Barrick, Late, of Upper Mifflin Township, Cumberland County, Pennsylvania, its Unknown Heirs, Successors, and Assigns. Defendant is Woodrow C. Stitt, an adult individual, with an address of 78 Conestoga Drive, Shippensburg Mobile Estates, Shippensburg, PA 17257. Defendant is Stilla Hess, an adult individual, with an address of 2913 Marietta Avenue, Lancaster, PA 17601. Defendant is Roger Stitt, an adult individual, with an address of 434 Hempfield Hill Road, Columbia, PA 17512. Chamberlin, an adult individual, with an address of 70 Dead End Lane, Shippensburg, PA 17257. 19. Defendants are any Unknown Heirs, Successors, and Assigns of the Estate of Isaac H. Barrick. 20. It is suggested that Isaac H. Barrick, is deceased. 21. It is suggested that no Estate for Isaac H. Barrick, Late, of Upper Mifflin Township, Cumberland County, Pennsylvania, has been probated or administered in Cumberland County; therefore, his property, both real and personal, passed to his heirs according to the intestacy statutes and laws. See 20 Pa. C.S.A. § 2101 et seq. and case law thereunder. 22. It is believed and therefore averred that Isaac H. Barrick was married to Annie (Derr) Barrick on December 10, 1894 based on the Geistown Bethany Church Marriage Registry, said church being located in Cumberland County, Pennsylvania. 23. It is believed and therefore averred that Isaac H. Barrick's wife, Annie (Derr) Barrick, predeceased Isaac H. Barrick, on or around May 24-26, 1905, as set forth on her tombstone in the Geistown Bethany Church Cemetery, located in Cumberland County, Pennsylvania. 24. It is suggested that no Estate for Annie (Derr) Barrick, Late, of Upper Mifflin Township, Cumberland County, Pennsylvania, has been probated or administered in Cumberland County; therefore, her property, both real and personal, passed to her heirs according to the intestacy statutes and laws. See 20 Pa. C.S.A. § 2101 et seq. and case law thereunder. 25. It is believed and therefore averred that Isaac H. Barrick and Annie (Derr) Barrick had four children, including Ida (Barrick) Stitt, Enoch Barrick, David Barrick, and J. Franklin Barrick, based on records located at the Cumberland County Historical Society and/or monuments or headstones located at the Geistown Bethany Church Cemetery. 26. It is believed and therefore averred that Isaac H. Barrick and Annie (Derr) Barrick's minor child, Enoch Barrick, predeceased Isaac H. Barrick on or around May 24-26, 1905, when he was seven years old, based on monuments or headstones located at the Geistown Bethany Church Cemetery. 27. It is believed and therefore averred that Isaac H. Barrick and Annie (Derr) Barrick's minor child, David Barrick, predeceased Isaac H. Barrick on or around May 24-26, 1905, when he was one month, twenty-four days old, based on monuments or headstones located at the Geistown Bethany Church Cemetery. 28. It is believed and therefore averred that Isaac H. Barrick and Annie (Derr) Barrick's child, J. Franklin Barrick, died on or around 1938 due to injuries sustained from a horse, when he was thirty-five or thirty-six years old, based on records located at the Cumberland County Historical Society, monuments or headstones located at the Geistown Bethany Church Cemetery, and/or information provided by Lucia F. Chamberlin. 29. It is believed and therefore averred that J. Franklin Barrick died single and without issue, based on records located at the Cumberland County Historical Society, monuments or headstones located at the Geistown Bethany Church Cemetery, and/or information provided by Lucia F. Chamberlin. 30. It is suggested that no Estate for J. Franklin Barrick, Late, of Upper Mifflin Township, Cumberland County, Pennsylvania, has been probated or administered in Cumberland County; therefore, his property, both real and personal, passes to his heirs according to the intestacy statutes and laws. See 20 Pa. C.S.A. § 2101 et seq. and case law thereunder. 31. It is believed and therefore averred that Ida (Barrick) Stitt was the only surviving child of Isaac H. Barrick and Annie (Derr) Barrick, who left issue based on monuments or headstones located at the Geistown Bethany Church Cemetery, Cumberland County Historical Society, and/or information provided by Lucia F. Chamberlin. 32. It is believed and therefore averred that Ida (Barrick) Stitt was married to Hayden Stitt who predeceased her on or around 1928 when he was thirty-one or thirty-two years old based on monuments or headstones located at the Geistown Bethany Church Cemetery, Cumberland County Historical Society, and/or information provided by Lucia F. Chamberlin. 33. It is suggested that no Estate for Hayden Stitt, Late, of Upper Mifflin Township, Cumberland County, Pennsylvania, has been probated or administered in Cumberland County; therefore, his property, both real and personal, passes to his heirs according to the intestacy statutes and laws. See 20 Pa. C.S.A. § 2101 et seq. and case law thereunder. 