CIVIL ACTION - MORTGAGE FORECLOSURE
1. Plaintiff is LaSalle Bank National Association, as Trustee for the registered holders of
Structured Asset Securities Corporation, Structured Asset Investment Loan Trust,
Mortgage Pass-Through Certificates, Series 2005-1 by its attorney in fact, Ocwen Loan
Servicing, LLC (hereinafter referred to as "LaSalle Bank National Association, as Trustee,
by its attorney in fact, Ocwen Loan Servicing, LLC") with offices located at 1661
Worthington Road, Suite 100, West Palm Beach, FL 33409.
2. Defendants are John Mayernick and Carrie Mayernick, adult individuals with a last-
known address of 1107 Shannon Lane, Carlisle, PA 17013.
3. Under date of 11/05/2004, defendants executed and delivered to MFRS, Inc., as nominee
for Finance America, LLC., DBA FinAm, LLC., a mortgage upon the premises 1107
Shannon Lane, Carlisle, PA (the "Property") to secure the payment of the sum of

(:]$17,000.0. The said mortgage is recorded in the Office for the Recording of Deeds in
or Cumberland County on 11/23/2004 at Book 1888, Page 4446 and is incorporated
herein by reference as though set forth at length herein. A copy of the legal description of
the premises is attached hereto and made a part hereof as Exhibit "A".
4. The said mortgage was assigned to LaSalle Bank National Association, as Trustee, by its
attorney in fact, Ocwen Loan Servicing, LLC, the within Plaintiff, by Assignment which
has been duly recorded or is in the process of being recorded.
5. Ocwen Loan Servicing LLC, successor to Ocwen Federal Bank FSB is the attorney in fact
authorized to act for Plaintiff.
6. Said Defendants are the real owners of premises 1107 Shannon Lane, Carlisle, PA 17013.
7. In accordance with Act 91 of 1983, as amended, a combined notice providing the
information required by §403 of Act No. 6 of 1974, and Act 91, aforesaid, was sent to the
defendants and no response was made in the appropriate period of time. A true and
correct copy of the aforesaid notice is attached hereto and made a part hereof as Exhibit
«B„
8. The said loan is in default as a result of the failure to pay the monthly installments of
$1,616.12 due on September 1, 2007 and on the same day of each month thereafter.

The attorney fees set forth above are in conformity with the mortgage documents and
Pennsylvania law, and will be collected in the event of a third party purchaser at Sheriffs Sale. If the
mortgage is reinstated prior to Sale, reasonable attorney fees will be charged based on work actually
performed.
WHEREFORE, Plaintiff, LaSalle Bank National Association, as Trustee, by its attorney
in fact, Ocwen Loan Servicing, LLC requests this Court to enter judgment for foreclosure of the
mortgaged property for the sum of $165,810.24 plus interest thereon of $7,078.07 plus $51.72 per day
from 12/19/2007 until judgment is paid in full, late charges of $628.18, plus late charges of $80.81 per
month from 12/19/2007 until judgment is paid in full, escrow advances of $0.00, fees billed of
$204.94, costs of $300.00, attorney's fees of $7,000.00 and all other amounts set forth above, less any
suspense as set forth above, together with record costs and any other amounts to which Plaintiff is
entitled to recover.

3. Denied in part and admitted in part. It is admitted that Defendants executed a mortgage
on the property located at 1107 Shannon Lane, Carlisle, PA on or about November 5,
2004. It is denied that the mortgage was delivered to MERS, Inc. as nominee for Finance
America, LLC, DBA FinAm, LLC. as Defendants are without knowledge or information
sufficient to form a belief as to the truth of that portion of the averment.
4. Denied. After reasonable investigation, Defendant is without knowledge or information
sufficient to form a belief as to the truth of the averment and strict proof is demanded.
5. Denied. After reasonable investigation, Defendant is without knowledge or information
sufficient to form a belief as to the truth of the averment and strict proof is demanded.
6. Admitted.
7. Denied in part and admitted in part. It is admitted that Defendants received a notice
substantially similar to Plaintiff's exhibit B, however it is denied that Defendants did not
respond to the notice as payments totaling $4,848.56 were sent to plaintiffs between
October 1, 2007 and December 15, 2007.
8. Denied. Defendants attempted to make the September and October payment by personal
check on December 15, 2007, four days before Plaintiffs complaint was filed. Plaintiff's
rejected this payment attempt on or about December 26, 2007 claiming the payment
amount was insufficient to cure the default. Defendants then executed a Forebearance
Agreement with Plaintiff.
9. Denied. After reasonable investigation, Defendants are without knowledge or
information sufficient to form a belief as to the truth of the averment and strict proof is
demanded.
WHEREFORE, for these reasons Defendant requests that the Court dismiss the Plaintiff's
complaint at the Plaintiff's cost.

