KNOW ALL MEN BY THESE PRESENTS, that Earl E. Kumpf, late of Hampden
Township, Cumberland County, Pennsylvania, deceased, died testate on March 25, 2007, having
first made his Last Will and Testament, which was duly executed on February 1,2006 and probated
in the Office of the Register of Wills of Cumberland County, on April 11, 2007.
WHEREAS, the said Earl E. Kumpf, by the aforesaid Last Will and Testament, named
Donald Vincent Kumpf and David Edward Kumpf to serve as Co-Executors of said Last Will and
Testament;
WHEREAS, Letters Testamentary on the Estate of the said decedent were duly issued by
the Register of Wills of Cumberland County, Pennsylvania, to Donald Vincent Kumpf and David
Edward Kumpf, as Co-Executors, hereinafter called personal representatives;
WHEREAS, the personal representatives have gathered the assets of the Estate of the said
decedent, paid all obligations of the said decedent and his estate with the exception of certain
anticipated obligations for which a reserve has been established, and have caused to be prepared
and filed a Pennsylvania inheritance tax return, and have prepared a first and final account, a copy
of which has been provided to each of the named beneficiaries of the Estate of decedent;
WHEREAS, Julianna Christine Kumpf, Daniel Paul Kumpf, David Edward Kumpf, and
Donald Vincent Kumpf are the heirs of the Estate pursuant to the terms of the Last Will and
Testament of the said decedent; and
WHEREAS, Daniel Paul Kumpf, individually and as trustee for his daughter, Julianna
Christine Kumpf, David Edward Kumpf, and Donald Vincent Kumpf hereby acknowledge that they
are in receipt af a capy af the decedent's Will, the Inventary filed af recard with the Register af
Wills af Cumberland Caunty, the Pennsylvania Inheritance Tax Return filed and appraved by the
Ca-Executars and a First and Final Accaunt which includes a propased Schedule afDistributian af
remaining assets af the decedent.
NOW, THEREFORE, Daniel Paul Kumpf, individually and as trustee far his daughter,
Julianna Christine Kumpf, David Edward Kumpf, and Danald Vincent Kumpf, being the sale and
anly heirs under the Last Will and Testament af the said decedent, and being the anly persans
entitled ta inherit under said Last Will and Testament, da hereby acknawledge that they have this
day had and received fram the afaresaid persanal representatives, in full satisfactian and payment af
all sums af maney, legacies, bequests, and devises as are given, devised and bequeathed ta each af
us respectively by the said Last Will and Testament, the amaunts due ta them under said Last Will
and Testament as set farth in the Schedule af Distributian, except far each respective beneficiary's
pra rata share af any unused reserves set farth in said propased distributian; and da hereby stipulate
that in arder ta avaid the expense and time invalved in the filing af a farmal accaunt and schedule
iDf distributian, we agree that na accaunt is necessary and we da hereby agree that we da cansent ta
distributian being made withaut the filing af an accaunt and schedule af distributian, the same ta be
with the same farce and effect as if they had been filed and canfirmed by the Orphans' Caurt
Divisian afthe Caurt afCamman Pleas afCumberland Caunty, Pennsylvania.
THEREFORE, we da hereby remise, release, quitclaim and farever discharge the said
persanal representatives, Danald Vincent Kumpf and David Edward Kumpf, their heirs, executars,
administratars and assigns, af and fram the said estate and fram all actians, suits, payments,
accaunts, reckanings, claims, and demands whatsaever far lOr by reasan thereaf, except far each
respective beneficiary's pro rata share af any unused reserves set farth in said propased distributian,
or far any ather use, matter, cause lOr thing whatsaever, tauching upan the Estate af the said
decedent, and we da further hereby cavenant and agree that shauld any liability came due ta the
estate af the said decedent after the signing af this Agreement, we da hereby cavenant and agree
that we will cantribute ta the Estate ta satisfy any and all claims, demands, suits, lOr causes af actian
which may be successfully prosecuted against the said Estate lOr the afaresaid persanal
rE~presentatives after the signing, sealing and delivery af this Family Settlement Agreement and
Final Release.
THIS AGREEMENT may be executed by the parties in multiple counterparts and shall
become effective when executed by all parties hereto.
IN WITNESS WHEREOF, we have hereunto set our hands and seals the day and year
noted below.