34. It is believed and therefore averred that Ida (Barrick) Stitt died on or around 1930 when she was thirty-three or thirty-four years old based on monuments and headstones located at the Geistown Bethany Church Cemetery, Cumberland County Historical Society, and/or information provided by Lucia F. Chamberlin. 35. It is suggested that no Estate for Ida (Barrick) Stitt, Late, of Upper Mifflin Township, Cumberland County, Pennsylvania, has been probated or administered in Cumberland County; therefore, her property, both real and personal, passes to her heirs according to the intestacy statutes and laws. See 20 Pa. C.S.A. § 2101 et seq. and case law thereunder. 36. It is believed and therefore averred that Ida (Barrick) Stitt and Hayden Stitt had six children, including Richard Stitt, Earl Stitt, Hayden I. Stitt, Leroy Stitt, Lucia F. Chamberlin, and Ross (Stitt) Fetrow, whom was adopted by Decree filed in the York County Orphan's Court dated July 1, 1946 attached hereto as Exhibit "1," and incorporated herein by reference as if set forth at length. All of the children survived Ida (Barrick) Stitt. 37. It is believed that Defendant Lucia F. Chamberlin may have had a one-fifth (115) interest in the real estate prior to the Upset Tax Sale, although it is believed and therefore averred that Defendant Lucia F. Chamberlin never made a claim to assert an ownership interest in the real estate. 38. It is believed and therefore averred that Richard Stitt married Dorothy L. (Worthington) Stitt, and predeceased her on November 10, 1989, based on information provided by John F. Worthington and the November 13, 1989 Shippensburg News Chronicle obituary attached hereto as Exhibit "2," and incorporated herein by reference as if set forth at length. 39. It is suggested that Richard Stitt and Dorothy L. (Worthington) Stitt had no children together. 40. It is suggested that no Estate for Richard Stitt, Late, of Upper Mifflin Township, Cumberland County, Pennsylvania, has been probated or administered in Cumberland County; therefore, his property, both real and personal, passed to his heirs according to the intestacy statutes and laws. See 20 Pa. C.S.A. § 2101 et seq. and case law thereunder. 41. It is suggested that Dorothy L. (Worthington) Stitt died on July 25, 2003 when she was seventy-five or seventy-six years old based on monuments or headstones at Parklawns Memorial Gardens and Mausoleums located in Franklin County, Pennsylvania and/or information provided by John F. Worthington. 42. It is suggested that no Estate for Dorothy L. (Worthington) Stitt, Late, of Upper Mifflin Township, Cumberland County, Pennsylvania, has been probated or administered in Cumberland County; therefore, her property, both real and personal, passed to her heirs according to the intestacy statutes and laws. See 20 Pa. C.S.A. § 2101 et seq. and case law thereunder. 43. It is suggested that Dorothy L. (Worthington) Stitt was survived by her son, John F. Worthington, who may have had a one-fifth (115) interest in the real estate prior to the Upset Tax Sale, who continues to reside upon the real estate as of the date of filing of this Complaint, and who conveyed any interest he may have had in the real estate to Plaintiffs by October 1, 2007 Quit Claim Deed and December 15, 2007 Correctory Quit Claim Deed, a copy of which is attached hereto along with the recording receipt as Exhibit "3," and incorporated herein by reference as if set forth at length. 44. The said Correctory Quit Claim Deed was recorded because the said Quit Claim Deed from John F. Worthington included an incorrect percentage intestate interest, one-sixth (1 /6) rather than one-fifth (115), and several incorrect recitations in the BEING clause due to misinformation provided to Plaintiffs prior to the filing of this Complaint and Plaintiffs discovering subsequent to the execution and recording of the Quit Claim Deed that Ross (Stitt) Fetrow was adopted by Decree. 45. It is believed and therefore averred that Earl Stitt married Elizabeth Stitt but predeceased her, based on information provided by Defendant Lucia F. Chamberlin. It is believed and therefore averred that Elizabeth Stitt is deceased based on information provided by Defendant Lucia F. Chamberlin. 46. It is suggested that no Estate for either Earl Stitt, Late, or Elizabeth Stitt, Late, both of Cumberland County, Pennsylvania, has been probated or administered in Cumberland County; therefore, her property, both real and personal, passed to their heirs according to the intestacy statutes and laws. See 20 Pa. C.S.A. § 2101 et seq. and case law thereunder. 47. It is believed and therefore averred that Earl and Elizabeth Stitt were survived by two sons, Defendant Woodrow Stitt and Defendant Roger Stitt, and one daughter, Defendant Stilla Hess, who may have collectively had a one-fifth (115) interest in the real estate prior to the Upset Tax Sale, although it is believed and therefore averred that Defendants Woodrow Stitt, Roger Stitt, and Stilla Hess never made a claim to assert an ownership interest in the real estate, based on information provided by Defendant Lucia F. Chamberlin, Defendant Woodrow Stitt, and/or Defendant Leroy A. Stitt. 