TO THE HONORABLE, THE JUDGES OF THE SAID COURT:
The pleadings in this matter being closed, LaSalle Bank National Association, as Trustee for
the registered holders of Structured Asset SecuritiesCorporation, Structured Asset Investment Loan
Trust, Mortgage Pass-Through Certificates, Series 2005-lby its attorney in fact, Ocwen Loan
Servicing, LLC(hereinafter "LaSalle Bank National Association, as Trustee, by its attorney in fact,

Ocwen Loan Servicing, LLC" or "Plaintiff'), by its attorneys, Stern and Eisenberg LLP, requests this
Court to grant summary judgment in its favor for the following reasons:
1. In their Answer to Plaintiff's Civil Action-Action in Mortgage Foreclosure (hereinafter
"Complaint"), Defendants(s), John Mayernick and Carrie Mayernick (hereinafter
"Defendants") fully admits the following (as set forth in the paragraphs in the
complaint):
a. The identity of the Defendants (¶2);
b. The address of the Defendants (¶2);
c. The Defendants are the real owners of the Property, 1107 Shannon Lane, Carlisle,
PA (the "Properly")(¶6);
d. That the Defendants entered into the mortgage on the premises on 11/05/2004 as
more fully set forth in the complaint (¶3);
e. That the Defendants have failed to make the payments due from September 1, 2007
through to the current date (18)
2. In paragraph one, Defendants allege that after a reasonable investigation, they can
neither admit or deny the corresponding averment of Plaintiff's Complaint which sets
forth the Plaintiff's name and address. Notwithstanding, the Plaintiff's name is clearly
identified in the recorded mortgage documents to which the Court may take judicial
notice.
Further, the denial set forth in this paragraph are of no assistance to defendants
for the reason that they are patterned after Pa. R.C.P. No. 1029(c) that permits the
defendants to deny allegations of a Complaint based on insufficient knowledge, after
reasonable investigation.
Had defendants conducted even a minimal investigation, they could have readily
confirmed all the facts set forth since they are aware of the fact that LaSalle Bank
National Association, as Trustee, by its attorney in fact, Ocwen Loan Servicing, LLC is
the holder of the mortgage. Because this denial lacks specificity, as required by Pa.
R.C.P. No. 1029(b), it should be deemed an admission, and therefore, poses no bar to

summary judgment in Plaintiff's favor. Further, whether or not Defendant(s) admit the
address of LaSalle Bank National Association, as Trustee, by its attorney in fact, Ocwen
Loan Servicing, LLC is immaterial to the instant action.
3. In paragraph 3, the Defendants deny that LaSalle Bank National Association, as
Trustee, by its attorney in fact, Ocwen Loan Servicing, LLC is a holder of the mortgage
upon 1107 Shannon Lane, Carlisle, PA (the "Property")duly recorded in the Office for
the Recording of Deeds in and for Cumberland County in Book 1888, Page 4446 on
11/05/2004 and is incorporated herein by reference as though set forth at length herein.'
The denial set forth in these paragraphs are of no assistance to defendants for the reason
that they are patterned after Pa. R.C.P. No. 1029(c) that permits the Defendant(s) to
deny allegations of a Complaint based on insufficient knowledge, after reasonable
investigation.
Had Defendants conducted even a minimal investigation, they could have
readily confirmed all the facts set forth in the various paragraphs which contain
information regarding the mortgage duly recorded in the Recorder of Deeds for
Cumberland County which Defendants are the real owner according to the records at
the Recorder of Deeds, to which the Court may take judicial notice. Because these
denials lack specificity, as required by Pa. R.C.P. No. 1029(b), they should be deemed
an admission, and therefore, poses no bar to summary judgment in Plaintiff s favor.
Pursuant to 1019(g) the Court may take judicial notice of the existence of the
mortgage held by Plaintiff, LaSalle Bank National Association, as Trustee, by its
attorney in fact, Ocwen Loan Servicing, LLC. The Defendants must be aware of the
recorded mortgage and their failure to respond in any meaningful way should be
construed as an admission.
4. In paragraph 7 of their Answer, Defendants admit receiving the Combined Notices sent
pursuant to Act 91 of 1983.
' Further, any assignment has also been duly recorded in the Recorder of Deeds office as set forth in the Complaint, for
which the Defendants should also be aware.

