as follows: BEGINNING at a post on the western side of the road leading from Creek Road to Watt's Bridge; thence by the western side of said road, south 7 3/4 degrees West 270 feet, more or less, to a post; thence by land of the grantees herein, north 72 ½ degrees west 84.7 feet to a stake; thence by the same, north 7 3/4 degrees east 233.7 feet to a stake; thence by the same, north 82 3/4 degrees east 87 feet to the Place of Beginning. Being improved with a school house formerly known as Watts or Fairview School. 7. Plaintiff and her predecessors in title have been in continuous possession of the aforesaid premises since April 10, 1958 which said possession has been continuous, open, notorious and hostile since said date to the time of the filing of this Complaint. 8. None of the defendants, nor any of them, have ever made any claim for possession of, or of title to the premises herein described, nor has any action of ejectment or other proceeding ever been instituted to obtain possession. However, defendants, as prior record owners, may claim to have an apparent title, interest in or claim against the aforesaid described premises. This alleged or purported claim of the defendants may constitute a cloud upon the marketability of the title of plaintiff. WHEREFORE, Plaintiff prays that a decree be entered forever barring the defendants and their heirs, personal representatives and assigns, from asserting any right, title or interest in or to the real estate described unless within twenty (20) days from the date of the service of the Complaint, the defendants or their heirs, personal representatives or assigns commence an action of ejectment. Twenty (20) days has elapsed since publication of the Notices in the Cumberland Law Journal and the Carlisle Evening Sentinel. 4. No responsive pleading has been filed by any party to the complaint, no appearances have been entered and no action in ejectment has been initiated against Plaintiff. A true and correct copy of the docketing statement for this matter procured from the Prothonotary of Cumberland County is attached hereto and incorporated as Exhibit 3. 5. Diligent search has been made to obtain addresses or whereabouts of all individuals named as Defendants including intemet searches and review of public records and telephone indices and no named Defendants have been located. Petitioner is Margaret E. Dyarman, the Plaintiff in the above-captioned action. Plaintiff/Petitioner on the 7th day of March, 2001, filed with the Prothonotary of Cumberland County an action to quiet title whereby she requested that title to the following tract of ground be quieted and that it be determi~ed that she have sole fee simple title to the same. ALL THAT CERTAIN tract of land situate in North Middleton Township, Cumberland County, Pennsylvania, bounded and described as follows: BEGINNING at a post on the western side of the road leading from Creek Road to Watt's Bridge; thence by the western side of said road, South 7 3/4 degrees West 270 feet, more or less, to a post; thence by land of the grantees herein, North 72 1/4 degrees West 84.7 feet to a stake; thence by the same, North 7 3/4 degrees East 233.7 feet to a stake; thence by the same, North 82 3/4 degrees East 87 feet to the Place of Beginning. BEING improved with a school house formerly know as Watts or Fairview School. AND BEING the same premises which Paul W. Snyder and Marie M. Snyder, by Deed dated 4/10/58 and being recorded in Cumberland County Deed Book J, Vol. 18, Page 63, granted and conveyed unto Arnold B. Dyarman and Margaret E. Dyarman 2. Many of the aforesaid Defendants/Respondents are either dead or their whereabouts are unknown. To the extent that the whereabouts of some of the Defendants/Respondents can be ascertained service will be made in accordance with the applicable rules. 3. The Petitioner/Plaintiff, after making a diligent search and inquiry as evidenced by the attached internet search results and phone book search results, has been unable to ascertain the present whereabouts of marly of the above-named Defendants/Respondents and/or any personal representative of same, many of whom are deceased.