48. It is believed and therefore averred that Hayden I. Stitt married Kathryn Stitt, who predeceased him, based on information provided by Defendant Lucia F. Chamberlin. It is believed and therefore averred that Hayden I. Stitt is deceased based on information provided by Defendant Lucia F. Chamberlin, Defendant Woodrow Stitt, and/or Defendant Leroy A. Stitt. 49. It is believed and therefore averred that Hayden I. Stitt and Kathryn Stitt were survived by two sons, Hayden F. Stitt and Defendant Leroy A. Stitt, and one daughter, Defendant Maxine Seibert, who may have collectively had a one-fifth (115) interest in the real estate prior to the Upset Tax Sale, although it is believed and therefore averred that none of them ever made a claim to assert an ownership interest in the real estate. 50. It is believed and therefore averred that Hayden F. Stitt is deceased based on information provided Lucia F. Chamberlin. 51. It is believed and therefore averred that Hayden Stitt, Jr. is survived by a spouse, Lena Stitt, based on information provided by Lucia F. Chamberlin. 52. It is believed and therefore averred that Hayden F. Stitt and Lena Stitt had three sons, Defendant Hayden D. Stitt, Defendant Ricky A. Stitt, and Defendant Robert Stitt. 53. It is believed and therefore averred that Leroy Stitt married Dorothy Stitt but predeceased her based on information provided by Defendant Lucia F. Chamberlin. It is believed and therefore averred that Dorothy Stitt is deceased based on information provided by Defendant Lucia F. Chamberlin. 54. It is believed and therefore averred that Leroy Stitt and Dorothy Stitt were survived by five daughters, Defendant Dorothy Gindlesperger, Defendant Peggy Horner, Defendant Doris Estay, Defendant Diane (Stitt) Rother, and Defendant Linda (Stitt) Hadix and one son, Defendant Leroy W. Stitt, Jr., who may have collectively had a one-fifth (115) interest in the real estate prior to the Upset Tax Sale, although it is believed and therefore averred that none of them ever made a claim to assert an ownership interest in the real estate. 55. The heirs of Ross (Stitt) Fetrow have no right, title, or interest in the Estate or the real estate because he was adopted by Decree as aforesaid. 56. It is believed and therefore averred that the above-named Defendants are the surviving intestate heirs to Isaac H. Barrick who may have had an interest in the real estate pursuant to 20 Pa. C.S.A. § 2101 et seq. 57. The real estate which is the subject of this action is located at 122 Gameland Road, Upper Mifflin Township, Cumberland County, Pennsylvania, with a Tax Parcel Number of 44- 07-0489-010 (hereinafter referred to as "the real estate"). 58. Isaac H. Barrick was the prior record owner of the real estate by virtue of a deed dated April 2, 1894 from Robert E. Shulenberger, executor of the last will and testament of Elizabeth Hershey, to him, recorded in Cumberland County Deed Book 5 E, Page 202, a copy of which is attached hereto as Exhibit "4," and incorporated herein by reference as if set forth at length. 59. Elizabeth Hershey took record title to the real estate by virtue of a deed dated March 22, 1878 from Henry Best to her, recorded in Cumberland County Deed Book 4 B, Page 167, a copy of which is attached hereto as Exhibit "5," and incorporated herein by reference as if set forth at length. 60. On September 21, 2006, the Cumberland County Tax Claim Bureau conducted an Upset Tax Sale of the real estate for unpaid real estate taxes and the Bureau received a high bid of $28,000.00 for the real estate from Plaintiffs. 61. On December 6, 2006, the Cumberland County Tax Claim Bureau, as Trustee and Grantor, conveyed the real estate by deed to Martin L. Weller and Diana M. Weller, said deed being recorded in Cumberland County Deed Book 277, Page 3991, a copy of which is attached hereto as Exhibit "6," and incorporated herein by reference. 62. There was a proceeding in the Cumberland County Court of Common Pleas at No. 2006- 5963 for distribution of the net proceeds of the Upset Tax Sale (hereinafter referred to as "the proceeding"). Those proceedings are incorporated herein by reference as if set forth at length. 63. The net proceeds of the Upset Tax Sale were significant. 64. Defendants Peggy Horner, Lucia F. Chamberlin, Dorothy Gindlesperger, and Doris Estay, among others, were given notice of, had an opportunity to be heard, and/or received all or a portion of the net proceeds of the Upset Tax Sale distributable as hereinafter set forth to the Estate of Isaac H. Barrick as part of the proceeding. 65. A Rule Absolute and Order for Distribution was entered on October 4, 2007 in the proceeding confirming the distribution of the net proceeds of the sale on September 21, 2006 of Tax Parcel No. 44-07-0489-010 absolutely. A copy of the said Order is attached hereto as Exhibit "7," and incorporated herein by reference as if set forth at length. 