5. In paragraph 8 of their Answer, Defendants deny that they missed payments and are in
default. The basis for the denial is that they claim on December 15, 2007, they attempted to
tender the payments for September and October of 2007, but Plaintiff returned them as
partial payments. This is true and Plaintiff acted in accordance with Paragraph 19 of the
subject mortgage. Paragraph 19 states that the Borrower has the right to reinstate the
mortgage, after default, if certain conditions are met. Those condition are that Borrower(s)
must "(a) pays Lender all sums which then would be due under the Security Instrument and
the Note as if no acceleration occurred; (b) cures any default of any other covenants or
agreements; (c) pays all expenses incurred in enforcing this security Instrument, including;
but not limited to, reasonable attorney fees, property inspection and valuation fee..."
By Defendants own admission, they were four (4) months in default when they tendered
payment for two (2) months ( September 2007 and October 2007). This was not the full
reinstatement as required by Paragraph 19 of the subject mortgage and therefore, Plaintiff
was correct in returning the partial payment. A true and correct copy of the subject
mortgage is attached hereto, made part hereof and marked as Exhibit "A."
6. In paragraph 8 of their Answer, Defendants also claim that they entered into a forbearance
agreement with plaintiff. This is also true; however the defendants also defaulted on that
opportunity to cure their arrears. In addition, under Paragraph 12 of the subject mortgage
and act of forbearance on the mortgagee is not a waiver of its right to protect its collateral
interest.
7. In paragraph 9 of their Answer, Defendants deny the allegations contained in paragraph 9
of Plaintiff's Complaint that sets forth the itemized balance claimed due.
This denial raises no legal defense to Plaintiff's Complaint because it is unsupported
by facts and further, relates to facts that defendant must necessarily know or could have
ascertained. As obligor on the loan, defendant must necessarily know whether or not they
have made monthly mortgage payments and; moreover, the amounts due on the loan are
readily calculable from the documentation in this case and clearly established by reference
to the Promissory Note, which is attached hereto and made a part hereof as Exhibit "Al",

the Affidavit of LaSalle Bank National Association, as Trustee, by its attorney in fact,
Ocwen Loan Servicing, LLC's representative and corresponding business record, payment
history for defendants' loan, which is attached hereto and made a part hereof as Exhibit
«B,1
In addition, the basis for the costs and attorney's fees can be ascertained from the Note, Exhibit
"A1" hereto and the Affidavit of Kevin P. Diskin, Esq., which is attached hereto and made a part
hereof as Exhibit "C".
Therefore, this Answer is not an effective denial as contemplated by Pa. R.C.P. No.
1029(c), and as such, must be deemed an admission.
WHEREFORE, Plaintiff, LaSalle Bank National Association, as Trustee, by its attorney in fact,
Ocwen Loan Servicing, LLC requests this Court to enter judgment for foreclosure of the mortgaged
property for the sum of $165,810.24 plus interest thereon of $7,078.07 plus $51.72 per day from
12/19/2007 until judgment is paid in full, late charges of $628.18, plus late charges of $80.81 per
month from 12/19/2007 until judgment is paid in full, fees billed of $204.94, costs of $300.00,
attorney's fees of $7,000.00 and all other amounts set forth above, less any suspense as set forth above,
together with record costs and any other amounts to which Plaintiff is entitled to recover.

I, Jessica Dybas, being duly sworn according to law, depose and say:
1. I am a Default Liaison of LaSalle Bank National Association, as Trustee,
by its attorney in fact, Ocwen Loan Servicing, LLC, the above named
Plaintiff. I have personal knowledge of the matters hereinafter referred to
and have the authority to make this Affidavit in Support of Plaintiffs
Motion for Summary Judgment.
2. Under date of 11/05/2004, Defendant(s) executed and delivered to MERS,
Inc., as nominee for Finance America, LLC.,D a mortgage upon the
premises 1107 Shannon Lane, Carlisle, PA (the "Property")to secure the
payment of the sum of $170,000.00. The said mortgage is recorded in the
Office for the Recording of Deeds in and for Cumberland County on
11/05/2004 at Book 1888, Page 4446.
3. Defendant(s) are in default on the loan as a result of the failure to make
the monthly payment of $1,616.12 due on September 1, 2007 and on the
same day of each month thereafter.
4. The payment history attached as Exhibit "B" to the Motion, is a true and
correct accounting of payments received from defendants. The payment
history is maintained as a business record in the ordinary course of
Plaintiff s business.
5. The balances claimed for principal, interest, late charges, escrow advances
and fees billed (and all other amounts due), were correctly computed and
are due and owing Plaintiff.
6. There is no genuine issue of material fact in this matter and trial of this
case would be an undue expense and burden to Plaintiff.

1. I am an attorney for LaSalle Bank National Association, as Trustee, by its attorney in
fact, Ocwen Loan Servicing, LLC, the above named Plaintiff. I have personal
knowledge of the matters hereinafter referred to and make this Affidavit in Support of
Plaintiffs Motion for Summary Judgment.
2. I ordered and reviewed a search of defendants' property; filed the Civil Action-
Mortgage Foreclosure; and, reviewed defendants' Answer and prepared the instant
Motion for Summary Judgment.
3. It is anticipated that if Plaintiff prevails on this motion, it will be necessary to issue and
complete execution, attend Sheriffs Sale and possibly file an ejectment action
thereafter. In addition, there is the possibility of a full trial and/or bankruptcy or
multiple bankruptcies.
4. The attorney's fee of $7,000.00 is thought to be fair and reasonable under all the
circumstances, particularly in view of the fact that it must be fixed at the
commencement of the proceeding. In any event, counsel would be willing to allow the
Court to fix a different attorney's fee should the Court deem it appropriate.
5. The amount claimed for costs is an estimated amount. Should Plaintiff obtain judgment
is in this matter, and defendants' property be listed for Sheriffs Sale, there is no
question that the cost of this proceeding will greatly exceed the estimated amount of
costs. In any event, actual costs are of record.
