STIPULATION AGAINST LIENS
THIS AGREEMENT made the +~ ~ of December, 2007, by and between
MADISON & SONS CONSTRUCTION, LLC,
hereinafter referred to as Contractor,
AND
DUANE M. DONISON,
hereinafter referred to as Owner,
whereby the former undertook and agreed to erect and construct a single family
residence on that certain lot of ground known as: Lot No. 16, Red Oak Estates,
Cumberland County Plan Book 93 Page 105, to be known and numbered 2 Marcella
Way, Carlisle, Pennsylvania. Further described in the attached legal description.

NOW THEREFORE, THIS AGREEMENT WITNESSETH: That the said
Contractor, for and in consideration of the sum of One and 00/100 Dollar ($1.00) to
Contractor in hand paid by Owner, the receipt whereof is hereby acknowledged, and
the further consideration mentioned in the agreement aforesaid, for themselves and
their subcontractors, and all parties acting through or under them, covenant and agree
that no mechanic's liens or claims shall be filed or maintained by them or any of them
against the said buildings and the lot of ground appurtenant thereto for or on account of
any work done or materials furnished by them or any of them under said contract or
otherwise, for, towards, in, or about the erection and construction of the said buildings
on the lot above described, and the said Contractor, for themselves, their
subcontractors and others under them hereby expressly waive and relinquish the right
to have, file, and maintain any mechanic's liens or claims against the said buildings or
any of them, and agree that this instrument, waiving the right of lien, shall be an
independent covenant.

LEGAL DESCRIPTION
ALL THAT certain tract of land situate in West Pennsboro Township, Cumberland
County, Pennsylvania, being more fully shown on a Final Subdivision Plan for
Pennsylvania Builders and Developers, prepared by Madden Engineering Service Inc.,
dated March 31, 2006 and recorded January 17, 2007 in Cumberland County Plan
Book 93 Page 105, described as follows:
BEGINNING at a point located along a public right-of-way known as Young Drive at the
land now or formerly of Plainfield Gospel Outreach Ministries; thence along corner of
Lot #14; thence along Young Drive, thence North 40 degree 3 minutes 46 seconds
East, 91.51 feet to a point at the corner of Young Drive and public right of way known
as Marcella Way; thence along Marcella Way by a curve to the right having a radius of
16.00 feet, an arc length of 25.13 feet, a chord bearing of South 85 degrees 03 minutes
46 seconds East and a chord length of 22.63 to a point; thence still South 49 degrees
56 minutes 14 seconds East, 45.50 feet to a point; thence still, by a curve to the left,
having a radius of 225.00 feet, an arc length of 80.19 feet, a chord bearing of South 60
degrees 08 minutes 49 seconds East and a chord length of 79.76 feet to a point at the

Outreach Ministries, North 49 degrees 56 minutes 14 seconds West, 140.00 feet to a

BEING Lot #16 of the aforementioned subdivision plan and CONTAINING 15,220
square feet.
BEING a portion of the premises which Glenn L. Young and Marcella E. Young, by

Deeds in and for Cumberland County, y
granted and conveyed unto Pennsylvania Builders and Developers, LLC.
AND BEING the same premises which Pennsylvania Builders and Developers, LLC by
Deed dated and recorded even date herewith in the Office of the Recorder of Deeds in
and for Cumberland County, Pennsylvania, granted and conveyed unto Duane M.
Donison.