66. Among other distributions, $21,300.68 was distributed to the Estate of Isaac H. Barrick. 67. A map of the real estate is attached hereto as Exhibit "8," and incorporated herein by reference. 68. It is believed and therefore averred that Plaintiffs are the rightful and record owner of title to the real estate by virtue of their high bid at the Upset Tax Sale and the proceeding and, therefore, have the free and unencumbered right to possess the real estate. 69. It is believed and therefore averred that there are no liens against the real estate; however, this action was commenced to eliminate any right, title or interest Defendants may have had in the real estate, and/or any cloud on title Defendants may present to Plaintiffs. 70. It is believed and therefore averred that Defendants have no right, title or interest whatsoever in the real estate. WHEREFORE, Plaintiffs respectfully requests that this Honorable Court: 1. Determine that Plaintiffs' title is valid; 2. Determine that Plaintiffs have the unencumbered right to possess the real estate; 3. Determine that Defendants have no right, title or interest whatsoever in the real estate; and, 4. Order such other relief as the Court deems available and appropriate. On December 20, 2007 Petitioners/Plaintiffs commenced the above captioned matter by filing Plaintiffs' Complaint to Quiet Title to Real Property Against Defendants, Their Heirs, Successors, and Assigns. 4. With the exception of The Estate of Isaac H. Barrick, Late, of Upper Mifflin Township, Cumberland County, Pennsylvania, its Unknown Heirs, Successors, and Assigns, all of the above named Respondents/Defendants have been served with a copy of Plaintiffs Complaint to Quiet Title to Real Property Against Defendants, Their Heirs, Successors, and Assigns. 5. Plaintiffs diligently searched for all of the Heirs, Successors, and Assigns of Isaac H. Barrick, Late, of Upper Mifflin Township, Cumberland County, Pennsylvania, and investigated the family genealogy. 6. Plaintiffs' search and investigation of the family genealogy identified all of the above Defendants and John F. Worthington as the Heirs, Successors, and Assigns of Isaac H. Barrick, Late, of Upper Mifflin Township, Cumberland County, Pennsylvania. 7. John F. Worthington conveyed any interest he may have had in the real estate to Plaintiffs by October 1, 2007 Quit Claim Deed and December 15, 2007 Correctory Quit Claim Deed, a copy of which is attached to Plaintiffs' Complaint to Quiet Title to Real Property Against Defendants, Their Heirs, Successors, and Assigns, as Exhibit "3," and incorporated herein by reference as if set forth at length. 8. Pursuant to Pa.R.C.P. 430, an Affidavit executed by Petitioner/Plaintiff Martin L. Weller is attached hereto as Exhibit "P-1" and incorporated herein by reference as if set forth at length. 9. On February 28, 2008 an Order of Court was entered and a Rule to Show Cause was issued by Judge Kevin A. Hess upon all known Respondents/Defendants. 6. On March 5, 2008 Petitioners/Plaintiffs mailed notice of the entry of the February 28, 2008 Order of Court and Rule to Show Cause upon all Respondents/Defendants. 7. Diane (Stitt) Rother accepted service of Plaintiffs' Complaint on January 21, 2008; O.) Linda (Stitt) Hadix was served with Plaintiffs' Complaint on January 9, 2008 by the Somerset County Sheriff, and, P.) Lucia F. Chamberlin was served with Plaintiffs' Complaint on December 28, 2007 by the Cumberland County Sheriff. 3. After the lapse of 20 or more days from service of either Plaintiffs' Complaint or Plaintiffs' reinstated Complaint upon each of the known Defendants, the undersigned mailed a Pa.R.C.P. 1037 notice to each of them and hereby certifies to same. 4. As of the date of filing of this Motion, none of the known Defendants have entered a written appearance personally or by attorney or filed in writing with this Honorable Court their defenses or objections to Plaintiffs' Complaint. 5. On April 1, 2008 this Honorable Court entered an Order of Court authorizing Plaintiffs to obtain service of process by publication upon the Unknown Heirs, Successors, and Assigns of the Estate of Isaac H. Barrick, Late, of Upper Mifflin Township, Cumberland County, Pennsylvania pursuant to Pa.R.C.P. 430. 6. On April 21, 2008 the undersigned filed Proofs of Publication from the Carlisle Sentinel and the Cumberland County Law Journal confirming service of process of Plaintiffs' Complaint by publication on April 9, 2008 and April 11, 2008, respectively. 7. As of the date of filing of this Motion, none of the unknown heirs, successors, and assigns of the Estate of Isaac H. Barrick (unknown Defendants) have entered a written appearance personally or by attorney or filed in writing with this Honorable Court their defenses or objections to Plaintiffs' Complaint. 8.
